Politicians serve lobbyists, not voters. This legislation will ultimately drive private landlords to sell their properties to corporations who'll abuse the rules and use their vast recourses to bankrupt any tenants who try to take them to court.

As usual, the real world doesn’t work the way politicians think it does. I’ve had estate agents recommend I take the tenants without kids rather than the tenants with kids as there will be less wear and tear on the house and on appliances like boilers and washing machines. However, I would never advertise the property as “no kids.” I believe it is fair for me to look at the tenant profile and decide who I want to rent to, including a preference for those without pets.

My tenants haven't had a rent increase in the five years they've been there. Any problems are solved within three days. Pets: no problem, if well behaved. They gave notice, with regret, and have just left to go back to Poland. I don't blame them. We parted company with chocolates and wine given and received by both parties. Why should we adjust our way of living to accomodate the bad'ens?

This is a good point. Let’s say 5% of tenants / landlords are bad then why make all these dumb laws to address the 5% rather than make laws to address the 95%.

Same here. Have not increased tihe rent for four years, I have a good tenant, coming from Serbia originally, I don’t even go to check the property without a little gift.

Agreed Nora, I act immediately and have always had lovely tenants, all students, but great relationship between all of us! I also have a good agent!! I have wondered about the pet situation though because you only need one who is super allergic to animals (as is my daughter) and then you could potentially have a huge problem on your hands! Obviously that tenant could leave but what says the next house they stay in has a cat climbing on the worktops!!!! It's a ridiculous rule and not thought out at all!!!!

Thanks for this summary. Based on this, I don't have a problem with what this might mean for landlords. I look after my properties and the tenants and always meet with prospective tenants beforehand to see if we can all get on. Increasing rents is fine - but I think being fair to good tenants is very important.

I think many landlords will sell up and invest abroad , including lots of other entrepreneurs leaving the country . Council already can’t find landlords and are offering 6k incentives to landlords to keep tenants yet many landlords are still not interested due to the agro and stress and unfair legislation that’s in place against landlords Every other day I hear of good investors starting to leave the uk to invest abroad instead. I thought I would never consider it but am serious about selling up now . Just too much stress . The harassment against landlords from the government is a never ending story .

My last tenant cost me £25k in damages. What support did l get? Ziltch. Baby Reindeer has nothing on this bitch, next level insane. And clever, used the system to the max, she even took one of the world's biggest banks to court, by herself! And won! Against all their lawyers! Unfortunately. She met her nemesis in me. Years after she moved out. I got her.

Nothing about recovering rent arrears!!!! This is a load of horse Manure it will increase rents as well. Rearranging the deck chairs on the titanic. What's wrong with the way it is now. All my properties have to have licences and minimum standards. Tinkering around the edges appeasing the socalists. A load off old tosh. Labour will drive through S'21 as soon as keir is through the door at no 10. Sorry I disagree with you. I think it's unfair on landlords. This weekends shopping, I'm not paying Tescos I not paying. Infact I'm not paying for my utilitys either infact I'm not paying for anything anymore. It's a ridiculous and to think you think it's a good idea. Disappointed your part of the problem the uk is going down the tubes fast...... ye all sit there in silence and let it happen. Rent arrears should be treated the same as it is in commercial property contract, 1 month unpaid rent locks changed out good bye. Why should we have to pay to house people that don't want to pay rent The system is broken and your enabling it. Disappointed!!!!!

If tenants can claim 24 months of rent back in compensation, this would be a big concern to any mortgage company as well as the landlord! And this also begs the question, that if the government puts in measures to substantially deplete a landlords’ finances, how are they expecting landlords to pay for repairs? Surely the emphasis should be on enforcement of repairs?

That's already happening. Landlords don't need an excuse to put rents up. There are so few properties that they can chase good earners who will pay anything asked. That may just be my area of course.

It's great news for build to rent New York style large block landlords who will be big corporations, but bad news for tenants who will be their cash cows and small time landlords who will be pushed out. We will then own nothing and the interfering overlords will be happy.

Mold can grow if you keep widows and door closed simply because of your breathing. The air needs to circulate to avode that! I am not paying £30.000 because tenants are silly enough not to air the house!

No mould happens when you have damp and poor insulation and is a health hazard. You cannot blame tenants for mould with the exception of bathroom sealant thats on you.

Ban tumble driers in the house make it a rule, they are a fire hazard but they will fill the house with mold.

@@whatanabsolutejokenonsense. Hanging wet washing in the property to dry, boiling kettles and pans all cause condensation, that creates the conditions for mould to grow. As soon as any mould is seen it just needs cleaning off.

Mould grows but you should get it treated as a Landlord after all it your property. Additionally, it's laziness as a landlord to want to increase rent but do nothing in treatment or the mould, be a better landlord and be a responsible adult. More importantly, opening the window is only half of the solution, grow up and fix your property, fix and extractor at a minimum, it cost no more than £30. It's Landlords like you that gives other a bad name.

@@scienceevolves4417 better to lose a few quid on heating out the windows than breathe in mould spores. Basically mould is mostly an education issue. You can clear most humidity by opening all windows for just a few minutes, the air changes but the home retains the heat which is stored in the walls and fabric of the home rather than the air.

I live in Bristol and my mate has bought a house and has just finished doing it up for rental. It’s a 3:bed semi and he hoping to get £1700 a month. Not a desirable part of the city. How on earth do people afford that type of money just to put a roof over their heads?

Most renters dont have a clue, how to live in a house. They cant get their heads around, opening windows, whilst the heating is on. Drying clothes on radiators. Where do they think the water goes?

There has always been rolling tenancy after the original lease expires i.e. based on the tenant giving 1 month's notice and the landlord giving 2 month's notice.

Yes but could give a section 21 if things don't pan out well, now it will be Section 8 with all the dodgy tenants making up stuff against Landlords seeing it as a money maker or an excuse to stay! Also the courts can't cope now, so can you imagine how it will be after!!

First the S21 legislation hasn't been passed. Second doesn't this mean someone on a 12 month has to extend to a min of 18 month instead of having protection of going on a rolling month by month ..which would tie tenants in longer ?

With new legislation, Landlords cannot give notice, only tenants can give notice. So Landlords cannot remove tenants unless they are selling property or moving in themselves etc.

Hi James. Thank you for a very helpful vid. It seems to me that most landlords will ‘price in’ all the factors in this new bill and that can only mean rents and deposits will increase accordingly, based on increased risk from damage to walls, carpets/flooring etc. which is not going to help tenants. The ‘Pets’ angle is something that’s not discussed by politicians in any detail, especially for flats vs houses. A dog or cat in a 1st or 2nd floor flat cannot be a good idea for the health of the pet - I never see any comment from the RSPCA about this although some people keep Labrador/Alsatian size dogs in upper floor flats - I’ve seen them (dogs) looking out from balconies. Also, how would a landlord react to a pet request and then finds out it’s for a Serpentarium? I know there are people who like snakes and spiders and feed them with live ……….. let’s not go there. Adjacent neighbours might be very nervous and complaining of a tankful of snakes living next door. The Government is being very simplistic about ‘Pets’.

Absolutely correct and will be another excuse for insurers to make some extra money by adding a big additional premium for having a pet, landlords won’t care as they won’t have to pay for it and tenants will pay as they love their animals. The whole bill seems to more in favour of landlords than tenants

If you’re responsibly running a business, you need to account for all costs. The only option is to increase rents to accommodate the increased possible costs. Or bail and sell. If that happens, less supply means further higher rents.

Less supply of rentals, but more supply of buying houses, and most likely at reduced prices if a lot of landlords want to get out of the rental game at the same time. More people owning their own homes it a good thing in the long run.

Is there a website or place to report bad tenants and to look up if your own prospective tenant has a bad rental history? I am aware that landlords do have the ability to send a collection agency after a tenant to chase down late rental payments as well as any other eviction or damage-related debt that a tenant might owe you. If a tenant won’t pay up, the collection agency can report this to the three major credit bureaus affecting their credit standing.

Most mould problems in homes are caused by human activity not penetrating damp. Some people are idiots and then act entitled after they caused the problem

Keep at least one window either side of the property open on the first catch all day. Showers and taking baths creates a lot dampness so open the window and the bathroom door until it dries off you can tell by the bathroom mirror will start to clear. Try and keep some of the internal doors partially open.

:( I have a very good landlord. All this interference and meddling by the government will result in my landlord signing over his properties to estate agents or selling up. If it goes to the estate agents my rent will literally double and i will no longer be able to afford accomodation.

You say so but doesn't it also limit landlord liability in law when judges could award more ? An Ombudsman makes it more tempting to apply though

I had one tenant that would have abused that and been reporting stuff daily. I paid that guy £500 to leave and new tenant have been great.

Rolling tenancy is usually written into the contract anyway, with all the same terms and conditions! DSS tennants are notorious for not paying rent and keeping it for themselves. Best avoided unless they have fantastic references.

Pets, Dss: Nothing stopping landlords to choose a tenant without a pet over a tenant with a pet or DSS when tenant demand is high. They do not need to provide a reason for their selection

You will know their on the dole when you look at their bank statements before letting the property. At this point their application can be rejected.

The is exactly my issue. The law hasn’t changed or given more rights to tenants. Landlords can still pick & choose. Landlords moaning they’re being shafted yet you can still silently refuse people with pets etc and give no feedback. So who do think is really getting played? Asset rich vs poor tenants.

There should be no blanket ban and no insurance obligation cause they're both just idiotic regulations.

Do some research what happened in New York and Ireland when this happened. What that does it push out more landlords, so you might get a bit cheaper rent but you will have 50 people trying to get 1 property. Also before the cap comes in rents surge.

My BTL mortgage lender has restrictions on who I can rent to and also the leasehold agreement on the flat has a covenant for not allowing pets at the property.

@@scienceevolves4417 I doubt if the rental reforms will outlaw existing leasehold agreement or the mortgage conditions, both of which the landlord has already signed. only way out of these would be to sell.

@@rhoochauhan9839 To be more precise, some parts of the new legislation are going to outlaw some bits of the lease agreements already in place (but not all), only the ones that will be inconsistent with the changes that are brought forward in the bill. I can tell you for a fact Acts of Parliament trump any other inconsistent contractual agreements, subjects only to savings, transitory and transitional provisions. Perhaps this specific issue you've mentioned will be scrutinized in more detail in the House of Lords during the passage of this bill though. This would, it seems to me, be helpful and provide greater clarity.

@@rhoochauhan9839 hi thank You for your question - generally speaking, it's not really something we should be worried IMHO. Believe you me, there's a general rule that an Act of Parliament trumps and has the power to override any existing conflicting contractual provisions anyway (subject only, perhaps, to any savings and transitional provisions that ought to be included in the Act). The statute doesn't have to override tenancy agreement as a whole, it could just override certain parts of it. This doesn't mean that up-to-date leases would have to be drafted in each caseas soon as an Act becomes new law. I suspect compliance with the new requirements in order to issue a new lease would only kick in when it comes to *new tenancies* (agreed after the bill comes into force), and for *existing (rolling) tenancies* it would only kick in once there was a change of circumstances (such as a renewal of the lease, a replacement of a lease or a switch from fixed term to periodic tenancy). Obviously the main thing is that ASTs will no longer apply to new/renewed/replaced tenancies; all those will become ATs. So it appears to me that if this bill passes and becomes new law, it will render some or all of the things that you're concerned about ineffective in law. You do of course raise very valid points and I would certainly hope that when this bill is scrutinized in the House of Lords over the next few weeks/months, it would be helpful if the specific issues you're relating to would be clarified.🤞🙏

The reason landlords are getting out is because they are on all interest only mortgage and rates have gone up, they can’t keep putting up rents by huge amounts indefinitely so are getting out, the model in a lot of areas doesn’t work anymore. Has nothing to do with these regulations

My initial reaction is that good landlords that using a letting agent to manage their property won’t have too much to be concerned about. It all may cost a bit more but then rent will go up accordingly. May take a bit of time for that equilibrium though.

I rented for many years. All my landlords were very good and I think I was a very good tenant. The downside to renting is that there is no security in that the landlord could give me a month’s notice to quit after the first 6 months. I was lucky as all my move-ons were due to selling the properties. The other issue is, of course, the very high rents. Where I am a two bed mid terrace with small garden will cost you £1100-1400pm. A one bed flat (not student) will cost c£800-900pm.

To much as wages stagnated, property rents are more than 50% minimum wage, can't waith to see abolish the rents prices at minimum wage market insted of profiting, and yeah owners of more than 2 empty houses should pay 60% taxes for having them empty for no reason at all... You see, build a hotel and rent rooms instead of buying properties... Still do not agree with someone who owns mote than 2 proeperties and makes money out of them when they haven't developed or architect developed property development. Owning more than two properties should be taxed more as it shows lack of investment ideeas that puses to a parasitic ownership

I think landlords are providing a most useful service and deserve encouragement and a lot more help with rising repair costs and government imposed modifications. Many have little choice but to increase rents just to cover costs. Many also are out of pocket when some tenants who do not care and go unpunishable leave atrocious damage and mess behind.

Portal please!! Soundproof standards should be added to the portal, so tenants can decide based in EPC and soundproof the suitability of the property. Most flats have little or no soundproof, you can hear steps every hour or people plugging their phone, paying extortionate rent but neighbours that are “roommates”!

I'm a good landlord. I've recently spent thousands on repairs and the house has a C energy rating. If you don't tax me too much, I'll keep the rent low. These property developers who rent delapidated houses that they'll never sell are fools and bringing huge problems down on all the rest of us that are good landlords. Raising capitol gains tax for landlords? We already pay income tax on rental profits! Lower rents equals less income tax for the treasury. I was crap at economics, but some things only require a little common sense.

The only issue I have is being forced onto 6 month rental because my agent charges me per introduction of around £800 which at present covers at least one year. If tenants only stay 6 months it will now cost £1,600 year and serve charges and ground rent is around £2,000 year so you are into £3,600 before one takes into account appliance insurance, tenant insurance, maintenance, voids and MORTGAGE At present I am lucky as I have a 5 year fixed rate at 2.1% so my mortgage is £3,000 year making at total cost of at least £5,000 The rent is £13,800 so at present I am fine, BUT and it is a big BUT, if in 2026 interest rates 3 times what I pay at present it adds another £5,000 my costs are £10,000 AND as you all know if you are not a limited Company and are only allowed to claim 25% of an interest only mortgage this will result in rents increasing or more likely me selling both my flats and we won’t even go to the issue of paying tax on money I do not earn due to a legitimate expense only being allowed at 25% of real cost👿👿👿

So don’t put carpet downstairs or in the whole property. It’s more hardwearing & hygienic anyway. Meet the dog & tenant in person. We have hardwood floors throughout our whole rental now with our dog. Our dogs paws get cleaned everytime he comes in from the garden or a walk. We are no shoes in the house household. We clean floors multiple times per week. Most scruffy humans don’t even take their shoes off. Are you going to ban humans? Might have been nice if landlord & previous tenants had maintained our grass & we didn’t have to re-seed the mud fest that was to grass again at our cost. Maybe the dog would have less muddy feet? 🤣 If you hate anyone actually “living” in your property then don’t be a landlord. The amount of landlords thinking of this as an investment only and not a service is pathetic. This is what gets you a bad name.

Bankrupt Birmingham Council has introduced selective licencing for some areas. £700 per rented property. But council housing isn't the best.

I have had properties with no mould problems at all only to have a new tenant move in and have a succession of mould problems until they move onto another property elsewhere. Mould is often down to lifestyle, but somehow I don't think the courts will see it that way even with a survey.

As I read this proposal, the landlord can refuse a pet on the property. However, once a permission is given (if at all), the landlord can't take it back which is perfectly reasonable IMO.

We had a six month tenancy 9 years ago. It has been rolling anyway. So what's different? What protections are in place to prevent landlords suddenly putting the rent up from £500 a month to £2000 a month to get you out by saying you didn't pay the £2000 rent? What protection is there to prevent landlords saying they want to move into the property, with no intention to do so, so they can stiff the next tenant for way more money? Don't kid yourself that tenants are getting any protections. And at present, tenants have to give one months notice, so they are going to be stiffed for TWO months, as well as the costs of cleaning their property. We will STILL have to pay the Landlord's council tax on THEIR property. Not much has really changed for tenants has it. to be fair? Oh good. So students get stiffed even more. I'm sure every student in the UK will fall over to vote Tory. And as a tenant myself, hell will freeze over before I vote Tory. I'm sure all the rich landlords will adore the Tories though.

Because landlords can still get rid of good tenants on the flimsist of excuses. All this does is benefit landlords. Tenants STILL don't have any real protections, tenants STILL don't have a right to have a pet, so to be honest, from a tenant's perspecive, nothing has changed.

Bad news for landlords is also bad new for renters , everyone always over looks that fact. Less rental properties as landlords have fled the industry means higher rent for ones that are left and if you happen to be a leas desirable renter like one that has the cheek to have inappropriate pets or numerous kids, or be on benefite you are doomed . It is a fine balance between landlords and renters rights is the legislation managing it, polls of landlords suggest not . If you have a good tennent youll eant to keep them for years , if you have a bad one youll want to get rid pronto before they bankrupt you

@@Baldneszabsolutely nonsense. People that say things like that regurgitate what they hear without doing the maths. There are many dehumidifiers that are only a few hundred watts per hour. I instantly see a dehumidifier on Argos that uses 340 watts. My electricity tariff is 28p per kilowatt. If the tenant uses the dehumidifier for 3 hours per day when cooking and showering, or drying clothes this works out as £8.57 per month on a 30 day month. Excuse’s excuse.

Nothing really changes about pets. Landlords give ridiculous excuses like the property is small. Ok, they say no again and you can't do anything. Unbelievable how unfriendly this country is to pets and they claim in articles that British are known animal lovers 😂because they buy expensive accessories for their pets. I don't speak about the majority buys animals like they are products to show off. However, what can someone wait in a country like Britain?. Will they care about pets? And of course, the insurance companies want to make profit from that. You have the deposit, if a human destroys something or a pet. These are excuses. Profit and exploitation always.

My houses and flats start off with new kitchens, bathrooms, decorating and floor coverings. After 6 months I am often shocked to find broken basins, baths and kitchen cupboards and burns on carpets from irons. Tenants blame the house and demand their damage is put right. I can see problems arising when tenants play the system and landlords get shafted. My mortgages and insurances state, professional shorthold tenants only and no pets. Leases also say no animals allowed in the blocks. I can see big dogs just appearing in flats and neighbours creating merry hell. Can't see why landlords will want to continue being landlords. Me included. Local authorities are going to struggle to home all these tenants that have been given notice..

I am not sure who you are renting to here! I have managed to never do this with years of renting. Screen potential tenants properly. And take inventory and deposit simple. Also most places aren’t brand spanking new except for new build rental developments. Wear & tear has be taken into consideration though. People have to live the places and that means your job as a landlord is maintain it to a fair extent. As much as it is tenants job to return property to the same standard it was prior to moving in. The pets thing is an issue. No wonder people lie and just bring in pets anyway. We have really struggled to find any new places that will accept pets. We have a small (7kg) middle aged dog who is literally no bother at all, never damaged anything. Yet we are refused due to blanket bans. So we are staying put as our current landlord isn’t so shortsighted & allows them. You need to assess people and pets fairly. There are far more people & kids who trash properties than pets and in that case you should have deposit to cover it. Are you going to ban kids next? Landlords are also missing a trick not allowing pets as there is a huge amount of people with pets struggling to find housing who are more than likely either better tenants, have better income & you’re dismissing them from the get go limiting yourself to the same type of shitty tenants you seem have mentioned above.

You may well have a point there but if they don’t abolish section 21 you can use this the evict them or at least threaten to evict them. However in my experience if tenants miss a payment it is because they either made a mistake or hard times hit and a bit of leniency and time to catch up is only fair and creates good will.

@@nagoranerides3150I don’t call a nightmare having a bank credit card system to pay rent. If you default on your mortgage you get evicted pretty quickly unlike renters.

Good video - obviously not law yet. Interesting in the rolling tenancy - first time I heard this . Can the landlord ask the tenant prior to the AST finishing whether they are staying , if not it just goes to rolling but with a 4 month min term?

The last AST will still stand as normal so you and tenant can give notice as set out in that. If they renew it will go onto new rolling rules.

Dont most of these rights and obligations already exist and it is morea case of ineffective enforcement? Local councils have paid housing benefit direct to landlords that dont meet the fit and proper person test, fail to send out environmental health etc for decades, Tenants are able to take landlords to court or risk their standing by refusing to pay rent until repairs are done. Plus all the many other reasons others express here. Seems more style over substance and of course more cost.

We have a leasehold flat we rent out, but the superior landlord which is a housing association hasn’t maintained the or property or done the repairs we and our tenants have requested. Should we go to the property ombudsman?

The reason why people with pets stay longer in your property is because they know thar they will struggle to find other willing landlords. However, when landlords cannot easily refuse them, then a bigger market will open up to them, so they may stay no longer than other non-pet owning tenants.

It's in the tenants interst not to open windows. The new great excuse not to pay rent will be mold.. While bad landlords need to be punished. The good ones need to protect themselves with photos 📸 and get a experts report about the state of the property before letting it. Have regular inspections to keep on top. Invest in a good dehumidifier just incase. The good landlords with half decent tenants don't need to worry. If unlucky and get a bad one then be prepared. No law against asking for at least one years rental payments by bank to the last landlords bank account. If he got paid you got a good chance to be paid. The vast majority of tenants just want a decent home to live in. But their are quite a few crooked tenants out to cheat landlords. As well as slum landlords. It is what it is. I hope it weeds out the bad landlords. There should be a register on line for landlords to put bad none paying tenants on anti social behaviour etc so as bad landlords will be on one so should bad tenants. Level playing field. Best hope is to get a Conservative government. The labour party are going to fleece the landlords. Wait and watch sadly. Regards 24 month rent refund, my shower collapsed Christmas Day the glass shattered everywhere lucky I wasn’t in the bathroom. It took over 3 month to get it repaired along with the mold and extractor fan. Would I qualify ?. The Guinness Partnership are just terrible.

Thoughts are I agree with you. Worried Labour will do something silly for votes that still leaves the court system unfit. Aside from that no problem with most of it - the Decent Standard homes thing really needs to be clear on some issues tho - mould for example - rising damp and internal mould from a structural issue is clearly down to the landlord to sort - however mould caused by showering without venting, drying clothes on rads and otherwise not properly venting the property as requested by the LL shouldn't be the responsibilty of the LL - clearly if it is evident upon start of tennacy that is another issue. Can see higher rents and can see rents always rising due to only one rent increase and is that one increase going to be capped/linked to inflation?
