I honestly feel like Judgement Day should win war games to get away from the repetitive "tension between them" storyline and give an more interesting angle on the good guys. Even though most likely JD is losing to create more friction between, maybe they'll kick out Priest in replace for Drew? Even though I see Drew more as a singles heel I wouldn't mind him in JD, especially if they kick Priest they'll need a new big tough guy in the group.

Per Wikipedia it can be cashed in at any time, any place. In fact there have been MitB cash-ins announced ahead of time when there was no match at all. So no, it doesn't have to be during a title match.

There's only been one situation where there's been cash-in during an active match and that made the match a Triple Threat because it was for the title in question.
