Tim, the ATF has no rule making authority. Congress can't delegate law making out to other federal corporate agencies, it must go through Congress to have any effect, as upheld by multiple Supreme Court rulings, most recently the EPA vs. West Virginia case. And this applies to all agencies, including but not limited to the ATF and the IRS. These corporate entities don't have power over we the people. We need to start acting like it.

Well, that's a commendable le position, and things should work that way. Congress has abrogated its responsibility in allowing these so called "enforcement " agencies to decide policy. Congress needs to be held to account for the blatant ambiguity and abuse of power that they allow to these agencies. As it stands now, these agencies can and have ruined lives.

I'm pretty sure Congress passed an act allowing itself to delegate rules and interpretation of laws they have passed to agencies tasked with enforcement. Surely we should know this rather than just complain that it is wrong. At least then we'd know the specific legal hold ups. Edit: I looked it up. Hard to find, but this looks right: Rulemaking is largely governed by standards set forth in the Administrative Procedure Act (5 U.S.C. § 551 et seq.). I wanted to add that it is illegal to convert your AR rifle into a pistol. If you buy an AR rifle and change out the stock to a brace and change the upper to less than 16in, it is illegal. You can convert a pistol to a rifle but not a rifle to a pistol.

But remember that a pistol over "26 inches in length is an "any other weapon" requiring a tax stamp. Best to swap brace with a stock as you would your barrel. I've got a 20" and a 10.3" as well as a .300 blackout 16".

Great video. As a new gun guy, i found these rules so damn confusing.. i mean clearly any AR is NOT a pistol, but theres so many damn laws to jump around. Also, why are so many people hating on Tim? I dont get that one either.

Summarized fellas: Rifle: 16 inch Barrel. SBR: Less than 16in Barrel WITH Stock (intended to be fired from the shoulder). AR "Pistol": Less than 16 inch Barrel NO STOCK, but with a BRACE not intended to be fired from the shoulder "wink wink" *with AR Pistol DO NOT PUT a vertical foregrip on it only a angled foregrip. Vertical Foregrip equals $200 Tax Stamp. Just saved you guys some time. And of course these rules and laws are good because as we all know, bad guys follow the rules, and good people should be punished for what bad guys do.

There's some bad information in here. It's not simply a matter of putting a brace on it or putting a stock on it, that determines whether you have a pistol or an SBR. You can't just take a rifle and swap out the upper for a shorter barrel, and then throw a brace on it. Once a rifle, always a rifle. What matters is how the gun was originally "designed" when it was serialized and how it was designated when transferred. Ironically, if you buy a "pistol", you can put a 16" or longer upper on it all you want, and switch it back to a shorter barrel whenever you want. Once a pistol, always a pistol. In other words, just make sure that all your AR lowers are "pistols", and then do whatever you want with your uppers. Side note, if you own an AR "rifle" and you buy just an upper with a barrel less than 16". The ATF can and will charge you with "contructive possession" of an SBR. So again...just stick with "pistol" lowers, which are generally covered by your CCW while "rifles" are typically not, but check your state laws to be sure on that one.

Brace rule was not struck down because it's unconstitutional it was struck down because it violated the APA. They, in theory could reset and start this whole nightmare all over again.

Unless something changed with the recent court rulings, swapping a rifle length barrel to SBR length and simply changing to a pistol brace doesn't make it a pistol if the receiver was originally listed as a rifle (sold as a complete rifle) on the form 4473. If you bought a receiver listed as "other," you have the option of building a pistol or a rifle. The swap you described, if the receiver was sold as a rifle, would result in an SBR with a pistol brace. Again, perhaps the court rulings changed this.

Correct, it would be unlawful to switch out a Rifle stock to a brace on receiver that is originally listed as a rifle. You can only switch it out on a receiver that is a Pistol.

ATF is supposed to just ENFORCE laws! Same as the FBI and every other law enforcement agency does! For some reason the ATF he’s been allowed to WRITE “regulations” or reinterpret definitions!

Thing to note is you cant turn your Rifle into a Pistol. Only a Pistol can be turned from a Pistol to a Rifle and back to a Pistol. Rifle can only turn into a SBR.
