The HOA is fake. It’s a Karen in your neighborhood that is used to being the president of the HOA and thinks she is still one. Contact the city and ask about HOAs in your neighborhood. Then contact the mortgage company and tell them what’s going on and then the last thing is to contact your lawyer and give him all your information and then have them send a letter to C&D order and then also issue a harassment report

Yes. This. Apparently this has become a thing where HOAs try to bully people who aren't actually a part of the HOA. When you buy a house, apartment, condo, etc that is part of an HOA you will have to sign paperwork and be given a copy of the rules and regulations. If you weren't then you are not part of the HOA. An easy test is to force them to produce paperwork proving you are a member. They obviously won't be able to if you aren't part of the HOA.

@@samuelnelsen8872 in the absence of said HOA - which other neighbours have confirmed for Erik - that's difficult to do. This is ONE neighbour masquerading as a HOA for reasons of their own. Law enforcement CAN subpoena the details of the email address the threatening, harassing emails were sent from from the relevant internet service provider. That's how you'll find that neighbour. Whether or not these emails are related to the trespassing going on in the wooded parts of the property is another question - they may be or they equally may not be. And the only way to sort that out is to find out who sent the emails. As far as that trespassing is concerned is their a "right of way" or an easement of any kind on that property. It's possible there may well be and the estate agent who sold the property either wasn't aware (yes - a possibility) or was aware but didn't disclose same. If such an easement does exist - there's not much that can be done. If not - & the HOA threats & trespassing are NOT linked - again, I don't know that much can be done sans fencing (which keeps out the wildlife). I have 436 sq m in suburbia and no front fence. If you lived in a legitimate HOA, you would have been given a copy of the CC&R’s when you purchased the property. Also, if a person gets a “nasty gram” from the HOA, it’s lists the specific rule that’s being violated. This seems like letters from disgruntled neighbors. As someone who calls out my HOA on their bs, I strongly feel someone is just harassing you and your family and you should contact an attorney ASAP to end this. Sorry you’re dealing with this but at least it’s not legally binding and you can’t be fined because I don’t believe you live in a legitimate HOA .

One of the first things that occurs when you purchase a house in a HOA community is they give you a copy of the HOA by-laws, which you can also request in advance. If you can't abide by some of the basic rules and regulations, look elsewhere for a home. I have been on a HOA board and have served as its president. Not All HOA's have a monthly or quarterly or annual bill - you need to read the Associations Rules & Regulations and you need to go personally and chat with a member of the board. Find the name of the association and look it up online and then communicate with them asking for the website where you can learn what the rules are --- also --- while reading these documents, look for information about all the committees. Because it is the committee that either has or does NOT have the ability to issue a financial penalty.

@@georgetaylor2819 But, first he needs to confirm he does ib fact belong to an HOA. Sounds like he might not. If he does he needs to actually show them all the letters and confirming someone is not trying to speak for them without their consent.

It's not even the HOA itself, it's other homeowners in the area that are abusing the HOA as a method of harassment.

State legislatures need to OUTLAW "HOAs" altogether on detached homes. Let's make this simple and better for everyone in the state who needs housing by ENDING the corrupt lawyers "HOA" gravy train.

I would have a hidden camera placed to watch your. Mailbox, that way you can catch who’s ever placing this HOA crap in your mailbox,which by the way is a Federal Crime, it’s apparent that you’re not in an HOA, and once you find out who’s behind this, you can have them arrested and possibly taken to court for pain and suffering, I personally would ignore everything and keep doing what you do, love all your videos, keep up the great work ❤️

As a letter carrier I can tell you that no one should touch your mail box but you and your letter carrier. If they put something in your mail box without a stamp turn it into your carrier to send them a bill. Also call the Postal Inspector and turn this in to them to handle. It's a Federal Offense with $10,000 in fine and two years in prison. Try to use one of type trail cams on your mail box to get the proof you need.

Nobody should be allowed to tell you what you can and cannot do with or on your own property.. In the uk , every town has a council. There are rules of what you can and can not do, but nowhere near as busybody as HOAs are.

Hi Erik (1) If it is an HOA it should have been sent on an official HOA document with the HOA name and address on it with a contact phone number. (2) This alleged Margaret person should also be listed on the document with a contact phone number (3) I find this whole thing extremely suspicious and sketchy to say the least (4) Lastly I think someone who’s watching your channel is part of the trespassers or at least in cahoots with them Be safe my friend God bless much love

If in your contract there's no mention that you are part of the HOA, you never signed up to be associated with the HOA and you disagree with them on their decisions, tell them that they can take you to court. Then advise them you are not part of the HOA and they can pound sand!!

Get an attorney. If your home was not explicitly sold as part of their HOA, they will have to pound sand. Either way, you will need an attorney. I'd never live in an HOA.

According to most state laws when you move into an HOA they have to give you a list of all the rules if they fail to do so within 30 days then they cannot legally fine you.

I bought a property in Sydney (Australia) in an HOA, and I ended up on the commitee of same. Yes, we did have rules, but their were no rules about Obsessive/Compulsive owners. (And strangely, one old biddy was named Margaret too!) Two of the owners were public servants in Govt departments, and the changes they tried and tried to get changed for 1 or 2 owners, were absolutely outrageous. But I solved that by reversing the complaints back on them about every little thing they did that was annoying, like parking on the main driveway, hanging things on their house that were too colorful, you know, really minor stuff. (Like your 3 bushes.) Eventually they got the message and sold up and moved, and Peace Rained Supreme.
@EdLeeper5 ай бұрын
That is exactly what "Margaret" is trying to do. Where is the difference? Members of the board of HOAs are elected by those in said HOA. If the majority of owners didn't like what was going on they would simply elect a new board. Individuals who buy into an HOA should read their agreement AND take an interest in what their HOA is doing.
