arrested because you were legally taking pictures in a public space and someone asked you to stop, and you didn't. You were acting legally correct and didn't have to stop. The security guards authority stops at the doors and not in the public street. This is why I've started campaigning for police to be educated on the law much like a lawyer/solicitor because they've just wasted their own time due to ignorance.

About 10 years ago the chief of police was on the news saying that Section 43 cannot be used to stop and search people simply for taking photos. A letter stating this, which I have a copy of, was sent nationwide to police forces. Since then, the police have got WORSE. As a photographer, I've had run-ins with police before and I can confidently say that if they tried to detain me, I would 100% not cooperate in any way. I'm a decent law-abiding citizen who's polite and friendly to everyone, but I've had enough of the police in this country and will never cooperate with them again when they confront me.

The police would know this is they actually read section 43 as it's very clear and written in very simple, clear language. "A constable may stop and search a person whom he *reasonably suspects to be a terrorist* to discover whether he has in his possession anything which may constitute evidence that he is a terrorist." They don't reasonably suspect that he's a terrorist and filming in public isn't grounds to suggest you're a terrorist and neither is refusing to give your name or that would be in the section 43 wording. They know he's a KZbinr who films police stations and the court will find in ABs favour assuming that it gets that far they don't offer to settle out of court.

@@dave030569there are certain circumstances where police in the UK are given immunity, for example, undercover cops. However this doesn't apply to the majority of uniformed officers. In theory at least the law applies to them the same as everyone else, and as such, they can be held criminally liable for their actions. However for civil suits it's far more complicated. In general employers are vicariously liable for their employees and need to pick up the tab for any damage that they cause. Police included unfortunately.

I repeat. When an arrest is unlawful, everything that follows is unlawful. You are in fact under arrest and the reason for arrest should be told to you and you should be cautioned and taken to a police station for interview. This is a serious civil and criminal offence. Make sure they pay big time AB.

@@ajl4656 Firstly AB was detained on suspicion of terrorism, hostile reconnaissance. There was absolutely no reasonable grounds to suspect him of that offense, suspicion is based on objective features ,not just a ‘feeling’ He was handcuffed and searched. Under that power he is not obliged to give his name etc. Having searched and found nothing on him the police are obliged to remove all restraint and release him. He is not obliged to show his photos or give any code to unlock the phone . The police are not allowed to keep AB in detention whilst they search for a reason to obtain details or find an offense to, in fact , continue detention. If he is not released after reasons for detention are satisfied he then moves from being detained to being under arrest and reasons for the arrest must be given ,caution given and removed to a police station for investigation. So by the time the police came up with a ‘reason’ for arresting him he had already been unlawfully arrested for some time. The police cannot threaten him with extended detention if he does not give what he is not obliged to give. That is a serious offense Finally S50 does not apply to a person lawfully taking photographs in a public place. So once again the police are acting unlawfully. So far the police have unlawfully detained AB, assaulted him ,committed a battery causing ABH, unlawfully arrested him, unlawful imprisonment and coercion under duress, ie threat of punishment by detention and use of handcuffs inflicting pain and actual bodily harm. The whole thing is a shambles. Should be worth around £5000 in a civil case. . The police should be disciplined and prosecuted for all disclosed offenses.
