Yes, unfortunately the pardons, commutations, etc… are all legal as he has not been hit with the 25th Amendment. The one area that may give him some trouble are the preemptive pardons as there is no precedent for them and the Constitution is silent on them as well. The Supremes would have to divine the will of the founding fathers on that issue, and since they do not have the activist urges of prior courts I think they would remain silent as well.

When I look at the Bruen Decision and how 6 of the 9 justices ignored 'legal experts' and based their decision solely on the published essays of James Madison, I think they'd do the same about scouring the writings of our republic's founders for their purpose and intent regarding presidential pardons. We may be looking at a 6-3 decision that preemptive pardons are outside of a president's pardon authority. This is going to be one of those "time will tell" things as to whether they'll even hear a challenge, or will decide to determine if the words "preemptive" and "pardon" should exist together in a president's pardoning authority. One thing I've noticed about this incarnation of SCOTUS is that they aren't shy about hearing cases that other incarnations of SCOTUS would duck away from. I'd love to hear Alan Dershowitz's opinion on this. He's had an amazingly accurate history of predicting how SCOTUS will rule on cases.
