South Dakota rancher John Harter tried to stop TransCanada from securing the right of eminent domain over his land where they want to put part of the proposed Keystone XL pipeline, but Harter recently lost his battle in court.

Now that the Keystone XL pipeline project isn't going ahead, I hope these land owners are able to get TransCanada's easements on their properties revoked. Unfortunately, I know that can be a real struggle as the law in many states doesn't provide any specific mechanism for property owners to revoke disused pipeline easements other than through an expensive and drawn out court battle against a big corporation. Instead the corporations owning these easements can reuse them for some other project or even sell them to another company without the land owners having any say in the matter. That's not right.

An individual should always have more right to their own land than the state, who in turn should not have the power to give private entities such power.

I'm a South Dakotan born and raised. While I am definitely against pipelines of any kind, I have to sit back and wonder if that is how the Native Americans felt back in the day. Well, probably not. You DO get to keep most of the land. I have no sympathy for either side on this one. Eminent domain is still alive and well.

They should all have to use eminent domain it's your first and last right use it not doing so is why thats all you have left. It should be your right as a last resort. Amarica has made it all these years without them but needed people like you. Why should Amarica need them now (and Amarica doesn't ever need them if it is to stay free) If you don't stay free how can Amarica? If it is there right then it is American's right and American's can use it to regain the freedom that has been taken along with so many other freedom's.

I know how you feel and have faced the same thing. However, I would trade the pipeline for the Interstate Right of Way I faced.

I'll just bet you find more than just a few farmers that object !! I don't blame them either. I'd likely be one of them if I was a farmer.
