Philip DeFranco Sexual assault is sexual assault. In my eyes, be it a man or woman being the monster who commits the terrible act should be held accountable. Whether in public opinion, court of law, etc. They violated someone horribly, and someone like that should be condemned!

Rape is Rape. Whether it's man-on-man, woman-on-man, man-on-woman, or woman-on-woman. I don't necessarily believe in trial by public opinion, since it's word-vs-word, but her words should be taken seriously & action should be taken.

Someone close to me was once falsely accused of rape. Ever since then, I have always approached allegations like this with skepticism. I don't know who to be believe anymore. It's sad that people lie about these things. Rape and molestation are very serious claims. I just hope the truth gets revealed and the true guilty party is outed.

I am always skeptical of accusations (whether against men or women) until evidence is provided, multiple accusers make similar claims, or the accused confesses. However, if Melanie did what Timothy alleged, anything other than a ‘yes’ should be treated as a ‘no’ and Melanie’s response of ‘not hearing a no’ would not excuse that kind of behavior. That all being said, I’m curious how things will play out now that a woman has been publicly accused.

Though this is not hard evidence, I'm leaning towards Timothy because in Melanie's response she didn't address any kind of consent beyond her supposedly 'not hearing a no.' We know that's not the same as consent, but it appears as though Melanie thinks it is which is very troubling.

Briqt Wemmde Her phrasing sounds like confirmation of what Timothy described happening, but I’d like to give benefit of the doubt and wait to see if her response was mis-worded or if the circumstances in both stories align and Melanie legitimately thinks that not hearing ‘no’ means consent.

I don't believe either side until proven either guilty or innocent but until there is evidence to support claims. Rape is a hard thing to prove because if you don't act immediately afterwards evidence disappears and waiting makes is increasing harder to prove rape happened.

Even with lots of evidence and even eye witnesses, people like Brock Turner get away with it all the time. Rape kits get lost or pushed to the side and discredited all the time, and if you don't do something extremely quickly it can't pick anything up, and its a super invasive process as it is that can make a victim feel even worse. People are always screaming for evidence, I don't know what they want. If it didn't happen on camera, its not real? Yes people shouldn't automatically be considered guilty, but sometimes we have to take victims at their word because it's all the proof they have.

You could report right after the fact and it is still difficult to prove, especially if its someone you know and are close to. The question isn't "did intercourse happen". In this case they need to determine if there was consent and that only comes from word of mouth. The you have one testimony claiming there was consent and another says there wasn't.

Brock Turner got a slap on the wrist because the judge was a piss ant. I think people are STILL gunning for his job, and rightly so. And no, in America we don't assume guilt. It's one of the things that separates us from the tinpot dictatorships of the world.

the cops 99% of the time don't give a fuck and with someone famous they can be paid off to keep it quiet so the next best thing is to ruin their image so the cops can't ignore it and a lot of the times the victims are scared especially dealing with a celebrity any type of move against them can ruin you

I’m kind of grossed out by the number of people who are treating the accusations against Melanie Martinez as some kind of victory against feminists. No rape should ever be celebrated. Regardless of your ideologies, rape is always a horrible, disgusting, traumatic event that should universally be condemned.

Sam S No one is celebrating rape. What I'm observing is that, Mel's "still" fans are going on "Melanie is not like that, she's a sweet girl" when that is plain stupid to assume. Nobody but the closest people in her life know her. Hell, Melanie only knows herself just like I know the real me, and you know the real you. What some people are trying to bring awareness to is that, if Melanie was a Male who had done this, most of those "still" fans would not be saying the same words as they are now. The male artist would be immediately investigated, and the media would be all over him unlike in case of female artists who it seems that they can get away with it, and even joke about it on tv without consequences. I also see people just jumping into conclusions TOO QUICK, which is wrong. We don't know for sure what the truth is, there need to be a deeper investigation on the case. Rape is just plain wrong so are false rape accusations. Stay Neutral on this matter until more info comes out.

I love how people are bending over backwards to try to defend this Melanie chick, like if this had been a dude doing this to a woman there would be no fucking question that people would pounce on him like a piece of meat. My standard has been and will always be innocent until proven guilty, but it's insane to see all these "we must believe accusers under any circumstances" going to "we need video evidence" or "how did such a small girl overpower someone". yeah i see how this is true, but in other situations it just isn't. Take Ed Westwick who was just accused by a woman of raping her years back whilst he had a powerful position over her. He is a loved actor and many people took the stance of 'innocent until proven guilty' which i think was justified since there was no evidence. I myself was a huge Melanie Martinez fan as you can tell by my photo. I looked up to her and had watched her ever since she was on The Voice. When I found this out I was horrified and disgusted to think my former idol would do such a sick thing. I had a few moments of disbelief but then read Timothy's story and I believe her and I'm frustrated with Melanie's response, but yet again no one knows what happened only Timothy and Melanie do. I am extremely sick and disappointed to hear any of this but I will wait and see what happens when justice is served.

Rape is a very serious accusation. So to all those people that are quick to take on a side, *READ THE RECEIPTS* . First, Melanie admitted they had sex but she also said it was a mutual decision. She said it TWICE consistently. However, Timothy have changed some details with her story about the situation even with the timeline of when things happened. You might say that it is a VERY traumatic event that one could have forgotten such “minor” details, to that I agree. BUT was the situation really that traumatic to her to the extent that when she was asked to state what happened in details in an interview- ON CAMERA, and even on Instagram live, she has the audacity to laugh and treat it like it’s funny? I’m not even a fan of Melanie but I am so fucking pissed about this because I am a victim of the same matter myself, and seeing someone blatantly using such a sensitive topic for personal gain is just downright unforgivable. And don’t tell me bullshit like she had nothing to gain from it, she had released her first single 6 days ago, it needed publicity and she got it. She gained 50k followers in a few days. She even took a picture of Melanie in handcuffs if you were so uncomfortable with sexual activities and what was happening why would you even take a snap? I’ll tell you why. Because it was a SET UP. It was planned ahead. Either way, Melanie’s career which she gained from years of hard work is now over. So she got what she want. If a person is already considered guilty just because of a claim in a mere tweet. Then we’d all be in jail.

There is evidence that Melanie wasn't even in the same freaking state the same day of the accused rape.She was traveling back from tour. Also she did make it up for publicity because no one would react the way she did or even go live on Instagram literally the fucking day after. She has mental problems, Borderline Personality Disorder(BPD) if you already hadn't known and she confirmed. Plus she literally fucking promoted her single the day after she fucking allegedly confirmed she was raped. These are all facts, not a biased opinion like yours.

When a woman is accused of sexual assault, her victim’s testimony should he held at the same level as the testimony of a man’s victim. And same goes with the accused; don’t rush to assume a man is guilty if you’re not gonna do the same with a woman.

Okay, some of you may not have ever taken a Psychology class, so let me tell you something: someone who's had previous abuse will freeze up just like Timothy did. They had an abusive relationship, which is why it was hard for her to physically resist. This is textbook abused behavior. Also, Timothy did state she said no multiple times. Male or female, high or not, I hope that this case is treated with the same seriousness as a male case would be and that if Melanie actually did molest Timothy she'll be shown the same justice as any other molester. I 10000% believe Timothy. Her account was extremely detailed and did come across as very genuine. Martinez's reply was just 'she didn't say no'. And even putting aside that Timothy said that she said no multiple times, lack of dissent does not mean consent has been given, particularly not when Martinez had been pressuring her for two nights.

RAIN MAYHEM She felt overpowered by Melanie and as she said, she loved her. She didn't know what to do. In proven real cases of rape, this has occured many, many times. It's sad, but most likely true, in my opinion.

Melanie was also very vague in stating "what we chose to do together." It begs the question that this isn't the first time she took Timothy's denial and passiveness as being willing, it makes it sound like them being bffs and having done so much together made her think that this behavior was okay.

Of course people are cherry picking who to believe and who to doubt. It’s easy to say “believe all victims” until someone accuses a person you love/respect. Innocent until proven guilty is pretty much the only viable option, because it applies to both parties! I assume the accused is innocent, AND I assume the accuser isn’t lying. Start with the assumption that it’s just a horrible misunderstanding and adjust your opinion as more information is revealed. I’m honestly curious why people find this difficult to do. If you have a different opinion please hit me with it. I could always just be stupid so take what I say with a grain of salt.

I'm kind of shocked by the Melanie Martinez thing I only just got into her music, but I find it so odd that someone who writes songs that subtly address sexual assault and abusive relationships would herself be an abuser. I'm saddened by this. I don't really know what to say other than I hope that Timothy can get the help she needs or desires so she can get through this hard time. Wow.

Lia Tan actually knowing our justice system the way it is in that people care more about cats and dogs than rats that are more sentient than cats and dogs. No I'm not happy I'm glad that the cats okay but I'm not happy that this kid got arrested. I'm not happy with the way our system is it's not going to change anything this kids probably going to become more of a delinquent and hate cats for the rest of his life and kill him but off camera. We got to see who this kid really was and what they thought was funny but we're not correcting it by throwing them in jail putting cuss on them making their parents pay thousands of dollars for an expensive lawyer just because the indigenous status is f***** up in every state. I'm super happy the cat is okay and that the kid was arrested...Idiot even tried to run, I hope he was banged up some in doing so. Really surprised that happened in Ontario though (as I live there) and it's pretty safe/level. I've only seen two cases of animal abuse, one a guy killed a swan and the other there was an animal serial killer in London....They caught both.

This whole story is hard to speak on. I was falsely accused. So many people turned on me and I couldn’t leave my house without the fear of being assaulted. I was proven innocent but today I still see so many people who don’t believe me and still believe the girl is still a victim. She’s out today accusing a new guy. I personally don’t know what side is telling the truth. I don’t know what the truth is I feel bad if the girl was raped, and I feel bad if this was a false allegation. But I know for the fact the truth always comes out.

It was found that he was innocent apparently (this was last year and he was a senior so I'm not sure) but this probably ruined his chances of getting scholarships and all that. If one of my close friends accused me of raping them, and everyone started hating on me I would want to appear as forgiving as possible. I think we need to put much more importance and really encourage victims of sexual assault to go straight to the police. It really helps sort everything out if it's dealt with properly and right away rather than tweeting accusations years later.

I went to the police and they asked me to clarify whether I said no and if it's not just a case of me regretting it. Then they laughed because she was a woman. I went through the report anyway and was called a month later and told that the rapist had bigger charges on drugs pending already and would I please drop my own charges as they would just delay their drug case and the likelihood of her being convicted of molestation was slim. I was outraged and was told by them that is actually very common bc drug convictions give perpetrators more time than sexual convictions do. There's a reason most victims do not go to the police. The emphasis should be placed on how society views this issue as a whole and the the current system will follow. We can start with education and statistics since many people such as yourself aren't aware this is an issue.

Plus police definitely can't do shit if you just tweet it years after the event. Considering the KZbin news, Theodd1sout had his own second account shut down and had his appeal to have it restored denied due to KZbin saying he was impersonating himself. I hope the increase in staff helps address issues like this and others such as inappropriate demonising and running ads on actually inappropriate content.

Here’s where my issue lies with the Melanie Martinez situation. The due process in the United States is INNOCENT until PROVEN guilty. I am a sexual assault survivor. I am a victim of abuse and a victim of assault on many occasions. But, if I chose to press charges after. He would beinnocent until proven guilty. Blindly believing someone is different than showing support to them. I am still a fan of Mel, because in my eyes she is not guilty. There is nothing besides her testimony that says otherwise. Do I believe Timothy? I don’t know. I can’t discredit her as someone who’s speaking out. But again, there’s nothing besides her word. Even in cases of assault against political figures, they are innocent until otherwise. If more people come out agains Melanie then my view point may change. But at this time all we should be doing is showing support, not automatically assuming that she is guilty of rape.

ARE THEY EVER AWARE THEY ARE RAPING THE OTHER PERSON'? You can have sex with someone and think they are only nervous or are not experienced. People say "Timothy said no many times" No, what? "no" might mean " not this position" "not like that but go on" the word No alone doesn't mean irrefutably "I will not have sex". It really is difficult to say. I have no doubt she felt molested, and at the same time I don't believe at all that the other woman Melanie thought she was forcing her or was under the impression it was not consensual.

I wouldn't attack her, but we need to always look at both sides of the story in these things. Rape charges are serious, and there have been innocent people convicted of rape. Very well could be a fame grab or slander, their friendship could have ended recently. To send her to jail for an ex-friends revenge would be just as bad as ignoring Timothy's claims in the first place. What sucks is that one person has to be telling the truth, and I hope its Timothy, the other way around is just as horrible.

I agree with that 100%. But I was reading the replies on Melanie's response on Twitter and the ignorance and people saying Timothy made it up in order to get followers is outrageous. We'll have to see what else comes out but at this point I don't know what to think because there are 12 year olds being awful because someone they stan has been accused of a crime. I would hope no one would make this up, but I don't think that someone would pull a name like Melanie's knowing that she was be drug through the mud for saying anything negative about their "queen"

Gotta say, a bunch of the comments I have seen on youtube and news sites regarding Martinez have been MUCH more skeptical and have talked more about "innocent until proven guilty". Where as sexual assault with male stars people jump the gun and just assume they are guilty and usually go into name calling and slurs. I appreciate that people are not immediately assuming someone is guilty because they are accused and it is the correct way to go about things. However, the hypocrisy has been insane.

yeah i see how this is true, but in other situations it just isn't. Take Ed Westwick who was just accused by a woman of raping her years back whilst he had a powerful position over her. He is a loved actor and many people took the stance of 'innocent until proven guilty' which i think was justified since there was no evidence. Double standards do exist but it is simply not true that when a male is accused every female suddenly hates them/believes the accusor.

I'm sorry for my input on the first story, but it feels nice to not be alone I am a victim of sexual abuse, from 4 to 6 I was repeatedly raped and molested by a family friend who is a woman. Anytime I brought it up I would immediately get the same response "girls don't rape." "Girls can't rape." I always felt like complete and utter garbage. I felt like I wasn't an actual victim, that it was just some sort of misunderstanding in a sense. I ended up blaming myself for my abuse, because I just figured that it wasn't that big of a deal. I later realized it was a huge deal, and went to therapy and am still recovering. With that being said, it's relieving knowing another woman is willing to speak up about this abuse, women shouldn't rape. Men shouldn't rape. No one should rape. No one should abuse anyone; no matter their race, sex, age, or sexual orientation.

And everyone believed him, but fast forward three years later and everyone found out he raped not only me, but four other girls. 1. Unless you were in the room you have no idea if she said no. You're all in caps " SHE SAID NO", you're just repeating what someone you don't know personally said on the internet. That's stupid. Also, if you have a boyfriend and your best girl friend who you live with keeps trying to sleep with you and then tries to get you high then you wouldn't get high. I wouldn't get high or drunk with someone I KNOW is trying to push me to sleep with them. There's a difference between being pushy and rape. When a guy buys a girl a few drinks so she's easier to sleep with, that isn't rape. If the girl doesn't want to impair her judgment at the end of the night, she doesn't have to drink. Slipping her date rape drugs, that would be rape. But any choices you make from intoxication you chose yourself isn't rape, otherwise every single girl (and guy) regretting a drunken one nighter with a stranger could cry rape...what a mess that would be.

Sugar Plum regret isn't rape, but giving a girl a drink to make them "easier" to comply is manipulative and IS rape. It doesn't matter if she took the drink, the man (or woman) had the INTENT to have sex with the victim and was using the means of something intoxicating to alter the victim's perception. Timothy agreed to weed because she trusted Melanie. That's what being her best friend means, they have a bond. Her boyfriend is irrelevant to her smoking weed, he doesn't control her decisions so she doesn't have to ask for his permission. She saw it as Melanie making inappropriate remarks and just playing. It lead to discomfort but in her mind prior to the rape she thought "hey, she's my best friend right? I can trust her." This is an educated assumption seeing as how most victims are raped by someone close to them, someone they trust, someone who then uses that trust to take advantage. Timothy said she never said yes and Melanie said "she never said no," so it doesn't matter whether or not she said no because she NEVER SAID YES according to BOTH women. Yes is the go ahead, silence is not an answer and doesn't mean yes. Timothy said she stayed quiet so it'd be over, which is a very real response in rape victims and doesn't mean she wanted it or is crying rape after regretting it.

I question the motives of dragging something like this into the public spotlight unless it involves pressing criminal charges. I give every person, even Harvey Weinstein, the benefit of the doubt until due process can provide concrete, factual evidence of wrong-doing. I will listen ... but I will not believe without evidence because I am not insane. Using the Internet as a vehicle to try someone in the court of public opinion seems like little more than petty childish drama to me.

Consent is such a fickle thing, and I believe that it varies from person to person. This situation involving Melanie Martinez and Timothy Heller is an example of how gray consent can be. With Melanie's statement, she doesn't appear to deny that they had sex or that she penetrated Timothy with a dildo, so there's at least that confession, but this is literally a battle of she said/she said. Melanie allegedly assumed consent, but Timothy is telling a whole different story. If anything, their relationship sounds like it was toxic and emotionally manipulative. Melanie may have had her own demons, but she seems to have had the power and allegedly used it to her advantage. I don't know. This is just my two cents, whatever they're worth.

When trying to defend herself, Melanie really fucked herself over when she said ‘she never said no.’ That is lack of consent. If there is no clear yes, that is not consent, there is no exception to that. Also, there’s the fact that Timothy says Melanie got her high. I feel like that’s just morally wrong, seeing as Melanie clearly had intentions of sleeping with her, and weed can skew your judgement and cause you to make decisions you wouldn’t otherwise make. It’s like getting someone drunk with the intent of sleeping with them. There is a clear motive there. I wholeheartedly believe Timothy and people need to stop defending Melanie because they like her music. Stop. Supporting. Rapists.

In a way, to put it roughly, you can say that she feels she owes Melanie so much that she thinks she's a _property of_ Melanie, like she belongs to her. That, along with the two nights Melanie kept bugging her about it, made her reluctant to say no. I'm not saying what she claimed was 100% true, I'm just explaining the scenario based on her claim. It's really interesting to me because it seems similar to how emotional abusers break down the victims yet we can't exactly say that their relationship was abusive

Ok, I looked at it, and i tried to give everyone a happy ending. -Timothy said it happened 2 years ago, she never went to the cops, but then PUBLICLY POSTED IT ON TWITTER EVEN AFTER SAYING SHE DIDN'T WANT TO LET THAT MANY PEOPLE TO KNOW Little fishy Timothy, Huh? but, -Mel didn't deny the sex or drugs, but said she didn't say no, but that doesn't mean she said yes either... -Timothy said she was tired and high and remained silent. - They were both really good friends already. I think Mel is innocent until proven guilty. If she is guilty, ok... I won't be a fan anymore. But I'm leaning toward Mel right now.

They obviously both partaked in drug use when it happened too. I can understand the freezin part but i can also understand that there was no signal for martinez to stop. As for the believing all victims, that's just dumb. No matter what the crime is, whether it's murder, robbery, or any other crime, we HAVE to have skepticism towards the accuser. A good amount of it, too. That's how the U.S. justice system works: The defendant is innocent until proven guilty, not the other way around. Always.

Vessica Games I have been in that position so don't just assume. I was raped. Like actually raped. He took me out on a date but drove me into the country where no one was saying he knew this "cool spot" (he was someone I trusted) there was no one there. No where to run. No where for my screams to be heard. Before I know it he was looming over me naked I didn't just give in I fought but I just wasn't strong enough. Timothy on the other hand I believed it until I read the full story and saw her timeline didn't match up and she has bdp which can cause you to alter your truths/reality that's why Melanie stopped being her friend because her illness was too much for Melanie to handle. I normally wouldn't have believed Melanie was innocent but I've seen proof that she is. Just my opinion

Ikr, she didn't deny any of the other details, so either she was aware of what she was doing, or she's used to doing things with bicurious/straight girls who don't show signs of being aroused/into it but still does things to them anyways ( in this era this is actually very common behavior some females exhibit, it's fucking disgusting ). But we don't know the truth for this situation yet so all we cn really do is share opinions. & that thing some girls do being so common could be why Tim didn't push her off or anything in the moment ( besides the whole freezing due to shock possibility ) or tell jer to stop. Concerning the rape, I think many people may subconsciously think of this situation differently, being that female rapists are so much less common than male. However, I've seen so many people since the news taking a stance and reaffirming the evil of the action - regardless of gender or orientation. I was pretty happy to see the practically wholesale condemnation of Melanie Martinez, especially by those who were previously "stans" (I learned a new word). I gotta say though, the fact that some of the people in the comments seem almost *excited* by the news because of the possibility of catching certain groups being hypocritical is....weird? Yeah, weird.

Important notes on Timothy, she makes these acusations as her album is about to drop, there are holes in the story she tells both on twitter and to a new outlet and it causes me to look further into it. Based on the timeline from instagram photos posted and other social media content they weren't even together when she claims the molestation took place.

Second of all, Melanie had no connection with her assets or bank account or possessions. They were not married or related to each other. Melanie had no legal control of her life in any way. She kept coming to Melanie knowing what Melanie wanted from her. Third of all, She was sexually abused by other people but she highlighted Melanie. She only mentioned Melanie. Basically, This is not about her trauma in life. This is about Melanie. She wants to destroy her life because Melanie wasn't with her when she needed her the most and Melanie cut their friendship out. The only defense that people will hold on to is the “consent” factor. She didn't say “yes” so it means she didn't want it. But when you look at the other details in the story, You're going to realize just how stupid you are for siding with the accuser.

Is there any "evidence" or "proof" for rape or sexual abuse? People keep saying they won't believe the accuser unless they have proof, but what would that be? Especially since someone decides to come out after their possible scars/bruises have healed. Most people don't have cameras recording them, they're usually alone, and the "abuser" will almost always deny the accusation. I believe that we need to listen and consider the validity any time a victim comes forward. One thing that has been bothering me as all of these stories come forward is the publicity that these people seek out. If you want justice you don't necessarily need to hang everyone's underwear out on the bushes. There is a proper way to take care of these things. For example, if I were to be sexually assaulted I would go to the police, my religious leaders (even though I am hardly religious right now), or my parents (even though I live ways away from them). There are resources available to all, but not all of it needs to be publized, especially accuzations.

On the flip side what if Martinez is a serial female rapist? Meaning she knowingly and willingly only rapes women because there is no physical evidence (e.g. seaman) to be found ? The only other strong physical evidence I can think of is if there is std's or sti's involved which is traceable. If that were the case my opinion of Tim may change significantly. The implications of woman on woman rape are pretty darn scary.

Idk I'm not gonna take any side with the Melanie thing until I know more. There's always the possibility she did indeed do what was said and is trying to cover her ass; but it's also completely possible that they had relations with consent and something happened between them and this girl is trying to take Melanie down (or there are even multiple possibilities other than that too). I'm not saying either case is true because I don't know. Do any of us? No. Because we weren't directly involved. We are all just outsiders looking in until the full truth is revealed and proven. (though Melanie saying "she didn't say no" did definitely throw me off; but I still won't say she definitely did it because as stated earlier I DONT know because I wasn't involved)
