Darcy Johnson he truly didn’t have a choice at this point in time if he wanted to keep his job. I’m not trying to be demeaning to you or anyone else when I say this but the law is complex in regards to questioning and investigating police officers and if you don’t understand the way it works it can be quite confusing. In this case he either had to comply with the investigation and take part in this interview or he would’ve been fired immediately. There was no option at this point for him to get either a union rep or an attorney because that’s not how the process works. He wasn’t being investigated for criminal charges to be levied against him at the point this was recorded. He was just under and internal investigation which looks to uncover evidence of wrong doing on his part that would allow the administration above him to dismiss or fire him and have absolute justification for doing so in order to keep him from coming back and suing for wrongful termination or something to that effect. If they uncovered things that were more than ethical violations during this interview then he likely would’ve been brought back in after he was fired from his law enforcement position and then questioned under the same Miranda laws that regular citizens accused of crimes are questioned under. At that point he would’ve been allowed to ask for a lawyer and refuse to answer questions that might incriminate him. If criminal wrong doing was uncovered at that point he could be charged with the appropriate crimes. When police are questioned about potential wrong doing while they are employed as officers they have what are called “Garrity” rights, they offer extra protections to officers that aren’t extended to the average citizen under the much more well know set of rights known as “Miranda rights” those are the ones your probably familiar with “you have the right to remain silent, anything you as can and will be used against you....”. The flip side of Garrity is that when active police officers are questioned under Garrity rules the conditions state that they MUST answer any and all questions asked of them in relation to the investigation or face immediate termination for refusing. So this guy was basically taking his chances and hoping to talk his was out of this, if not he would still be fired, just the same as if he refused to talk. He was just attempting to save his job and he truly had nothing to lose by trying to talk his way out of it. That was the only strategy he had available at that point that didn’t lead directly to him losing his job. It’s also been ruled that a person cannot simultaneously be questioned under Garrity and Miranda, it has to be one or the other so they needed to use the internal investigation as a way to justify his firing and prove he’d done things that provided that justification first. Then once he’s no longer an active police officer he could then be questioned a second time under a criminal investigation at which point you’d be correct, his best bet would be to refuse to answer questions and ask for a lawyer. It’s fairly complex to explain but once you understand what I’m trying to say here it should make a lot more sense. Same with some of these other interview videos you see of active police officers being questioned, they are answering the questions only because they know it’s there only option to avoid being fired on the spot.

lol Onion, you have clearly never had any kind of government job. Most people don't steal but people get lazier & lazier & lazier the longer they have a government job. You end up with 25 people employed when 4 or 5 people could get the job done. Every job has a few slackers, any government job has mostly slackers. It's frustrating when everyone is getting paid the same, or close to the same and you have 5 people carrying 20 or 25. My last job I was a forensic psych at a large city/county jail. I worked swing shift and we had 5 people total that covered swing. Some nights we had 2, some nights 3 (busy weekends) When you only have 2 or 3 people you can't slack off. When patients are stacking up you gotta get to them. Day shift had 20 to 22 people working on any given day and all of day shift only saw a few more patients than swing. The boss tracked it for a while, we (swing shift) were averaging over 30 patient contacts per shift with 2, sometimes 3 people. Day shift, with 20+ people were averaging just over 40. Having those exact numbers pissed everyone off. We had about a 1.5 hour overlap. We came in at 3:00 and day left at 4:30. One of my coworkers got to work at 3, went out and saw 2 people, got back to the office in about 45 mins and asked if she could go home. The boss said "you just got here" she said "I have already done more work than anyone on day shift" That kind of thing is frustrating. Everyone on swing was busting our humps seeing 12 or 15 people a night while some on day shift were seeing 2 patients all day and getting paid almost the same money. We got 10% shift diff, not because we were more productive but simply because we worked nights. lol Sorry for the rant but sadly, that kind of thing is typical. It sounds like this guy was stealing from the county. If that is the case he does need to pay his dues but the simple fact that he put in 34 years and wasn't doing much of anything isn't surprising.
