Prof Stanley L Paulson Two Species of Law in Hans Kelsen’s Legal Theory

W poniedziałek 7 maja 2018 r. odbył się zorganizowany przez Katedrę Teorii i Filozofii Prawa WPiA UAM wykład prof. Stanleya L. Paulsona z Washington University w St. Louis i z Uniwersytetu Chrystiana Albrechta w Kilonii, pt: „Two Species of Law in Hans Kelsen’s Legal Theory. Why Kelsen Has - by Design - No Theory of Legal Interpretation”. Obok przedstawienia dwóch rodzajów prawa w koncepcji Hansa Kelsen, prof. Paulson skupił się na podobieństwach pomiędzy poglądami Hansa Kelsena i Hermanna Kantorowicza oraz na znaczeniu upoważnienia dla drugiego z wyróżnionych rodzajów prawa: prawa jako aktu woli.

I believe natural law is a product of mature mind/s, and perhaps a bargain between those who prescribe a law and those who (not necessarily police) enforce the law. Legal positivism is the subsequent publication of natural law for the consumption of and adherence to by minds, immature and/or occupied by labour other than that of law prescription. For example: I suggest (prescribe) to not drive a vehicle that has potentially faulty airbags to the dealership in order to get it fixed, because by doing so you put several lives at risk. Instead either get the vehicle towed to the dealership or get it rectified by a mobile mechanic at your residence. It is now up to the enforcing power to either accept & publish or reject the above mentioned prescription. Should it get published, it is then for rest of the community (Learner drivers, Retards, etc) to receive it as legal positivism.
