You're right, powers that be are stripping rights. I'm older(over 60) & even we didn't get much Constitutional information but these younger officers only know how to spell the word & the swore an Oath that they violate everytime the LIE on a Police Report. The Pros Attorney violates their Oath everytime they catch a LIE on a Report & fail to Charge the perjury like they should. That's 2 public servants who never keep the laws they swore to uphold & b/c they are always trying to hurt the public & will lie to do it, that makes their relationship a conspiratorial one that's against the People! Judges are the last leg in this System of Legal checks -n- balances but who's really upholding Justice? IDKnow anymore? peace man

He should not sue, he would be ill advised to sue, yes the detainment is most likely unlawful but the courts are corrupt, the lower court judges do not understand or choose to ignore case law, they just support the unlawful actions of the police. It is only at circuit court you actually have a chance of an honest knowledgeable judge, but Robbins v Des Moines (8th circuit) shows that circuit judges can also be corrupt and or wrong. It is seriously not worth suing this encounter, don't do it.

Where, better yet, why, do you think LEO MUST ID verbally? It's not a law or policy of ALL departments, some require, officers ALWAYS ID by having their name tag and badge number (those that don't have badge numbers, ID by name tag) displayed on their uniforms. So stop making up shit, you losers.

Exactly, and it's also by policy. Take LEO entrance exam. You will be rejected because you fit a profile that doesn't lend itself to a career minded person. They want someone for long haul (30 years usually). The way they do this is by hiring the village Id10ts. If you are not on the left side of the bell curve you don't qualify to be a LEO.

They won’t admit it but they want your ID because it’s their department policy. Their policy says grab ID from everyone you come in contact with and run their name for warrants. It’s completely unconstitutional but they don’t care. So just like the sheep they are, they run around violating people’s rights because their boss told them to. Nothing ironic about this whatsoever. This is intentional. "Law" is man made and enforced via violence. Whomever has the predominant violent force controls the "law." Said force is not obligated to know or follow the "law." They impose an agenda through violence, not the "law." Fighting the predominant violent force with "law" is a fool's errand. I think it’s human nature to become suspicious of anyone who appears to be hiding something. I don’t blame the cops for being suspicious of him, as the conversation progresses. In their eyes they potentially are confronting someone who has an arrest warrant. Unfortunately they don’t have the legal justification to be “suspicious”, but they feel like they can set that aside in order to do their “main” job of finding criminals. I just don’t think you can ever get a cop to back down once you’ve activated their salivary glands. It’s literally animal instinct to try and apprehend an intruder/enemy. I honestly don’t think these measily lawsuits are doing ANYTHING to prevent cops from continuing to do this across the nation. There needs to be activism or protests across the country. At the very least, it makes me want to confront my own PD to make sure they realize that they are on notice. They violated my 1st and 2nd Amendment rights, and I gave them a pass. But maybe that was a mistake.

The clueless expression on the face of that ponytailed quota hire said everything about the uselessness of the vast majority of today’s cops. It’s beyond ridiculous that anyone would have to give up their identity, a sacred right to anonymity, to a government official just because they think they have the right to demand it, minus any reason other they they “need to know”. The fact that so many Americans have become conditioned to simply comply to this abuse of their fourth amendment really worries me, another step on the slippery slope to us losing all our rights. If cops can commonly believe this is acceptable, we’re in bigger trouble than most of us realise. OUTRAGEOUS!

Well said topramen5718, I agree. & partially due to most police officers having to wear body cams these days. The police academy is also teaching drama classes for the purpose of officers being properly prepared to act emotional or hurt on a dime if potentially needed too. But WE THE PEOPLE, We know that the main reason for these drama classes is mainly being taught to officers because of reasons regarding situations where there are civilians on scene, who are armed with their own personal & *" dangerous " cameras "*. This will ensure that the trial is on Neutral Grounds and taken out of the hands of the Same Municipality that arrested you. REMEMBER: In these municipalities, all the people there are Paid by the same City that is seeking to take your money and save their own skin. ALL involved, except you, ARE PAID BY THE CITY. He does not have to dispel anything, and in fact it's dangerous to do that. Anything you say can be used _only_ against you. Anything you said that was not against you must be ignored. It's called the rule of evidence. This means that you can't dispel any suspicion by definition.

@@MiamiCereal Correct! As a Dutch citizen, on vacation as tourist in the US, I had my rights violated twice. During my third and sixth visit. The first one was a stand-off about ID for no reason. In my company there was a National Reserve NATO IT specialist, who would ruin his career when mentioned in ANY US police report. So we were there on the streets for over two hours surrounded by twenty police(wo)men. Finally we left without showing ID's. Second time was at the Hoover dam where our RV was invaded, searched, and cloths, sheets, blankets were thrown on the floor, than 'decorated' with the content of every kitchen container, coffee, pepper, nutmeg, cinnamon, with a topping of ketchup, soy sauce, chilly sauce, milk... After that friendly encounter with US police, we swore we would never be back again in that horrible country. We had seen enough!

Was not an illegal stop. They can stop and question you for being at a business like this due to suspicious activity. However there is a line at which if they cannot articulate a crime, then they need to let you go. They cannot force you to ID without a crime. Reasonable Articulable Suspicion dictates that you must know, without a doubt, a crime has been, is happening or is about to happen. That is the only correct way to ID. They would have put cuffs on him and taken him to jail straight out the gate if that was the case. He couldve just said "If Ive commited a crime of suspicious activity, then take me to jail now." And they wouldnt have done anything but it wouldve shown they were lying.

I agree. The lack of knowledge of the actual law is the problem with LEOs. They are trained stupidly by other LEOs that have no clue. The Academy they learn in only teaches the barest of minimums. They need Defense Lawyers and Constitutional Attorneys teaching law at every Academy. The State Academies are where this needs to be taught. Not just for a few hours, but for weeks ans a test at the end of those weeks. A pass fail academics Course in Constitutional Rights. If you fail you fall the entire Academy Course. You cannot become a LEO without it, then go home WE THE PEOPLE DONT NEED YOU TO BE IGNORANT OF THE BASIC CONSTITUTIONAL RIGHTS.

It will get worse if the economy continues to decay and there are more homeless hanging around their neighborhoods and businesses or anyone who "doesn't belong". And if the police don't handle it, average citizens will on their own. The Bill of Rights was pretty much suspended during the Great Depression. People were routinely told to "move along", or even deported from various states.

Whilst I agree with the sentiment, just saying things people like, has already filled Congress with sound bite morons (MGT, Hoebert) who have no ability to legislate in the interests of the citizens they represent. Check out cursus honourum. This and early civics lessons to install a respect for the system of government may save the republic from itself

Ask cops in these situations for their unlocked cellphones so you can go through their phones to make sure they aren't involved in any illegal activity. When they say no. Ask what they are hiding and demand the other officers detain them for being suspicious for hiding the contents of their phone.

No, this is not going to fix it (or will just introduce other problems). Stop just sheepishly repeating junk you read/hear. Police play an important role in our society. We just need better ones and/or they need to he held accountable for their actions when they do stuff like this. A reform would be a better approach. Better training, no qualified immunity, no paying settlements with taxpayer money, actual consequences for blatantly violating rights - things like these are what's needed.
