It appears that Microsoft is making a strong argument against its critics. Sony will regret not having planned these attacks on the ABK merger much more carefully. If this is litigated, Sony will face additional difficulties. First off, there is a good chance they would lose if the matter went to court. Second, if it goes to trial, questionable practices will be brought to light. I must admit that, given all the difficulty Sony has created, I don't really feel sorry for them.

If this deal is blocked Sony will not get anything of substance through themselves (ie. no SquarEnix, etc) as all the same arguments Sony has used and EU and CMA are parroting will apply to Sony gaming, even more so since they are twice the size in console market space over Microsoft gaming. In fact, in the the EU since the EU regulators and CMA only view there are two consoles (Sony calling Nintendo a toy maker and regulators agreeing) the PS has over 70% of the console market and it could easily be argued just on the fact it controls such large percentage of the market (in various countries on EU regulators prevue) any move would damage their competitor. Additionally, MS really can't go after them for anti-competitive behavior. MS can make a complaint (at least in US) to government bodies and those bodies would take it from there if they want to pursue it further. What is more likely to happen is MS in case of the dealing with the aftermath of failed BK deal would respond quickly and just finish off the deals that were but were put on the backburner when the ABK deal came into play. The competitive move after that would be primarily to in part by using similar model as Sony uses with third parties. But it does so to get big deals across within variety of areas (billions spent but do so much cheaper than buying ABK) over just COD. It won't' be as difficult to do so this gen with closer sale numbers between PS and Xbox (along with streaming becoming more important determinant) and with many studios moving on to PS5 and Xbox Series only that dealing making would be solely surround compensating losses for this gen not last. I can also see Microsoft is more likely to just buy IP itself, make smaller acquisitions and go about making large investments (not outright buying) various studios/publishes. Do what Tencent does and buy 20% to 49% of companies. Do what Embracer has done a few times just buy the IP outright, not necessarily the studios. Do what Sony does make long term exclusivity contracts or marketing deals that also block out games from reaching competitor's subscription services (game block).

Based off the FTC's argument a very easy solution is just to say "Exclusives as a whole are anti competitive." Sony and Nintendo and Microsoft might grumble (well probably not Microsoft as much), but I'd be all for that. Bayonetta 3 and Astral Chain and XC2 on my PC with better performance would be lit (they aren't really in the conversation but Nintendo has way too good exclusives for such lackluster hardware).

The deal is no more likely to fall apart now than it ever has been. Nothing unexpected has really happened yet. Some regulators have expressed concerns about the merger, as everyone expected. The question has always been if there are remedies that would allow the deal to go through. I have never seen any reason why there aren't acceptable remedies. If Sony is in fact talking to Microsoft, I would see it as a sign that the merger is a fait accompli. They can at least get their ten year "CoD on Playstation" deal

The regulatory bodies that are pushing the case have no proper understanding of the market, the instigator of the case main issue has had a direct response for that specific issue and refuses to accept, and the case seems to be marching forward regardless of the knowledge that should have been gained in the last 6 months, that should have clearly explained how this market is set up. And it is common knowledge that the instigator of such charges the regulators have run with is doing an order of magnitude worse in terms of the same activity. Huh? It is absolutely bonkers that these so-called regulators have yet to be able to see that one game is not going to disrupt an entire market. It's just crazy!! How where are we at this point and they don't know that yet. They're going to hurt cloud computing in the future because they have call of duty? This is just freaking crazy

I don’t think folks realize the effect this merger will have on the Gaming industry as a whole. I hope people realize that any of these developers not on board with adds in games are being purchased by the big companies. I honestly think if Xbox gets this deal we as gamers will all loose. In all history when one company gets a monopoly over anything it’s we the consumer that suffers. If they want to sell then they should be made to sell off to other smaller companies that won’t have a monopoly. Sony, Microsoft or Nintendo should not be allowed to purchase. To many big games that will creat a monopoly

You know, after this, if I were Microsoft, I'd be looking at challenging every acquisition that Sony attempted, as well as any other big business thing they wanted to do. Existing exclusivities? Is there a way to charge that they're anticompetitive and harming our gamers? (I don't have a Playstation, so I can't play Spider-Man... I couldn't even get Spider-Man content for my Avengers game... I felt pretty, uh... well, for the sake of argument, let's say it detracted from my quality of life). I'd be having my lawyers look at everything and ask if there's any way to drag it out and make it unpalatable, without crossing the line wherein I get clapped down for frivolous lawsuits. If that's the new reality that Sony wants to live in, let them enjoy having it impacting them too.

The reason Sony would talk to Microsoft now is what you just said; Sony is about to lose this case in the FTC. They wanted Microsoft to lose but on another level they were using this case as a bargaining chip for Call of Duty. If they wanted to take an advantageous position to secure that deal, AKA pay as little as possible to keep getting Call of Duty games, now would be the time to do it

Whatever CMA decides will likely decide the fate of this aquisition. CMA will get 1st Crack at the aquisition, if they don't like what they see and they block it, FTC and EU will fall into place. Even If FTC were to rule in favor, if EU and CMA rule against they are screwed. Doesn't matter if they are 2 American companies, cod certainly couldn't survive without EU and UK territories.

@@krisdahlin4386 I agree if both EU and CMA rule against, the deal has higher possibility to fall. If it's just CMA, it doesn't mean too much. So far, CMA just give some options and suggestions. I think they are still looking at how EU and FTC case play out before any more solid response come out. And the bright side for xbox is that Sony is struggling to provide relevant documents to back up their complaints. So, I think both EU and CMA are still watching how the situation develops. Maybe Jim Ryan's trip to Europe to lobbying regulators only brought this much benefit for him. He still needs to prove his case in the court.

They should have done that instead buying up publishers. People don’t understand why Sony is fighting this. If they get ABK, it leaves the door open for more publishers. All these armchair regulators here only talk out of their asses. The only reason they want this deal pass is that CoD might get on Gamepass nothing else, their are no new games or benefits for them. OK, so I have posted this comment on mini videos but here it goes again. Sony made a private deal with Activision to have all these exclusive perks for PlayStation users on call of duty. They even went as far as to make it so you cannot turn off cross play if you have it on Xbox but if you have it on PlayStation, you can turn off cross play. Can somebody please explain to me how this is not an abuse of power? They’re literally punishing Xbox users because Xbox wants to buy Activision.

I really hope not only Microsoft wins this case, but that Sony algo gets severely damaged from this! Im sick of this anti consumer company since many years ago, the whole Spiderman MCU drama, Epic vs Apple exposing how they actively plot against cross platform games and the general gamers interest. This generation Sony took countless anti consumer and absurd decisions that directly impact even their most loyal fans, and they just dont care.
