I'm trying to improve but my best days are past me, I'm not as quick witted as I use to be. Aaahhh its all good fun though gotta have a laugh

PukkieSWL Privacy Principle 3 1 check the 1st 3 words of that it will give you the answer, I'm not an "Agency" And if you read the case law in the this its not law its a principle. Further please correct me if I am wrong the Privacy act is for the government and agencies and businesses not for the individual, please point me to the place where its for an individual citizen. If you want to find the law on what I'm doing look at NZBORA Sect 14, and case law around that. I'll make it easy for you read hosking v runting that's the most influential case law on the matter, see how the courts weight "Freedom of Expression" that's all it is, my right to "record and and impart information in New Zealand in any format I choose" Have a nice day
@James-nq4kf2 жыл бұрын
While the Privacy Act 2020 appears to include an individual (Section 8 defines agency as): "In this Act, New Zealand agency- (a) means- (i) an individual who is ordinarily resident in New Zealand; or......" You still need to be aware that when an individual collects personal information for their own personal use (as is the case here) then their actions are exempt from the IPPs in Section 22, by Section 27: "27 Restricted application of IPPs to personal information collected or held for personal or domestic affairs (1) IPPs 1 to 3 and 4(b) do not apply to an agency if that agency- (a) is an individual; and (b) is collecting personal information solely for the purposes of, or in connection with, the individual’s personal or domestic affairs. Section 27(b) further restricts the application of Principles 5-12 where information is 'held' by an individual under the same circumstances. Therefore, there is no application of the Privacy Principles to this type of collection, storage, use or disclosure and any complaints to OPC will be shut down fairly quickly. The individual is entitled to exercise their right to seek, recieve and impart information in accordance with NZBoRA. The Privacy Act certainly does not override this.

The Community Law Manual is written by Community Law Centres and updated annually. It is a comprehensive but accessible legal guide and explains all your legal rights in a simple, clear manner. It has a great section on activism and public life. It's about $170 for hard copy but it is all available to read online free. Unfortunately, the law is complex and difficult to understand. The right to film in public is broadly protected by Bill of Rights Act Section 14. When people say it is against their Privacy, thats when you need to refer to the Privacy Act and, by process of elimination, determine that it doesn't cover members of the public in their personal capacity.

There are usually laws pertaining to public records. When one is denied access to getting those records that is a violation.
