40 years I have been a licensed land surveyor and the guy filming is clueless and just talking big. The only reason that "point" and equipment are at that location is because it is open to the sky. GPS does not like trees. The "point" has nothing to do with "lines" or triangulation. GPS works strictly by the clock timing between satellites and equipment. The more accurate the clocks of the equipment the more accurate the satellite readings, that is why the equipment is so expensive. The clocks on your tractor gps cannot touch the science that goes into survey grade GPS. When the surveyors are finished and gone you will never know they were there and the "point" will have no legal significance to anyone. Just a bunch of hand ringing over nothing.

I'm glad you recorded this. In 2010, SCOTUS ruled that it is NOT a crime to photograph or video law enforcement from a public area. Anything that can be seen with the eye, can be recorded, again, from a public area. It cannot be deemed suspicious activity warranting a DETAINMENT by law enforcement. ALWAYS RECORD any interaction you have with the police. Always.

This guy doesn't seem to realize that in the old days those guys would be marching through the woods and properties with actual chains of a certain length to check property lines, buildings, etc.

In Michigan, surveyors have a right to trespass to find appropriate boundaries within a township or governmental unit. In other words, the person behind the camera would be wrong, dead wrong.

They don't tresspass there's a public easment under the law. It varies but it's usually about 30 feet from the road center. They aren't going to come into home and watch Americas got talent, they have a job to do.

A surveyor acting in a governmental role has different access rights to properties within the jurisdiction than any privately acting surveyor. Most cities, townships, etc. have invoked doctrines to provide themselves many such things, some unconstitutional. It is important to qualify EVERYTHING and never taking anything at face value.

The guy recording this doesn't understand how GPS triangulation works. The triangle is in space. Your GPS device communicates with three different GPS satellites and then it uses your position relative to each of the three to pin point your location. What they are doing here is setting up a base station at a know location that increase the accuracy of that GPS calculation. I don't know what the easement distance is, but it looks like they are probably in it or just a tad outside. Either way, if you are going to be entering sometimes property it's always best to let them know ahead of time. The explanation that was given probably would have satisfied these land owners if they had just extended that courtesy. Since they didn't, everything they say it's gonna be viewed skeptically.

In some states surveyors have full rights to cross your property. If you do deny them that right to cross your property for boundary verification etc. the local sheriff will come out and impress upon you they have the right to cross your property. You cannot deny them access in most states

That is just a base/reference station for the GPS the guy is carrying (Rover). The rover alone is only accurate to about 3-5m (10-15ft), like a Garmin or other consumer GPS. By giving the Rover a fixed base point it brings the accuracy down to less than 2cm (1"), which is needed for surveying. The way the GPS system works is that each receiver only collects data on one singular point at any time, so the base will sit there all day collecting a position on the one point it's setup on, nothing else. While the rover is controlled by the surveyor and collects data on everything else. The guy said in the video the range is about 3 miles, which would be true without the external radio attached to this unit. I run the same setup, that radio in farm land can easily go 15-30km (10-20 miles) or more. Typically when surveying a pipeline that travels a fair distance, you don't do a new base setup for every property you cross, you'd setup as far from the beginning of the line, or the last control point so that you minimize the number of base setups. So it's very possible that while the surveyors were miles away, despite the base being where it was. Now, when plans are issued, the base point is never placed on the plans, nobody cares where your base was when you surveyed it. So if the surveyors were surveying a parcel of land miles away, then that's all that would be shown on the plan. I'm about halfway through the vid, I'll comment again if something pops up in the 2nd half.

And the standard road allowance is 66ft, some small roads can be less, I've seen 33ft, 50ft, etc., highways and larger roads 100ft. They really can be anything but that's just some typical sizes. IF these guys were actually surveying this property shown, then they would have to know what the ROW width is. This tells me that they for sure were not surveying anywhere near this property.

You were also wondering how much $$ in equipment was tied up there, your looking at about $80k for a complete setup like that. 2 receivers, external radio, 2 tripods, tribrach, etc. the quick connects to connect the receiver to the tripod/pogo are almost $400 each lol surveying is expensive!

The GPS device you were looking at is at a known control point because it has known, surveyed, exact latitude and longitude coordinates. The antenna is sending correction data to the field unit which is doing the surveying at another location. There is no "triangulation" between the two units. The survey unit is using the exact location data from the control point to correct the location error inherent in the GPS. No surveying is being done at the control point location.

+Shaw Law The question was not about satellites but about precision GPS (surveying). I know all about how GPS works, I've worked with it since 1991. Three satellites is the minimum for position and four to find elevation. Precision GPS requires the use of a base station, so the communication is then between the base station and the field unit. That is NOT triangulation between the base station and the field unit.

+Buckhorn Cortez And the reason they set up in an open area is because GPS signals can be blocked by buildings, trees, even heavy clouds. They want as little possible interference as they can get. And setting up to close to the area being surveyed will not give you the best data correction which is what it sounded like these guys were doing.

***** The person videotaping the incident feels that the surveyors are trespassing on his land, they contend they are using the roadway easement. The videotaper seems to think the easement only extends 25 feet from the centerline of the road. Although it may be the case in that township, the general rule is that local roads have between 86 feet to 100 feet of easement which would be between 43 to 50 feet from the roadway centerline. At one point, one to the people walks off the distance from the centerline and says they are 27 feet from the centerline.

did you notice the way the 4 guys from the start didnt go on the private land or anywhere near the equipment so they can deni having set foot on the land and there for did nothing wrong but they left it to the poor low end of the employment chain to do all of that so they could move the blame off on to the real workers even though the real workers where just following orders

I know laws are different all over, but I thought I'd tell you what happened to some survey equipment on my uncle's farm land. He lives in Minnesota and he went out one day to find survey equipment on his land. First he was nice about it and just called the police who came out and made the survey crew take out their equipment and told them without landowner permission they could not be on his land. About a week went by and sure enough equipment on his land again. He didn't call the police right a way this time though. He flattened all of it with a tractor first and then called the police. When the crew returned to see why they lost signal the police were there waiting with summons. My uncle was found innocent because it was his land and equipment was placed there illegally. Survey crews go to the other side of the road now!

funny in most states by law survey crews can do just that and are immune from all trespassing by law in Florida from time to time this come up and it is a felony to interfere with the crew and they do not have to ask but most good crew will and tell the home owners why and how come they are there most home owners are shock to fine out 40 feet below there is a stormwater box culvert under the house and we have a crew in it under the house right now

*ACTUALLY in most states the easement is 4 feet from the edge of the road. IF the county has contracted those workers to survey the land that's no different than a cop or state worker being on your property. if the guy is there not doing any damage or harm i don't see what the hassle is. what the guy wasn't conveying to you is that in each area they use central lines and feed off of those central lines to map places in the counties. you guys should be thankful they are there because that will keep people from uncorrectly showing up at your property when guided there by GPS. this is how they correct the incorrect information that you GPS guides you to when you are using a GPS for your directions*

Easements also vary from place to place. I'm on a very old, rural road in upstate NY. The town easement is literally the edge of the road. They have to get my permission just to ditch the side of the road. It's not a problem for me, just pointing out that you can't guess where the easement ends. You need to know for sure.

ends up a land man should have contacted the owner of the land and did a little explaining and this would have been a good day for all. owner of land (kid) had no idea what was going on, and farmer didn't either. Settle down folks and be nice.

I commend the police officer, he did a good job of explaining the law. Kudos to him. Big company do not have the right to step on the land owners. Good job wess for standing up for all our rights.

Neverrod....The officer was polite....so....the camera person politely turned it off. Real communication took place. Turning off the camera politely seemed to actually contribute to a SUPER outcome!

The surveying equipment is made by Trimble. Depending upon the system used, the radio frequency will be either 12.5 kHz, or 25 kHz. The communication is direct from the base station radio (control point) to the field survey unit using standard radio communications. It is also possible to do it through the cellular telephone network. Given there was a large antenna on a tripod, you can rule out cellular and know it was a standard narrow-band VHF radio. No communication between units is using satellite communication.

Some of these utilities.... AT&T hung a transmission line on my privacy fence for nearly a year and called it good until I called and threaten to sue them for $100 a day access right to my property. Their response was they had a utility right of way on the fence line. My response was yes, but you did not purchase the rights to hang your line on my fence. It was burred the next day.

@@peterbarber7613 No they didn't. Most people that are just superficially familiar with the concept of easements assume all easements are the same and provide the same levels of access. That is simply not true however. The easement at issue in this video is not your garden variety utility easement that is seen along the side of the vast majority of public roads. The easement agreement here was a negotiated easement that only grants very specific access to very specific entities under very specific circumstances. It is absolutely not a standard utility or public access easement.

You have rights to the land use. You don't have rights to the airspace over it. In some cases you also don't have rights to what is in the ground. They don't have to notify you if they are not physically ON that property.

Steve is correct. Property lines do not always go to the center of the street. Whether they do or do not, is immaterial. Whether there is a separate Street right-of-way, or a street way easement he's what makes no difference. These people were probably two or three feet within the street right of way. The police officer is incorrect about them being unable to use it.

GPS base stations can be set anywhere. The rover the other guy was using can actually gather information on known survey points. The base is usually set up in a convenient location central to the work to be done. You don't have to set the base on a known point, as long as you gather data on a known point with the rover unit.

I had a underground gas pipeline go through my property, after it was all done and the individual contracts arrived it was discovered that they could come back whenever they wanted and put another and another pipe in the same easement or even sell part of it to another company so they could put a pipe in the ground. Be careful and keep the bastards honest.

All about the terms of the easement -- just be careful about narrow language -- require notice for inspections and specify the type of line (size and product transported etc...) and number of lines.

My brother hired an oil and gas lawyer in south Texas. Every time they come on his property they pay. They have put several pipelines inand each one is in a contract by itself

There are exceptions to trespassing laws for utility workers and law enforcement and a hand full of others that are on official business. They have every right to be there

I live in Indiana and we have trouble with the electric utilities destroying private property. They have a right of way but that is also on private property. Utility companies have to work with the land owner before they are allowed to cause damage. Most county cops these days do not understand this and they side with the big money.

Possibly the law is different there, but in Ontario, surveyors have the legal right to trespass in the commission of their duty to perform a survey. Of course, extreme patience is exercised when confronted by difficult citizens (with cameras) as we try to maintain a positive relationship with the community. We make every attempt to knock on doors and explain to neighbors why we're on (or may be on) their land, but it's not realistic to notify every land owner on every given survey. Boundaries must be established, and surveyors are licensed and regulated to perform that task. You don't "own" land, you own "rights" to that land. Just let the poor guys finish their task so they can get paid and put food on their table. Sheeez. Also, it's not your business where, what, or why a survey is being conducted. We would just outright LIE and say we don't know. Playing stupid gets rid of nosy locals a lot quicker than feeding them even the slightest bit of information to feed off of ;)

Yeah, none of that behavior flies here in the States. You own your land here, not just "rights" to it. Surveyors cannot trespass here, even in the commission of their duties. That aside, if a property owner is attempting to trespass a surveyor who has just established that the land they're on at present is not said offended party's property, then that's a very different story altogether.

House was sold on the far end of one of my forty's. Land renter called and said someone is riding horses on newly seeded hay ground. I went to see the city slicker that moved in. She said that thats her land. I said, no way. I asked her if she got an abstract when she bought. She said yes, I said well, lets measure it off. She said the seller who sold it privately told her that her land went all the way to the second tree line. I said no way, my land goes to the 1st tree line. I told her my boy & I would measure with a transit and GPS it. We marked the points and I asked her if she'd accept that as our property line. She said no way! So she hired a surveyor for the 2,300' property line. If she would have accepted my GPS, she would have gained 6" X 2,300'.

Camera guy has it backwards, the utility easement extends about 10 feet onto the property, it varies from County to County so it may further onto the property.

No… utilities do not automatically have easements on private property. Utility easements are obtained on some private properties and not on others.

Landowners do have rights, regardless of right of way. Public land isn’t the same as private property and the rights associated are different. My family owns a large recycling business. Pennline, a contracted tree trimming company that is clearing hundreds of power line routes in my area, is contracted by PP&L. I pull into our facility and these guys have 4 trucks, 8 guys, and a bunch of their equipment all over our driveway, blocking my way in...no big deal. I knew they were clearing trees for power lines, no problem. My problem came when some lumper started spouting off at the mouth about how they can go wherever they want, whenever they want, without anybody’s permission. He then started saying how they would purposely leave a huge mess at private property owners’ sites they had previously cleared. So I calmly went to my office and contacted a friend in law enforcement. I waited for these Pennline guys to start getting ready to cut, and I went out and said, “this is private property gentlemen, and not one single person called beforehand to let’s us know, or even have a foreman or supervisor talk to us! So please leave this property until you can properly acquire permission to cut anything down on our private property.” Once law enforcement arrived, my situation was basically the same as this video. They do not have the right to just enter private property, and must notify the landowner. Who is paying late freight fees if one of the tree trimming trucks is blocking our driveway for a delivery or pickup of product? We have several million dollars worth of equipment all over our property, who in their right mind would not at least have the brains to at least let us know what they’re doing. I can tell you if they happened to damage any of our equipment, it would not have been a pretty sight. How are we(business owners) supposed to let our daily customers know beforehand that they are trimming trees and it poses a safety and liability hazard? I tried my best not to be ignorant, but when people are ignorant of rights of others, then I have a problem. This all occurred during the winter of 2016, so on top of all that aforementioned stuff, we run a recycling business. It’s been in the same spot for 40years. What happens if a pennline worker steps on an old rusty nail, or gets hurt on a piece of garbage, or old iron, or whatever other hazard that may be on our property. Shame on Pennline and their management for not considering what other business people also have to deal with on top of incompetent employees.

I am a 3O year surveyor from Texas. Actually in Canada right now doing survey on a pipeline from Winnipeg to Calgary... we do NOT ask every land owner... just today I covered 122km so talking to every land owner is impossible. ROW is ROW. Law is funny. I've been in court over 10 times and every single time I won. Sometimes we have to cross property that is NOT ON THE ROW because I cant fly. Also with my Trimble and laser I'm able to stay in my Jeep on the public road or Row and shoot your house or structure and never tresspass.... I love that, but sometimes land owners still raise hell that i pointed a "camera" at there house..... geez. In 30 years I could tell you some stories.

I caught a man 100 feet passed my property line, driving survey stakes, I pulled all of his stakes and told him I was target practicing there with my 30.06. He didn't come back. Turns out a local mining company had some ambitious employees using company equipment on company time to make a road for deer hunting! Don't think the bung holes still work there...LOL!

Surveying has changed a lot since GPS triangulation. The ping station is only an anchor for the surveying, which stabilizes the signal from the Satellites, which can wobble enough to vary a location by a few feet. It does not need to be at, only near the survey operation, but does need to be clear of trees and brush that interferes with the signal. Usually stations are set up near the survey site, in favorable areas. If you are a Conservative, don't hamper large corporations rights, they are on your page. Eminent Domain rights have changed in the favor of the big guys. But, rules are rules and everyone needs to abide by them to be a citizen in good standing.

The issue would be if they're stepping onto private property, they can do whatever they want from public property including surveying, filming, photography, or whatever, as long as they aren't damaging the private property.

I have a 105 acre farm. We have a couple huge power line towers on our property. It sucks because they cut our trees all the time and block our lanes with the cuttings. They give us paperwork saying they will stack the fire wood for us that they cut but they have never done that. One bit of advice: Never let them spray anything!

Virtually every jurisdiction in the U.S. provides for an easement alongside public roads ...typically 6-8 feet. It is provided for utilities, road maintenance, etc. Some people are just plain hypersensitive about their perceived property rights. The vast majority of landowners are decent and reasonable. There are a few who are just plain assholes. I remember when we used to walk to school, we also took shortcuts across private property. I can recall only one or two times when homeowners shooed us away from walking on their property. Most people who friend and gracious.

Every state is different but in my state a surveyor by law can cross anyone’s land without permission in performance of their duty. I always would seek permission because a piece of paper filed in a book doesn’t protect you from shot guns. That said, his base station is set on a point of known coordinates to send corrections to the rover in real time and really has nothing to do with your property other than using its known location. Why do you have a problem with a bit of his equipment sitting on your dirt and grass?

The County owns a right of way of a certain distance from the center of the road. They can do anything they want in that area. In some areas it's as much as 33 feet. Where I live in a small city where the utilities pay a fee to the city for the right to run their pipes and wires across my front yard (between the sidewalk and curb) which I then pay to the Utilities. Then to add insult to injury I have to mow the grass and clean the side walk for this area I pay the fee for my utilities to cross because if I don't even thou it's not my property (city property) according to the city they will take care of it and put a bill on my property taxes! Wonder who owns your property? Don't pay your property taxes for 3 years. They'll tell you who owns it!

Look it is official work being done, so why the big deal? As a land owner, and I needed a survey of my property, what is someone stepping in a being a busybody. First the guy says he is a farmer and is farming the land where the equipment is sitting. I wouldn't even talk to the guys. If I were the survey team, I'd wait for the police to arrive and show them the paperwork.

As someone who grew up on a farm, in a rural farming community, and now work in the natural gas pipeline industry, I have a few comments on this situation. I work for a natural gas pipeline consulting engineering firm that handles pipeline projects and facilities in the northeast. First, there are several good comments explaining GPS survey basics from a technical standpoint. No, the location of the base station does not "survey" the land it is sitting on, it simply enhances the accuracy of the rover (performing the survey) which may be at a remote location. There is no "straight line" from base to rover, you could kinda make that argument with a total station survey perhaps. Secondly, while I have nothing against LEOs who are doing their jobs, it is a fact that LEOs may legally lie to you and a LEO should NEVER be trusted to know the law. While I do not know the law in that area in regards to county road right of way, I would suspect that if they are licensed professional surveyors they probably were not breaking any laws by setting up their base station there, and because the LEO asked them to leave does in no way indicate that the surveyors were not allowed to set up their equipment there. Thirdly, I would like to explain the general process of building a pipeline. A company (like Penn East) comes up with a business case for moving natural gas from point A to point B. Then they may commission a feasibility study, a part of which may involve driving around in the area and looking for potential issues. Route development is the next step, at which point they will ask landowners for survey permission on private land as they try to determine the most cost-effective route. This is not a full survey, but they may use GPS to record points of interest and potential routes. As the process moves on, they will eventually sign lease agreements with the landowner for the future pipeline ROW. The pipeline project is assigned to a project manager in the pipeline company who is responsible for that particular project. He or she will have engineering, surveying, legal and any other resources needed to execute the project, many of who may be outside consultants. There are consultants who deal with the environmental issues and permits, ranging from wetlands to endangered species. In the other video the "bat study" was mentioned, which is part of the environmental process. A "landman" will act as the interface with the property owners. Unfortunately, there are many cases where the landman has not been up front with (read lies to) the property owner in order to get that lease signed. The property owner should always have lease documents reviewed by an attorney familiar with the pipeline industry and document everything. If the landowner does his due diligence and understands the process, the chances are much greater for a win-win outcome between both the landowner and the pipeline company. They are willing to pay you good money if you know how to talk to them and the pipeline will not affect how you farm your fields after construction (make sure the lease takes care of land restoration etc). I have not even scratched the surface, but a bit of education can make all the difference in dealing with pipeline companies. I am one of Wes's subscribers and watch his videos, and felt that I could help people understand the process a bit better. I believe that many who are against pipelines might feel differently if they understood the process a bit better and realized the challenges facing those involved with constructing a high pressure natural gas pipeline. Yes, there are bad people working for pipeline companies, but many of us are just trying to do our jobs and want a good outcome on all sides.

Pipe lines destroy the land. And they do affect building and farming to a great extent. Can you build a house over a pipeline? Nope. Do you risk catastrophe from deep tilling? You bet. Do you risk life and limb from poor construction and materials used with the pipeline? You bet your ass. How do pesticides and fertilizers interact with the pipe? Surely corrosizes aren't good for the steel. We had a 24" pipeline cross a corner of the family farm a few years ago, and cross neighboring farms. We did not have any problems farming over the line since then and neither have the neighbors. I did hear of another section of the same pipeline where it has taken a few years for crop yields to recover over the pipeline ROW due to the contractor and inspection being sloppy about restoring the farmland correctly. However, the pipeline company is actively working with the affected farmers to restore the land and/or compensate for lost yields over the years. This is a result of improperly replacing topsoil, mixing subsoil and topsoil and not mitigating compaction issues correctly. Deep tilling? Natural gas pipelines are required to have minimum cover of 36" in ag fields, and typically are buried at 48" of cover. If you are tilling that deep you must be doing some very unconventional farming. Fertilizers and pesticides? Pipe is coated with fusion bonded epoxy, and protected from corrosion by cathodic protection. Every single weld is x-rayed and inspected, every piece of pipe must have an MTR on record and the coating is inspected (it is called "jeeping"). Before being placed in service, the pipeline is filled with water and hydrotested at 1.5x maximum operating pressure. As for me, I support safe, clean-burning, low cost American natural gas over energy from the Middle East any day, and part of that means pipelines!

Study up on that explosion. Just a freak occurrence? Regulators came down on them pretty hard for it to be just a freak occurrence. Here's how the pipeline owners thin, A direct quote, There are many pipelines in the area, said Gregory Ebel, Spectra’s CEO, and the industry is adept at finding workarounds. As for Spectra, Mr. Ebel said that “all things taken in, we would not expect any material impact financially from the incident.” I bet that makes the young man who had to run for his life with 3rd degree burns over 75% of his body feel better... Not to mention the material things he lost as a result of his house being destroyed.

If something is illegally 'without consent or judge order' is placed on private land. It is the land owner with responsibility for the legality of the items left do to possessions. Lay claim to items next time by giving the job to anyone as to pick up any things on properly placed without Land Trust approval. This would require them to admit to trespass, if only to claim ownership of items worth 40k.

Third time is the charm. It sounds as if the Pipeline sent out several sets of people, some direct employees (with uniforms) some subcontractors not collecting union wages or employee benefits. Instead of issuing paperwork to several sets of people they get hired on a need-to-know basis so even if they know what's going on they can claim their clueless. The surveyors are out about a mile each direction so they get a satellite map a mile square. The Pipeline want the government to claim eminent domain and Heritage is pushing back. All the employees ought to have known to stay on public property.

We had similar experiences. One thing I did that ticked off the surveyors who were trespassing and did not have any legal access (I checked beforehand), was to park a nice high forage box right next to their equipment. It kinds messed up their "satellite" access. I really wanted to drive real close with tractor and a large bale on the loader and just hover it above their equipment, but...

The trespassing law in Tennessee is doesn't exist anymore to actual employees who works and holds a land surveyor license. And they can't be charged under the trespassing laws in Tennessee. Land plots or ground levelation changes constantly in mms to inches every year depending on the location of the property pin or markers which are surveyed every year. These pins or markers help with the right of way of roads, private property and state properties such as the high power over head power lines and underground natural gas lines running across the state. Each state has different laws for trespassing. This is one of Tennessee's laws on trespassing..

A lot of people believe "right of way" give the ability to loiter. It does not, right of way in raw form only gives people the right to utilize that piece of land to be able to travel. the land owner still owns the land and maintains that right of way as well. squatters have no rights on right of way's but to only pass through that persons property, but if that was the case then he wouldnt be a squatter of sorts. lol.

It's a RTK (real time kinematic) GPS. The base station on the side of the road is set up over a control point on known ground coordinates. These control points are usually, but not always set up via convention survey instruments (total stations) and create a network of points that are referred to when ever the surveyor sets up.GPS by it's self, like your phone or a handheld, are only accurate to within a few meters due to many factors. With a RTK system, the GPS is set up over the known point, the GPS comes up with it's satellite position, software is then used to calculate the differences from the known point to the gps measured point. This difference is then transmitted via radio (the tall antenna that was set up) to a rover GPS, so that rover is able to deduce it's position down to a centimeter.The base station it's self collects no data, other than it's position.

The question to ask the survey crew is whether the control point is a known survey monument and part of the Public Land Survey System (PLSS). Then ask if it is a State or County survey monument? If it is a State or County survey monument - THEY ARE NOT TRESPASSING as survey crews have the right to access the survey monument.

+onelonleyfarmer If they did not setup the base station over a known survey monument, then the corrections are useless as they are not tied to an acknowledged, accurate survey point - making a survey description of the proposed right-of-way not accurate. Can't be used for any type of legal work (applications, studies, etc.). However, IF they use a subscription GPS correction service, that can be tied back to a known survey point, then the survey is still valid. So, if there's no monument, then the next question is, "Are you using an outside service for the GPS correction?"

I believe New Jersey because it is one of the original settlements is a metes and bounds state not a public land system state I could be mistaken. As far as the gps goes, it most likely is going to be used as a post process type of survey where the GPS sitting there is collecting data, and it helps to correct the data of the hand held device. You can tie into known monumentation with the base not on a known point and then using corps stations post process the data. At least that is what we have the ability to do in nh.

Was it an offset from a monument? Perhaps in the middle of the road and to avoid public disruption they moved laterally off the road?

It looked like it was just a local dGPS (differential GPS) system, which gives far greater/faster location accuracy to the people who are moving around, measuring an area. The actual location of the base station is kind of irrelevant and not part of the final measurements - it just assists the mobile party who are making the measurements.

i had a company place wires, junction boxes and holes with explosives on my property, without my permission. i was disking up a rice stubble field so i plowed it into 90 million pieces. they called the sheriff on me and unfortunately for them the deputies that showed up also goose hunt on my land. they claimed they just made a mistake, no, they were doing seismic work and wanted to do it for free, they had to dig up their explosives and they gladly paid damages

They are not striking any line, or creating anything. The line you speak of is a theoretical or calculated distance. ALL the GPS creates, so to speak, is a theoretical point. The private property might not start for 10 or 20 feet from the edge of the road. The road is built anywhere inside the Road Allowance, owned by the government. A Road Allowance is a strip of land, owned by the government, that they may or may not build a road on. The width of the Road Allowance is defined on a survey plan registered with the Land Titles Office. There will also be a title or titles proving the ownership of the Road Allowance Land by the involved authority, (city, county, state, federal government). Calculating the distance across a piece of land does not involve ANY KIND OF TRESPASSING or accessing of the property. If the survey crews are not entering private property physically, they do not need to interact with the uninvolved property owners in the area.

Gayle Allen- Absolutely! I don’t own the street in front of my house, nor the sidewalk. So I may or may not like it, but I still don’t see an issue. What harm are they doing? It has nothing to do with respect, but seems to have an ego issue instead.

I'm curious is Penn East a pipeline company? A big pipeline company called Kinder Morgan is proposing a petroleum pipeline from Greenville , SC to Jacksonville, FL is pulling the same sort of tricks here in Georgia in the Augusta area. They are entering private lands and surveying for a right of way for the pipeline and many times don't have permission and have been warned of Criminal Trespass on numerous occasions. One of the strongest people who opposes the pipeline is the President of a newspaper conglomerate based here in Augusta. He has three plantations South of Augusta and just by his place in society carries a big stick. The courts are still out on whether the pipeline will be approved.

They could of used some other control points to set a good traverse point on the private property they are supposed to be working on. Or make efforts to contact the property owner to get permission. I get being the survivor trying to keep his equipment and labor central to the job site though.

Before GPS, when surveying was done with measuring chains, transits and compass, the USGS placed a large number of survey monuments, mostly along public right of ways. Despite the methods used, these have positions known far more accurately than standard gps readings. If the private property had a survey monument on it, I am sure they would be using it. This is likely the closest publicly accessible survey monument confirmed to be in a correct location. All they are doing is monitoring how far off the GPS determined position is from the known location of that monument. Then sharing that via radio link to the portable on private property to use to adjust the error out of their readings. They might also be using radio transmit time from this point to the handheld, but still doesn't alter the concept. Any question about which direction the radio link goes is about as relevant as which properties your cell phone call crosses to get to the cell tower.

I remember an episode of Andy of Mayberry, in which Barney gave a speeding ticket to a truck driver for exceeding the limit on a particular stretch of road. Andy tore up the ticket and explained to Barney that a loaded truck needs extra speed to climb the next hill without stalling. Andy explained further that laws and lawmen that don’t extend tolerance on certain situations, bring about disrespect for the law and law enforcement. Choose more important battles looneyfarmer!

Well if I understand what happened there it is refreshing to see the private citizen's right to preserve his land respected. Easement or not they did not get permission to trespass. The township doesn't give a hoot about the whole deal. Both the surveyor and the township should have talked to the landowner. They might have gotten permission to do what they wanted had they done so. More flies with honey right?

there was no trespassing!! they were using a benchmark/control point that was clearly within the roadway easement....NO PERMISSION IS NEEDED TO OPERATE IN THE ROADWAY EASEMENT. that's why it is there!

Might be a private easement to a group of houses. In that case it is not public and can only be utilized with permission from an easement holder.
