No cops can't go around identifying anyone they want & especially on private property. These cops have limited power anyway. They can't go to another state and treat society like this. The guy definitely has Common Constitutional grounds to sue them on in federal court . He wasn't even driving or the 1 they pulled over.

It's not crazy at all. It's quite well orchestrated. They've been militarizing and weaponizing the police for the last 30 years. They hire former military as often as possible (they make great order followers) and they hire as many useful idiots (functional morons) as possible. Why would the so-called powers that be care if their enforcers take charges? They're stealing our money to pay for it on both ends. They lose nothing. And "we the people" allow it. Society has failed us sane rational people.

Of course they do...back at the station, "See how he fabricated a pretext to demand ID that escalated into am arrest"...High 5's all around... Even though a seat belt violation is a "moving violation" must be observed while the car is in motion - back passenger has a lap belt - makes it impossible to see...Cop only saw it when he leaned in - EASY dismissal at trial....And tat turns the failure to ID a moot point

I'm 77 and though never arrested or charged with a crime it is perfectly clear to this old disabled veteran that things are going to get much worse, especially since there's no legislator(s) willing to rein in these out of control militarized, weaponized cops that are operating as though Martial law is already here. What's crazy is that even that trained, experienced lawyer STILL can't tell you directly if it is legal or illegal to ride in the back seat of a car on private property without a seatbelt. Yet somehow everyone is supposed to know. If the lawyers don't know, what hope does anyone else have to know.

They're in a parking lot!They're not required by law to wear a seat belt in a parking lot!!My dad wrote his motorcycle across the parking lot without his helmet on in front of the cops stopped before he left the parking lot parked the bike and walked away and everybody is like. How did you ride your motorcycle without them pulling you over without your helmet on?. My dad said it's a private parking lot it's not the road.

I don't know if it is federal law but I believe that almost anywhere an officer has the option of arrest for any minor ticketable offense. A ticket is basically a summons to appear in court but most people don't, they just plead guilty and pay the fine. But the roadside issuance of a ticket is in lue of an arrest and having a judge issue a summons to appear. But it's my understanding that an officer can decide to arrest you and take you before a judge. The idea of a ticket was invented to reduce simplify things IIRC. Don't take any of this as gospel, I'm just going from memory.

An infraction is not a crime and therefore an arrest cannot be made. You can only be arrested for a misdemeanor or felony. If the passenger was going to be issued an infraction ticket for the seat belt then should have requested the passengers information for the ticket. A drivers license is not required in order to be a passenger in a vehicle nor is an ID required.

@@ToddKing in florida almost all traffic offences are civil. they call them civil to avoid jury trials. in Florida you are not granted a jury trial for civil infractions under a certain amount... magicly all tickets fall under that amount. no one fights the unconstitunalty of that law because its not worth it.

But besides reading that they could affect an arrest somewhere quite some time ago I think I remember an Audit the Audit video where the cop arrested someone over a traffic offense and like he does on that channel he went and pulled up either the law or case law that showed that is was legal for the cop to make an arrest. But maybe he was charged with a misdemeanor that is normally just ticketed and the cop chose to make an arrest. Again I'm just going from memory.

Bless Josh's heart.. he was definitely being bullied and harassed unjustly and unethically.. I've heard/seen stories about how egregious the LEO up there are in that part of the country, and this just confirms that even more.. all of this bs simply because of an initial license plate location is inconceivable and unacceptable on so many levels.. I'd probably have simply told them that I didn't have it on me at the moment and that I'd accidentally forgotten it at home, in my car or something just to shut them up about it.. the fact of the matter is that their business was with the driver alone.. they chose to escalate the situation outta sheer ego, which seems to get bruised extremely easily the minute they're not shown the fearful compliance they're so used to receiving.. total abuse of power and absolute lack of justice.. they should most certainly NEVER be allowed to have as much power as they are given... my heart and prayers go out to you Josh.. stay righteous and never let them bully you darlin.. @Fresh Pack ummm, next door to Maine in NH, a non minor not wearing a seatbelt is 100% legal. Over 18, you don't have to buckle up in vehicles or wear a helmet on a motorcycle. NH takes "Live Free or Die" quite literally in some instances. 😆 🤣

@@chucknorris277 Yeah the Superior court judge probably does but he also has to follow the law set forth by the higher courts, especially SCOTUS. Even if the trial judge doesn't buy in, the Appellate will reverse on appeal. It will just take longer but the result will be the same.

A seat belt is a civil infraction, not a crime. On top of that, on private property, civil infractions can't be inforced. He will have it thrown out in court.

Yeah some bad judges have ruled differently on private roads that go through. I don't even stop at stop signs unless they are state issued or it is safer to do so in parking lots if exiting onto a main road if it's not a state sign I'd rather fight it in court cities are supposed to make deals about that it must be state issued!The only traffic enforcement in my state on private property is criminal things like reckless driving peeling out doing brodies in a parking lot with people in it can be arrested!

If they refuse, then he can then sue them civilly and they will have to pay reasonable attorney fees when they get the court order to dump the data.

You see, the job was working for the police in an IT role, and on the application I had to list any and all encounters I've ever had with police. I had never been arrested, never so much as had a ticket, but when I was 15 I got busted at a festival with a smoking bowl, but I didn't list it because it honestly had slipped my mind. I was never booked, but detained, questioned, and my parents came to pick me up, but it was the data from this encounter that got me. Since I wasn't arrested nothing ever got entered into the judicial and/or criminal database, but it turns out the police have internal records that they keep and use. Any time they ask for your name or whatever you can bet your sweet ass that it's going into this database. You might think nothing of it, but 15 years later a situation may arise where the cops will go "well, if it isn't Mike Smith, an officer Jenkins picked you up on this at the same spot 15 years ago" or whatever and you can bet your ass that information won't benefit you one bit.

@@Hear-MeoutTwo2 the only caselaw exceptions I've ever read are the Supreme Court has allowed smaller juries of 6 some municipal courts have denied juries but you can always demand it and appeal and get one because on appeal you go before a judge not an administrator calling themselves a judge and they must follow the law! For criminal violations! The Supreme Court said all serious violations must have a full jury of 12 but has left vague what is a serious crime but the basic setup of the court generally are serious crimes can't be heard in municipal court which perseveres the right to a full jury of twelve!

It's because of qualified immunity that they play dumb. Qualified Immunity specifically protects cops for mistakes caused by not knowing the law. It's literally part of the defense.

I saw a video on KZbin, maybe it was on lackluster that showed a bogus not wearing seatbelt traffic stop. A woman in Texas was driving along a highway, the cop did a quick u turn to pull her over for not wearing a seatbelt. She had a dash cam that showed her seatbelt on until she came to a complete stop on the side of the road. All on video. The cop issued her a ticket. She took it to court and it was thrown out immediately

Thank you God for bringing these Demons to my attention. I had been making plans of traveling through the area. One of my greatest fears has been in thinking of such a trip was roadside Terrorists in Blue looking For excuses to cause harm. I now will never travel to Maine ever again. The more rural you get the potential for bodily harm increases from the armed Terrorist in Blue.

The fact that serious crimes were unfolding while these five piggies were focused on a grown man not wearing a seatbelt in the BACK of a car just shows how absolutely shitty our so called “justice system” is.

My biggest take away is how much the police want to escalate a situation. Imagine the guy was mentally ill or feared for his life how bad this could turn out.
