Pennsylvania v. Mimms

One of the most important case laws out there! 1977 US Supreme Court Pennsylvania v. Mimms is the bane of every "sovereign citizen" out there. Unfortunately, it also happens that not nearly enough police officers know about the case. Every deputy, state trooper, or LEO conducting traffic stops should have a thorough understanding of Penn v. Pennsylvania versus Mims says the officer can lawfully order you out of the vehicle. Marilyn versus Wilson says that they can also order the passenger out of the vehicle.

what about states where you can legally conceal carry? why would you search someone if they're legally allowed to conceal carry? that doesn't make any sense. You should just assume everyone is carrying then, and it's legal.

Something I don't understand. Why was he ordered out of the vehicle THEN was asked for his ID and stuff? Did they carry all that on their person at time time?

Yes - In Arizona v. Johnson, 555 US 323 (2009), the US Supreme Court held unanimously that police can conduct a putdown of a passenger in a vehicle if the police reasonably suspect the passenger is armed and dangerous.

In a traffic stop, a person gets out on their own without being ordered out. Can that person remain out of the car and refuse an order to get back in the car?

Police officers can lawfully order individuals into or out of vehicles during traffic stops. Best bet is to obey lawful orders from police officers as it relates to your movements/positioning during traffic stops

Look up Pennsylvania vs Mimms. The supreme Court ruled that police can order your out of your vehicle on a traffic stop. So know your rights. If a cop orders you out of your vehicle just get out.

Yes okay, cool. But the epidemic camera-in-the-face-of-the-cop - situation nowadays, is always combined with the demand that the officer has to say why. So you've missed the probably most relevant part: does the officer has to give a reason?????? 😉

Does Penn Vs Mimms give an Officer the right to order the driver out of a ( properly) stopped vehicle as an initial step in a field sobriety test? In other words, using the lawful order as a pretext to "Evaluate" the drivers ability to execute the procedure of exiting the vehicle as a part of the field sobriety test, that the driver may wish to lawfully decline?

The officer does not need to articulate a reason in order to order occupants out of the car - as long as the traffic stop was for a valid reason.

Officers can legally direct the movements of occupants during traffic stops. So if an officer orders you out of the car - get out. If the officer tells you to stay in the car, stay in.

Was looking for a breakdown on the mimms case law. Found this garbage. But I’m thinking that i need to start watching more of these boot licking videos to fully understand how people who are ok with destroying liberty think. Would like longer format videos. This video seems to just cover the key words to implement qualified immunity.
