I definitely think this guy was throwing the wood towards the trashcan, missed, and hit the vehicle. Also, it wouldn't matter if she drove over the wood already in the street and it caused the damage. He would be responsible since he was the one throwing it there.

even if he gently placed the wood in the street by the curb then he STILL would be liable because we cannot put things on the street where cars drive and his wife at the end saying that the plaintiff was not allowed to drive too close to the curb is not accurate because cars can pull in and park next to the curbs and drive next to curbs when making turns or avoiding obstacles that are in front of them so unless there were signs posted saying that it was a bus lane or bike lane only then the plaintiff is totally at fault .

How would he know she was speeding if he wasn't outside and close enough and be pissed off enough to whip a piece of wood at her car. I believe he did it all day long. The freezer wasn't made of wood, it was sitting on a pallet so it could be moved easily. This guy didn't even know, what a dork.

He was totally throwing the wood to the curb. Even if one of his actual throws didn’t hit the car directly, he probably threw a piece to the curb, missed, and it ended up in the street, which then she could have ran over and it ricocheted. He’s responsible either way.

He admitted the wood was protruding from the curb whether she hit would that he left where it shouldn't have been she wasn't driving on the sidewalk. So if you have debris hanging in the road you're responsible whether she hit something that was in the road that you put there or whether you fling it a little too hard either way what happened because of you man

I actually believe them both, FOR ONCE. No matter the height of his stack of wood, even " less than 3 feet" pieces can break off and go flying, fast&sporadic. I stack pallets for a living and have seen it frist hand. Its likely he was just minding his own business ("throwing") stacking wood by the curb, at the exact moment she happened to speed by, while mindinding her own business. Nothing malicious, just a, spontaneous accident?

In his answer to the complaint , he claimed she was speeding down the road. Maybe he got mad and threw it at the car because he was sick of people doing that, and thought to himself "She wouldn't be able to prove this to insurance or in a court , since there's no evidence." That's my thought process :p

OMG!!!!!!!!!!!!! They were clearly having an affair and she was over it!! I’d say as she was speeding off with her belongings, and he threw something that hit her vehicle. Last attempt to get her back? This was a crime of passion. Marilyn is such a class act. She didn’t go there since the defendant’s wife was present.

I believe it was the right call as the damage was by both parties caused by his garbage/wood. He never denied it was only that he didn't throw it there. His story kept changing slightly every time he told it hers didn't. He started out saying it was up on the sidewalk next to can and was asked about that again by judge, then it was partially in the street set down while he opened up the lid to can. If he had just carried it down to do such he would have been at the curb also and not back up by the garage. Rather he threw it or set it partially into the street and her tire caught it and flipped it up he is still liable. He could have set it at his lawns edge or completely on sidewalk and it wouldn't have resulted in what happened. Even if someone had tripped on it on sidewalk he would be liable because that is a public walkway and you can't obstruct it.

Not a stretch to think that a piece from the pile he was carrying to the curb fell to the ground, he went back and turned around attempting to toss it into the pile, but was flung a bit too far and hit her. Nothing malicious, just an accident. Doubt if he played baseball 😉
