@Poppy Robinson thanks for being civil I agree but your using an extreme example. I agree that those people are a burden on society but most people aren't so excluding everyone because of a few bad ones isn't fair, nor is it the right approach. I think that we should set higher standard to make sure that people aren't abusing the system as well as creating more jobs to make sure they can work. Forcing the small minority that are abusing the system to get a job and making sure they have a job to get is better than denying people who can't find a job from getting help with a $30 000 medical bill or letting people die because they can't pay for insulin at as high as $350 dollars a vial.

The lady at 0:49 seems to abide by a extremely libertarian view of the US Constitution. If we are going by that strict interpretation of the US Constitution then we also have no right to privacy (especially computer or telephone privacy), no right to own businesses, no right to vote, no concept of innocence until guilt is proven beyond a reasonable doubt, etc. Strict constitutionalism will lead you down a weird road. Additionally, I think the question would be more appropriate if it was along the lines of, "Should healthcare be a right or a privilege?" Just because a right isn't in the US Constitution, does that mean the right doesn't exist? For instance, before the US Civil War and the emancipation of slaves through the 13th Amendment, did the slaves have a right to be free? Was the right to be free from slavery created on the day that the 13th Amendment was ratified? Of course not. No one should be a slave simply because no one in their right mind would want to be one. The question should be worded in a different manner in order to get more interesting responses.
@saraalouh2197 жыл бұрын
SailingSeignior the wording was ok, she's just a dumbass who watches tomi lauhren (she made the same strict constitutionalist argument a couple days ago)
@KennyBky927 жыл бұрын
Actually, the fourth amendment covers rights to privacy, Fifteenth Amendment protects our right to vote, and the Fifth, Sixth, Seventh and Eight all provide concepts of innocent until proven guilty. Also, owning a business is not a right. It is a privilege granted in the form of a license. Healthcare is a privilege. However I agree with your second paragraph. It should be a right.
@SailingSeignior7 жыл бұрын
Here's the IV Amendment: _The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized._ Nowhere in there is anything stated about online or telephone privacy or an inherent right to privacy like in a bathroom stall, for instance. I do agree that we have online privacy rights pertaining to online banking, emails, etc. But that's because I don't believe in strict constitutionalism. I believe in a living, breathing Constitution. Here's the XV Amendment: _Section 1._ _The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any state on account of race, color, or previous condition of servitude._ _Section 2._ _The Congress shall have power to enforce this article by appropriate legislation._ Nowhere is an inherent right to vote given. It can't be denied based on race, color, or previous condition of servitude but it could potentially be denied on other criteria if you use a strict interpretation of the document. Again, I believe that we all have the right to vote but that's because I have a more liberal view of the US Constitution. Here are the V, XI, XII, & VIII Amendments: _No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation._ _In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense._ _In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law._ _Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted._ Presumption of innocence is simply found in common law, not the US Constitution. I think everyone has a right to enterprise so long has they meet the standards to license their potential business. The US Constitution contains some things pertaining to contracts and how the right to contract shouldn't be infringed, for instance. Freedom of speech also protects journalistic businesses and commercial speech like newspapers and book publishers, for instance. Healthcare could be considered a right under the XIV Amendment. In order to be duly granted a right to life, healthcare is a necessity.
