if my wife hides her employer details and income in rajnish vs neha affidavit in DV case and in bank statement which she already attached with the DV petition which clearly shows her salary in her bank statement. should i go for 340 crpc and will it be fruitful for me. Kindly suggest

In Rajnish Neha affidavit wife concealed her immovable property(Flat, Notarised colony Flat kacchi colony) & tempered the affidavit question to (movable property) with answer NA. Husband submitted that flat mortgage agreement , executed till date of marriage month minus 30 days. Now in 340 reply by wife, she is saying that flat was sold much before marriage but did not show any sale deed papers or money transaction in bank .. What will happen in this case against fraud wife ? Whats the law point to enforce her to submit sale deed papers.. to show bonafide and not only statement.

Pls reply my wife left my house willingly alongwith her brother on pretext to visit her parental house. Later on filed false maintenance case stating my husband's family beaten me and thrown me out of my matrimonial house. Tell me since there's a law u/s 125(4) crpc and it may affect maintenance amount is this perjury? As i have cctv footage, photograph of her leaving and police enquiry reports station she had willingly left her matrimonial home. Its different situation other than fabricating employment statement. Pls reply

Thanks Nitish. This video was insightful. Especially the timing of invocation. I came across a recent Delhi Court Judgement Rahul Kesarwani vs State Of Nct Of Delhi & Anr. on 19 November, 2024 where After Trial Courts acquitted husband of 498A, husband invoked Section 340 CrPC on wife for submitting false evidences related to forged jewelry bills, income statements etc. These evidences were clearly fabricated and hence proven wrong by husband in trial court. However Magistrate Court ,then the Sessions Court and later High Court did not agree to initiate Section 340 was these fabricated evidences were not materially obstructive to justice. Now question is what kind of material evidences if proven wrong could be initiated for perjury proceedings ? Hats off to Rahul for fighting this case for 13 years !!!

In her income affidavit for DV, she has added: 1. a picture of burnt marks in the hands, which is made up and not true 2. is working but has mentioned she is not working 3. Has added bank statements with clear transaction with 2nd or even 3rd account but has declared that she has only 1 account to her name.

what if she has mentioned that she is not working and has no assets in her R vs N ffidavit and she has given a contradictory statement in another matrimonial affidavit that she is working and she has XXXX assets . Can I use this contradiction as sufficient evidence for 340 or should I insist on sec 91 ..?

Wife filed cases against me with the following false claims: She is a working woman but still declared herself as housewife She has not declared anything about her assets and liabilities while filing section 24 She has provided false and ambiguous figures about my job and salary She has provided allegations like I beat her during arguments but those things didn't even happen afterall.

If its in trial court, then provide evidences to disprove her and first try to get acquaintance from trial court. Then may be think of Section 340 later.

Understand this. Proving statements as contradictory or evidence as wrong confines to perimeters of 498A. For Section 340, it should be such that wife herself admits n court that she gave false statement and that court accepts that false statement has significantly impacted justice process.

Yes, as per noticing wife's condition the lawyer take the advantage and make false argument like dowry in her petition but wife that time not in condition to remove it and finally filed in court..... Baad mein wohi lawyer other party se paisa lek wife ki case vitiate kar deta hai.... This is the ill practice of advocacy.
