Sana po masagot, yung sec. 5 ng rule 112 po ba na nababasa ko about resolution of investigating judge and its review ay rulling pa din po ba yun or naamend na po ba sya dahil hindi naman judge ay nagcoconduct ng prelim. Invest. Kase po naka indicate parin ang judge sa sec 2 rule 112 accdg. Dito sa nababasa ko po. Kung may pagbabago ko pwede po pakituro or pakibigay na lang ang amendatory law po non salamat po.

Good day! Thanks for this valuable comment. Sec. 5 Rule 112 pertains to the conduct of Preliminary Examination for the purpose of determining whether or not there is probable cause for the issuance of a warrant of arrest. Preliminary examination is conducted by the judge after Preliminary investigation. Hence, it provides "resolution of the investigating judge and its review".

Bakit po ang judge a hindi nag conduct ng PI po? Sana po masagot

Hello good day. Nasa rules po na PI is conducted by the prosecutor because it is not a judicial function. It is merely an inquiry to determine probable cause.

Hello atty! katapos lang po counter affidavit mga magulang ko laban sa kaso naming child abuse at vawc.. mababasura po ba ang kaso namin dahil hindi pa kami nagsumbit ng evidence upon filing? or may P.I pa po? para makapagpasa po kami evidence..thank you Godbless!

Yung subpoena po na pinadala sa mga magulang mo ay bahagi ng Preliminary Investigation. . Depende padin po sa existence ng facts and elements po ng crime. Hindi ibig sabihin na hindi kayo nakasubmit ng evidence ay wala na kayong laban. Dpende padin po ito sa ebidensya ng complainant. . Pwede kang magfile ng Motion for Reconsideration kung sakaling adverse sa inyo ang resolution ng fiscal. Thank you.
