Paul Patterson has undeniable courage in producing his personal critical survey on what he calls “a costs scam” involving council tax recovery processes. He is an angry man! And his anger is about the concept of the award of costs which are at the discretion of the court.
There are always at least two sides if not more to a story, and costs are often as emotional as the judgment itself. Sadly, the way in which council tax payments are obtained from the local electorate has remained an area of concern for many since 1275 with the initial poll tax conflict, reignited with the modern council tax.
In his earlier book, an historic forerunner entitled, “My Council Tax Stance” from October 2017, Paul wrote: “This all started in January 2016 when my son Jay started to tell me how the council where investing in arms companies, if that wasn’t immoral enough, it came apparent that the council are deceiving people who have fallen into arrears with their council tax. They are deceiving them in the summons they are sending out to them.”
He continues, declaring that a summons is “nothing more than an invitation to the council’s place of business, a room in the magistrates’ court, nothing to do with the magistrates, just a way of putting fear into you. Hundreds of people all summons to appear at Bodmin Magistrates Court on a Friday afternoon at 1.20pm.” With his new paperback, Paul has expanded his points to cover the pandemic and after.
Paul then sets the scene, stating that “a council officer will be waiting to usher you into their place of business, get you into agreeing to paying by instalment and that way accepting liability without even seeing a magistrate. The following information is purely based on my experiences over the last twelve months. Anyone wishing to use the following information does so, in the full knowledge that they take the full responsibility for their actions.”
There is then a plea where Paul states: “I ask readers to not believe what they read, until they do their own research. Research all the links, the use of any or all information that follows implies the reader’s acceptance of this disclaimer”. In his original book, he offers advice that many of the letters he cites can be used as templates for your own council tax stance”.
And Paul is back on the attack in 2020 with “The Great Council Tax Recovery Scam”. He updates his original work setting out how a Defendant might challenge costs in a practical way. There is an analogy here to the non-payment of the licence fee where those opposed to such fees were encouraged “on mass” to make a challenge and clog up the court system.
With the sheer numbers of Defendants in both licence fee and council tax cases being so high. The court (and the Johnson government since 2019) have remained concerned at the numbers and chaos which can ensue. Bulk listing liability orders have been a matter of concern with the council tax and many other civil proceedings where the allegation is that the Claimant receives preferential treatment with their causes of action, and the inflated costs sought against mainly vulnerable people.
There is only one conclusion: urgent reform. There is also a bigger issue about the extent of the powers of local government officials who are often considered to “over-egg” the costs they seek by doubling up the sums of money for work done. Sadly, it remains the position that costs so often out-strip any sums of money sought or issues in dispute resolved which makes a mockery of “open justice” which remains the preserve of the rich (except the council tax payer).
It is clear this book will be highly unpopular with many officials, and it does not aim to replace professional legal advice which should be sought. It is feared that the only real solution is a root and branch reform which will occur with the post-Covid developing chaos to the justice system once tax arrears and costs claims return to the courts. You are very brave to take these people on, Paul.

The reality of this is councils acting as the court in their own cases. There are no court records or court order. Do a Subject access request on the court. What the court and council offices are doing is criminal, I have identified about 12 offences, some carry up to 15 years in prison and an unlimited fine for each offence.

I pay it, but I don’t want to pay it. The reason is because the bastards are not accountable and I do not see any fruits of us all paying it. council tax has put me into povery since 2010 when benefit claiments were forced to pay towards there council tax, i have never signed agreed anythying with the council over council tax, but it doesnt stop them colluding with the dwp to take money direct from benefits without my permission, i have lost count of the amount of liability orders against me, but i know this cannot carry on this way, i agree its basically a sham tax like the council tax was .

🤔 The reality is the amount of Council Tax you pay ! Lovely pie charts are given but a true breakdown is not ! 25 to 30 % of money paid is for council pensions! This in itself is not a payment any Council Tax payer should be contributing to . Anyone that gives a bill of service should give a detailed breakdown of the costs they are charging for . A pie chart is not a detailed breakdown nor is it transparent.

Whilst I appreciate you trying to give a balanced view and advising people on getting legal advice, but what about those who can't afford legal advice? We know that Council Tax is unlawful and in the control of corrupt officials who abuse their power to pick on the most vulnerable and poorest in society. I know of MP's who have fallen into arrears with Council Tax, and I have seen interviews on TV about the CT system being broken, so why is it allowed to continue? As a consumer, I have a right to question the fees that I am being charged, but you ask your local Council for a formula they use to calculate the fees. They can't do it because they don't know, so why should we be forced to pay for something that is hidden? I have been financially abused for years by the council, they won't reply to my emails, they tell me the matter is closed but they keep sending out bills for hidden fees. It's wrong and it needs to stop.

I believe, it was a Labour MP last year, on the Andrew Marr programme, said that Counci Tax needs scrapping because it is not fit for purpose. And I agree. It is after all, a Tory tax and we know that their objective is to serve the rich and punish the poor. We are being pulled back to victorian times under this Tory government.

Bracknell Forest BC had a load of councillors who hadn’t paid their CT, and one who had been given a liability order.... but they refused to name them via FOI requests, which then went to the Tribunals Court who found against them and told them to release that data. They just ignored the court.

You need to do more research and to understand contractual and common law. Do you know of a law that says you have to pay council tax? And I don't mean a legislation or a statue as these are not laws they are made for corporations. Have you ever signed a contract with another living man or woman in the council? In other words can they provide evidence of a signed contract where you have agreed to pay council tax. Remain honorable and send council a letter of conditional acceptance. Send it to a man or woman not PO address or a title. Never say you will not pay. Send the notice 3 times copy and paste the questions each time. Let them know you are going to send a second and third notice. If they do not answer your questions by the third time. It becomes a tacit agreement. In other words. They have failed to rebut your questions and your notice stands in contract and common law as the truth. Never make statements only ask questions. As I said do your own research. The system is fraudulent they rely on frightening you and they rely on your ignorance. Why are we afraid of pieces of paper. The word summons means invitation. It is an invitation to a stage performance where they want you to perform as a defendant. It is all fictional and it is all acting. How much do you value your time. Choose a fee that will deter them wasting your time

My local council made an administrative error and lost paper work now six years later they want £15,000 because I can’t prove it was their error ,they can’t prove it wasn’t .it is my belief that it is down to the legal profession that there is a problem I tried to get legal advice I can’t have legal aid and solicitors want £300 phr off people already in dire straits if solicitors and the councils worked for the public like they should then I wouldn’t have debt collectors knocking on my door demanding money that I truly believe I don’t owe but had no chance to defend myself solicitors and the system are all complicit in the corruption of this country and our laws screw all of them I for 1 have had enough

Here's some professional, legal advice. Commercially charge every false claimant who enters your life. A court of record is paper. Hold your own court and make them present the evidence to support their claims. the key word here is consent. There is no contract without consent, in full knowledge and understanding, without coercion or deception of any kind.

Good Morning Sir. No individual is morally or lawfully liable to fulfill an obligation created by another.. (eg a debt I create and make you liable to pay/a contract I enter into and make you responsible for the performance of its terms). If this proposition is true then how is it morally acceptable that the state can punish those who refuse to comply with the obligation when the obligation itself is immoral/unlawful/an act made against my will. What does that tell us about the individuals operating the machinery of government.. And not to mention consent, if a man penetrates a woman against her will without her consent, that is rape no... Isn’t that classified as statutory rape? This can carry a sentence of 7 years I believe. When a policy enforcer stops you in a car and coerces you to sign the unlawful ticket he has issued he is in fact carrying out the offence of statutory rape especially if we are travelling in our modes of conveyance. Mr Phillip Taylor MBE barrister is wrong about the court costs. The judge does not chose the amount of court costs, he/she just agrees with the amount without even questioning it. It is their responsibility to check the cost but fail to do so on every occasion. Cost vary from council to council, ranging from £75 to 135. The so called judges also fail to look at cases where the resident has not turned up to court , which is the vast majority of cases and always find against them in their absent and charge costs at the same rate has people who attend although all the absent cases all together takes two minutes of the courts time. The judges are not doing their due diligence. The court is not a court of law but a administrative court only ( business meeting). Administrative courts are contrary to the common law and are getting ever pervasive. Lord Chief justice Heward wrote a book on the subject in 1929 titled The New Despotism, in it there is a chapter titled Administrative Lawlessness, so this has been going on a long time now.

Absolutely correct. We need a total reform of the courts and the civil procedure rules. People have no access to courts as there is no legal aid for civil matters. They have closed all courts and courts counters. Online access to court staff by call centres. No access to direct access barristers unless their Clerk permits them to accept your case.

interesting video.i'm disabled and now have to exist on state benefits, i have experienced problems with council tax in fact they sent me a summons for the magistrates court earlier this year (even though i had been paying council tax) i did some research on the matter before i emailed the council. magistrate courts deal with criminal cases and council tax arrears is a civil matter therefore a county court should be dealing with it not the magistrates. to have a hearing and you are not allowed to attend and state your case to a judge isn't this also unlawful? i put this to the council via email along with a few other points where they fall short in their duties. i'm considering taking legal action against the council as last year i discovered by way of a letter i had overpaid my council tax by a considerable sum and as yet have not recieved a satisfactory answer as to where the money has gone.

In my book I have Barnet Council's costs that they are claiming. Barnet state 9. Cost to be charged in respect of liability (A * C / E) A is . Barnet total gross cost of Council tax operation (2017/18) £5,026,516.00. How can they claim for gross costs? B & C are the only costs they should be claiming 5. Cost of activities between summons and liability order hearing £502,651.60 4. £2,261,932.20 so they should be claiming £2,764,583.60 So over charging by £2,261,932.40 The judge in the Rev Paul Nicolson case v Haringey Council stated the council can only claim incurred costs up to gaining the liability order, and yet Barnet are claiming 'Post liability order costs' and the magistrates are allowing it.

The wealthiest areas are charged the least amount. For example compare council tax in Kensington and Windsor to Bridgend and Liverpool. Also council tax doesnt even go to your local council, it goes to central government.

There is no LAW to say we're obliged to pay for Council tax and it goes into a Consolidation fund which the government can use to fund genocide. The Government give the Council funding to run services but this comes with conditions attached.

@@PhillipBTaylor Rochdale council and other councils in Greater Manchester have been holding telephone hearing for council tax at Greater Manchester Magistrates Court. HMCST have been informed. Rochdale Council sent out just under 3,000 summons for people to attend telephone hearings on same day, people couldn't get through it was chaos nearly all had liability oeders made against them. I sent in a few legal notices for a few people, and their cases were withdrawn. I was told the magistrates only managed to hear two cases.

LEGAL NOTICE 21tst September 2020 FAO Greater Manchester Magistrates Clerk to the Justices Greater Manchester Legal Team Dear Greater Manchester Court, In my legal notice to the magistrates and clerk to the justices dated 10th September I asked for the following : - (Copy also sent to the council) Disclose Rochdale Borough Councils ‘detailed’break down of costs. Rochdale council have sent me a break-down of costs, but this is not a ‘detailed’ break -down and without a ‘detailed’ break-down of these costs the court and council are stopping me from making a lawful challenge of these costs. I have since asked Rochdale council to give me a ‘detailed ‘ breakdown of their costs they are claiming as ‘overheads.’ The council has refused to give a detailed break-down of these costs. Until I receive a‘detailed’ break-down of these costs I ask the court to now adjourn my hearing on 25th September 2020, even if the court or council now give me a‘detailed’ break-down of costs, they have now left it too late for me to make a lawful challenge. If the court now go ahead with my hearing on the 25th September without allowing me to make my lawful challenge I will have no other alternative than to ask for a case to be stated and if need be a judicial review. If the court nor the council supply me we these ‘detailed’ overhead costs claimed by the Council I believe the council and magistrates will be breaching High Court Case ruling of: CO/976/2014 Rev Paul Nicholson v Tottenham Magistrates, because adding unreasonable costs to the claim was unlawful. Following on from the 2014 case of Nicholson the High Court held that a Local Authority must be able to demonstrate to the Magistrates’ Court that “the costs claimed represented costs reasonably ‘incurred’ by the Council in obtaining the liability order”. If the overhead costs which the council is claiming are reasonably ‘incurred’ are not broken down the magistrates can not agree they have been ‘incurred’ in gaining the summons. I suspect that the costs are being used as a form of penalty or deterrent, or as a means of covering the Council's general administrative costs of collecting council tax, rather than reflecting any actual or fair appraisal of the actual costs incurred by them in enforcing the obligation to pay. Tomorrow (25th) seems to be the first attempt by HMCTS to do Council Tax Liability Orders - via the phone…which is completely ‘unlawful’. For example: A. There is ZERO provision in legislation that allows this to happen and it should be stopped as any orders made tomorrow would be void ab initio B. Neither the Magistrates’ Courts Act 1980 nor the Magistrates’ Courts Rules 1981 SI 552 permit such an approach. C. The Criminal Procedure Rules 2020 SI 759 do not assist as these only apply ‘in a criminal cause or matter’ (Reg 2.1 2020 SI 759). D. Similarly, any attempts to borrow rules from the County Court and High Court are misconceived as the CPR rules do not apply - see Lone v Hounslow LBC [2019]. E. In the County Court and High Court, CPR 23.8 A permits the setting up and holding of a telephone hearing at a ‘telephone conference enabled court’ for case management and costs proceedings. F. But none of this helps with liability orders being outside the scope of the CPR… G. A telephone hearing can be used with a Case Management Conference in some civil cases before magistrates since January 2020, under the amended Magistrates' Courts Rules 1981 SI 552 but when did anyone hold one of those for local taxation which is governed by its own enforcement regulations? H. In fact, they cannot as the procedure is entirely statutory, governed by the Council Tax (Administration & Enforcement) Regulations 1992 SI 613 and allows no scope for case management since the task of the justices is restricted and constrained by the regulations. No other steps are prescribed other than those in the regulations. I. There is no basis and no scope for effectively making up rules or applying technology in this way and you will be in breach of the legislation, constitution and the Bangalore Treaty if you allow these to continue. J. What scam you been. Obligation ( lawful ) was removed from 1992 local gov finance act - not lawful. 2003 the ‘ liability order’ was withdrawn with nothing replacing it. All councils are corporations ‘ for profit’ since 2009. ( uk gov 2005) go into companies house. Dunn and Bradstreet and VaT numbers ( what happened to Brexit?) It’s a civil matter which means County court. CCJ cannot be given against us because there’s no contract. Business cannot force joinder - contracts with people. I stopped 1st April batted away all ‘ debt recovery’ purporting to have a liability order. No court stamp just words. Fraud act 2006. Then claimed all my ct back since 2014 via NatWest. Go for it! Defund the crooks!

The Birmingham city council sent a bailiff to a friends house, he has all my post. to collect the unpaid c.tax of £752, there was an initial threat of forced entry, this they denied later. Because my friend was at work they posted a letter in his letterbox. The following day he took time off work terrified of having his house trashed!! I immediately called the bailiff, and after a wait of 7 hours!! Finally spoke to her. She treated the call as a joke, laughing throughout. She said she was represented Equita and wanted me to pay unpaid c,tax from August 2020 to February 2021. And said i have 1 week to pay it or prove it was paid. Whats my rights? have i got any? I have contacted the property company managing my flat then to see if they can help .

Thank you for this review. I can see you feel impacted by this situation, I think you are restraining yourself from further comment. I cannot imagine that you are not aware that people are in receipt of council created liability orders that have been signed by magistrate court officials, in a simulation of legal process, as though they are court documents, with authority of the court, that this is against Justices Clerks Society Procedure advice (2011, revised 2023) thereby court officials failing their inherent duties and obligations under their oath and common law, leading to legal and ethical implications. What I think must be ultra vires and an abuse of process, could be punishable under torte law. Perhaps you may also be aware that even when we bring behaviours like this to the attention of council revenue staff’s attention, these are ignored, with the response that they will continue to pursue the alleged debt?

Magistrates' Courts Act 1980 s.58 says recoverable summarily as a civil debt only. The County Courts Act 1984 does not have the jurisidction for enforcement because it says s.16 EXCEPT shall only be recoverable summarily.
