Yes lucinda definitely helped me during my lawsuit. It was tough a year and 9 months. Did my summary judgment for defamation and other cause of action and won. Now im just stuck for damages. I got the liability out the way but still trying to get damages. For the record, I sued 3 individuals and did everything from filing, amending complaints, discovery and then summary.

Interrogatories are fine Admissions are fine and remember there may be limits on numbers but you can sometimes do second and third set of questions. Be aware that you cam always during the discovery process ask the court/ motion to extend time for discovery. In my case Defendants with held 1038 unmarked documents less than 24 hours before discovery closed. In hind site I should have asked the Judge to extend time again.

I tried to go pro se never filed. Gave up as of yesterday. Realized there wasnt enough resources out there to help me get through my situation. The reason i thought to go pro se was because no one would take my case. Most wouldn't even give me the time of day to even hear it. Just either automatically decline saying they are at capacity, never call back, say they don't handle my kind of case, or it was one of those firms that only took big buck cases. I wanted justice and accountability but the more i tried to research how to put my case together the farther away my goal became. The system is set up to make it difficult for some cases. Especially when it is against educational institutions.

Dont give up! If your matter occurred within 6 months I believe, you can file a complaint with EEOC in your state. Download the forms from their website. You don't need an attorney to file your Civil Rights "protected class" complaint. You can also file a complaint with the Department of Human Rights in your state within about 300 days since incident occurred. I hope this helps you. Good luck!😊

Start with a complaint to EEOC in your state. It doesn't cost to file a complaint. It must be based on federal protected rights, i.e. Civil Rights.😊

There are a lot of companies out here that are violating their employees and customers privacy rights. BIPA gives one the private right to sue for $1,000 to $5,000 per offense in some states. I’m at the discovery process in my slander case. The defendant’s lawyer hasn’t responded to discovery request or to interrogatories and now both are outstanding. I filed a motion to compel. Now I am waiting for request for admissions to be responded or neglected and then I will be filing sanctions and For summary judgment.

This is a good example dealing with a private company while being pro se. It's different dealing with a government agency as the employer in an employment Discrimination suit.

@@advocatelucinda Its generally harder to sue the government because our judicial system is based off the British, which holds the gov/monarch as the Sovereign or in other words untouchable. But it is still possible, the key differences are: the gov cannot be held liable for punitive damages, and the complainant must exhaust the 'administrative process' before taking the government agency to court. Keep in mind, the administrative process is completely controlled by the government and generally takes about 5-6 years to complete. The 'judges' during this time are all employees of the government and the executive branch i believe, so there is certainly a builth -in conflict of interest IMO. I am currently going through said process, most of which was done pro se...

To sue pro se for employment discrimination is impressive. I’ve successfully defended against traffic court cases and and. I’ve settled pro se against two cops for first amendment violations. It’s on my channel. And at the moment I’m suing a former co worker for averse slander pro se status. I’m also suing my former employer but I have an attorney handling the case.

I have a case in federal court for employment discrimination and failure to accommodate a disability i have overwhelming evidence and admissions from the opposing side the defendant did not file a timely motion twice according to local rule 7-3 the judge allowed both to be heard i served the defendant according to ccp 415.30 and provided a signed acknowledgment of proof of service by substitute service the judge still quashed my proof of service i heard the gentleman in the video talk about interlocutory appeal can you explain more on how to file such a motion?

How do I handle a defendant who is apart of the government disrespecting my character for having evidence on wrongful termination as well as discrimination acts by management. I was fired due to speaking up for not being heard during a harassment situation that the colleague ended up getting let go. After that i started seeing my managers look for any reason to treat me rudly and take my clients from me. I did a task they lied about me not doing which led to the termination. However i had ny colleague txt and tell management it was completed. After my termination the position i had been asking for months to transfer to it magically opened up and given to another person who was promoted to my position at a time i wanted and was told it wasnt available. Does this not fall under the discrimination act and whistleblower act?

You wont find it because he settled. Normally when there's a settlement, the case is withdrawn so that's why you aren't finding it. Just because the case was dismissed doesn't mean he didn't refile an amended complaint.

I won on due process violation, got a restraining order, and then permanent injunction, against my parole officer. They violated me on a marijuana urine. I resigned from my job and went to jail.

More than likely he studied federal and local rules of civil procedure. All you need to know about bringing a suit can be found there, depending on the district you live in, local rules may slightly vary but federal civil rules apply every where and tell you exactly how to bring the suit. Studying the rules of civil procedure is just scratching the surface but that's how you learn how to sue.

Good evening all I appreciate all the information I’m I New York and I’m in litigation in a foreclosure action in which I’m pro sa I have been in court since 2007 going back and forth my case was dismissed and then the plaintiffs came back with another action and different index numbers the judge gave the plaintiffs in there favor a summary judgment in which I had to appeal and the appeal reversed the order and decision please look at Wells Fargo vs William carrington Now it’s returning to lower court Where I put in a motion to dismiss and the plaintiff did a cross motion and summary judgement the court denied there summary judgement but also denied motion to dismiss the judge gave a reason why he dismissed the plaintiff summary judgment is that he wasn’t going over the appeal order and decision but the judge never gave me a reason why the court denied my motion to dismiss I asked for clarification on why he denied my motion to dismiss the court clearly came back to me stating that’s there no need for clarity take it to trial I have a question the federal rule of civil procedure can it apply

I was terminated from my last to job first job excuses was job abandonment which I was attempting to go out on short term disability bt was not approved due to not being on the job a full year which HR failed to accommodate as I had PTO, Vacation time etc also the employer never contacted me while out for 7 days pending approval for STD but instead was terminated. The EEOC gave the rights to sue which I’m currently in the Discovery stage in my case next depositions I would like to communicate with someone in regards to the process in my situation also I was hired at all women’s clinic and was very much discriminated against bc of my sex I was terminated for lack productivity which is impossible to do on the clock they stated I sat on camera on the clock for 4hrs doin nothing which later terminated me after the supposed situation I requested during the termination proof which they did not have bc they’re reasonings where false I was terminated bc my sex at an all women’s facility

@@smooveking773 That's a result of the prosecutorial immunity and also the prison litigation reform act PLRA. Makes it very difficult to get assistance - attorneys feel there's no money any many of the cases.

Some great inspiration to be aggressive, proactive, etc. when engaged with the other side. Him being so jolly, colorful, and entertaining probably worked in his favor to somewhat disarm and “entertain” the judge and opposing counsel… but I have questions. Was it really drawn out litigation… or just proceedings that led to a neat settlement? Speaking from personal experiences and observance of other attorneys over a period of (4) years, it’s weirdly refreshing to see this guy so entertaining post-litigation (assuming that’s what it really was). Do we have case numbers? What jurisdictions?

EEOC did not represent private contractors against non profit. They did no thing.

Although EEOC may elect not to sue on behalf of the complainant, the complainant can receive a right-to-sue letter from EEOC, to sue.

Question; I have a federal lawsuit pending. The defendant responded and also ask for a motion to discuss. Should I respond to the answer? Any information would be appreciated

It depends how the defendant responded. If the defendant answered the complaint, absent a counter-complaint, for example, there's nothing to respond to. If the defendant filed a motion to dismiss, for example, the non-moving party should respond to it. Read the federal rules of civil procedure and your jurisdiction civil rules.

@@advocatelucindaThanks for this valuable segment. I noticed the gentlemen said he was busy and there were 200 documents on his case. I have 75 on mine and am at the Summary Judgement phase. He also mentioned that he would request settlement conference. In your opinion; should I request another settlement conference while we wait for the judge to rule on summary judgment? We had a settlement conference back on April 25, 2024 and the court assigned a pro bono attorney, unfortunately, the defense did not negotiate in Good Faith and offered pennies.

You certainly have the right to request another settlement conference. Communicate this to your pro bono attorney.

@@advocatelucinda too late to communicate this as she was only there for settlement, she has since left the case, something also happened that I won’t share on this forum as to why the case did not settle. I have since sent an email to the defense attorney requesting discussions. He asked what I was looking for to resolve the matter at this point. I sent a detailed offer this past 7/5 and asked for a response from his client by next Friday.
