It all depends if you’re on railroad property. You can be made to leave if you are, but once off the property you are free to photograph. Also, any pictures you took on the property are yours and no one can demand you delete them without a court order. I once was taking pictures of Conrail from a public area. I struck up a conversation with another railfan doing the same with his grandson. The Conrail police came over and said we weren’t allowed to take pictures and demanded ID. I politely refused and explained we were in a public area off the property and we can take whatever pictures we want. He got snotty and said, “What are you, a lawyer?” I told him that actually I am with over 30 years experience and here’s my business card. He said he had to “call this in to his supervisor” and we were told not to leave. The other railfan with his grandson chimed in and said, “I know it’s tough being a rent-a-cop but if you call your supervisor, I will have a State Police troop car here in 10 minutes.” Then he took out his badge and ID-he was a retired NJ State Police captain. He said, “Son, do you want to be the one cuffed and taken for a ride?” The Conrail cop turned white, mumbled something, got in his car and left. The retired captain turned to me and said, “Two-bit moron.” We continued our train watching and picture taking. I have many relatives and friends in law enforcement and back the blue, but there are LEOs out there who are poorly educated in the law, sad to say.

@@Visionery1 I think the retired captain sized the Conrail cop up as a wise ass and decided to shut him down. You don’t get to be a state police captain without being able to read people in a flash. I’m sure he had many troopers under his command over the years and could pick the wise asses out right away. The Conrail cop was very abrasive and dismissive, as if to say you railfan are jerks, now get out of here, even though we were on a public street.

I was on that train with my wife. I felt like I did nothing but buy a ticket for a train ride. The same thing happen at the turn around. If NS continues this approach there won't have a steam program.

I know. Of all the train rides I have taken over the years, that is the only one where they didnt let us take pictures after the ride. We were in the front of the train and got to the engine just in time to look at it. I feel bad for the ppl in the rear of the train who never got a chance to get pictures of the steam engine. Ppl were asking the cops for a quick pose by the engine and they just told them to leave. It was never like that when we rode the 611 in the 80s and 90s. We rode it on 5 trips without any problems.

Every railroad I've ever visited never stopped me or anyone else from shooting still pictures or video. As a matter of fact, they encourage people photographing the trains as long as you are at a safe distance and not interfering with the operation of the train.

I personally have a great relationship with the BNSF security folks, I ran into one while they were repairing a section of rail and asked about the discarded spikes. They are "technically BNSF property, but no one's gonna complain if you swipe a handful left along the rails by the crews, just don't pull them out of the ties of course" was the response I got. I delivered that security member a knife made from a spike a few months later that he loves. I also made a neighbor a cross for her yard with his husband's name on it, he died 5 years ago but was a long time BNSF employee.

I just remembered a train ride that I took where they said nobody could take pics at a certain location or they would stop the train and take the persons camera. It was a train ride from Rock Island across the Mississippi River into Davenport Iowa. They would not allow photos of the Rock Island Arsenal. That is the only time I can remember something like that in all of my train rides. We kept our cameras down while passing that site.

There are certain places and the signs let you know when you cannot take any kind of photos, videos, etc. It is the same way in other places but I think the Patriot Act or something has broadened the limitations making more places a "matter of national security." I believe things are out of hand on both sides of the issue.

As a former RR Policeman in the context of enforcing trespassing he is right, unless the public was invited onto the property to view the train. Most people do not understand that RR is private property, the same as your backyard, except at grade crossings. If the public was invited, then he is in the wrong.

In my younger days hopping freights in Canada, I was chased by CN Cops after I jumped off a freight car riding for 16 hours. Last thing I saw lookin back was the cop unholstering his sidearm. This is uncanny . My cousin and his wife recently moved from Seattle to the UK . Jan was telling me tales of how she and friends would often hop on a freight to go places . The station master would tell them which train was going where. She never made me tion of any unpleasant times. I guess she was lucky ! Good job she never stopped here !

There are some very dishonest cops out there. While most of them are okay, there are some like Trevor Rohe and Gary Helton of the Kenton County Police Department in Kentucky. Those are the most immoral, ignorant, unprofessional, dishonest cowards that I have ever met! They arrested me for having a radio in my car that I was licensed to have and I had to go to court at my expense to prove my innocence. These 2 cowards were not even man enough to apologize to me when they found out from the judge that I had done nothing illegal. I filed written complaints on them, complained about them to their merit board and I went on cable tv to tell the community about them. I learned the hard way that just because they are police officers, that does not mean that they are educated and moral.

At least 611’s allowed to run on the Strasburg RR & NCTM, which she does use NS to travel too. I hope when 765 gets put down for a rebuild, probably in the next couple years judging by her last one (2006), that Cuyahoga Valley Railroad invites 611 to sub in for Steam in the Valley, and give her more than 4 1/2 miles or some museum grounds to stretch her wheels.

I don’t think it was about filming. I think they were on railroad property without permission. In the current atmosphere of not being able to watch a movie on tv without some group of lawyers trying to get you to sue someone. The railroad is liable if some is injured on their property. Also being in company property without safety training is a major OSHA violation. It’s not about first amendment rights it’s about liability.

There was a train fan taking pictures of a train from city property in Sulphur, La. 5 sheriff deputies made him leave public property or be arrested for criminal tresspass. He left. Next day he talked to the city mayor and police and they it was ok to film while on city property.

If you are on public property (a street, or park, for example), OR your own, or a friend, or neighbors property, they can't "legally" say boo. If you are on railroad property, the RR can request that you be moved off. However, if the officer made this decision on his own, he clearly overstepped his lawful authority.

They were being asked to move away from the tracks and or vacate the area. That’s a matter of property law and liabilities. If the owner of the rail yard/right of way wants the people to move on, so be it.

In a situation like this where the police are behaving illegally, the most effective response is to sit down in ‘non-violent protest’ and invite arrest. If charged, the case will collapse in court. You may get compensation but that is besides the point. The police require retraining, particularly the commanding officer. I too am not anti police having worked with a police force to help with custody training.

It could've been the rr that called the cops for all of the people in the yard. From my experience of railfanning both in Lexington and Danville your more than likely to get kick out in Lexington than Danville. Me and my grandfather went to RJ Corman rail yard to see the trains and get some pics however a RJ Corman official kick us out . In Danville we decided while we are here let's check out the yard . We are parked about 12-15 foot of track and a guy in a utv came around to a truck , wich was fuleing a loco and went right by us . when he came back he stopped and talked with us for a while and he said say as long as you want just stay out of the way of the fule truck . we had a great day the got a few horn shows and saw a ns heritage unit .

This is nothing compared to what Kenton County Police Department in Kentucky did to me. The morons arrested me for having a scanner that I listen to trains with. I never even broke a law and the dumb fucks towed my car, questioned me for hours and charged me with having a scanner in my car. I went to court and in five minutes the judge threw the case out because I didn't break any laws. I was out two grand and never got an apology. The assholes were Gary Helton and Trevor Rohe. We need to do a first Amendment audit on them.

I thought I had that in the description. I will check but yes, we had just got off the train. We rode the train from Lexington to Tennessee and back. All these people in the video had just got off the train and were trying to take pictures of it but the police showed up and chased us all off before we had time to do anything. I have been on tons of excursions and this is the only time I have seen that happen. Usually they let you take pics and pose by the train after you ride it.

These are NS police, requesting folks to depart from an active railroad operating. No where did you state how much time you had once you exited the train. It appears several minutes. The railroad has a responsibility to keep people off of their PRIVATE equipment and property, the same as you would if you had an attraction, such as a large pool. Liability. I have been to Lexington and spoken with NS police. Very professional, and courteous. Once the train started moving, you were being directed off the property. But by your comments, if you were on a roller coaster, once the ride was done, you should be able to stand around in an unsafe area. Yep, makes sense. By the way, it is just your word that you were told to stop filming. With the camera pointed towards the police, those words were never uttered. Neither was the word arrested. Go figure.

You are 100% right. It was RR property. They have every right to, as the teaser said, “run you off.” it looks like they didn’t close the area that until the train was ready to move. That would’ve been a safe time to move people off anyway. Didn’t see anyone being told not to take pics.

The cops were probably contacted by NS and asked to clear the property of people. Agree with what you stated, but it doesn't apply in this case.

That's a true story, a cop shot a woman's chihuahua because he feared for his life of a 4 lb dog the size of a loaf of bread. Cops are just bullies with guns, and a lot of guys now that got bullied as kids, they join the police force and get their legal license to kill people to justify their troubled past. Killing 2 or 3 people a week makes up for their daddy not loving them. They are just psychopaths.

I think you folks are correct. Looking at the vehicles and their dress, they were most likely NS Police. In the end, its definately a bummer for those who didn't get pictures of the steam locomotive. It could definately be a once in a lifetime for some people.

@Trevor Bryant NS did not 'bring out' the 630. NS granted the TVRR permission to use their tracks to run a special train. The event was over and the train was departing. The passengers were asked to leave the railyard which is private property. Non issue.

I'm sure what was happening was the police had been asked by the rail company to assure nobody "rushes" the train as it leaves for closer photos. Being a rail fan I've seen two people get smashed because they were walking near or around a moving train while looking thru the viewfinder or their phone. And there are kids and unaware adults who tend to rush towards the train and get blasted by steam. And then, of course, they want to sue every entity attached to the train co and railroad. It's most likely an insurance thing.

I think the keyword here is "trespassing" which stuck out like a sore thumb for me. You weren't stopped from photographing the locomotive. You were stopped because you and the others were trespassing. The first amendment has nothing to do with it. :) I would have been out there taking shots with you all. :)

You don't have to be asked to leave for it to be trespassing. Railroad right-of-ways are private property. In the text of the post, it says "Police force railfans to leave or get arrested for trespassing!" Being on private property without permission is trespassing.

Did the rail road ask you to leave? The police have no authority on public land to tell you to stop photographing and no authority on private property at all unless the RR asked you to leave and you refused. Its a first amedment protected activity.

The railroad never asked us to leave. As soon as we got off the train, everyone wanted to pose next to the steam engine for pictures and then the cops just showed up. I don't know if anyone told the cops to make us leave or what happened. I never saw this happen before in all the years that I have been on train rides.

Its not just because they wanted to barrier you just because. It was because the sun was on the opposite side of the engine and people were going into the yard. So they made barrier to make sure people wouldn't go to the opposite side of the engine.

This was a shame. I'd have asked for a refund on my ticket. I wouldn't have been able to move fast enough for them.

When I was in San Francisco rail fanning and no police came and said “Hey move from Private property, when I am on a parking lot that has no sign that said “private property” other then the railroad tracks, but police come to harass people for taking a picture of the train the they rode, I am sorry, but Jaw tooth can do that, he can’t do that if he was in front of the train but like 10 feet from it on the side??? Police the Police they are in the wrong. In other parts of the US other rail companies encourage the public take photo's etc. This is how they fund the restoration project through education and public awareness projects.

KZbin throws this at me a week after Mr J Tooth overheard (via radio) a NS crews giving him the stink eye as he was recording their siding gymnastics. This tells me that 1) Mr Tooth has some history of this outfit rejecting him, and 2) NS has a very long memory for folks who get on their bad side. Funny thing is I had a different title for this video that only said railfans were not allowed to take pictures of the train that they just rode and it didn't get many views. I did an experiment where I added first ammendment to the title and the views took off. Lol

That wasn't Lexington-Fayette County Division of Police. It was NS Police. LPD will not answer an emergency call from NS unless it involves a grade crossing incident. Even then, Kentucky State Police has jurisdiction over railway issues. Locals are only used to secure the scene until KSP arrives.
