Prosecuting Estate Theft & Fraud

Litigated estate cases run hot. They are like hard-fought, name-calling political campaigns. Allegations and counter-allegations abound. Much that is said in the heat of the moment is later softened or withdrawn altogether.
This is not about the heat of the moment. It is not about estate differences, however cantankerous, between personal administrators, executors, trustees, heirs, beneficiaries or estate creditors. It is about out-and out-theft from an estate.
At Hackard Law we handle a good deal of estate litigation. I’m happy to report that estate embezzlement is rare, though it’s sad but true that it still exists. When estate theft is discovered, there is near-universal surprise and consternation. How could this happen? Well, it does happen all too frequently - and here are a few examples:

My brothers stole before & after mother's death from her ample estate. Found extensive evidence of forgery and embezzlement. Bank said to contact law enforcement. The National Bank Act requires the bank to contact law enforcement & suspicious activity as provided for in the SARS ACT. Elder financial fraud is the number one white collar crime. Getting law enforcement to do anything about it I've found a virtual up hill battle. I will fight on though as my mother would have done for me. I tried my hardest to protect her through didn't have thousands to fight for custody & the Trustee brother stuck her in a facility after selling her beloved home wherein she stroked out from the shock into a vegetative state dying 2 years later. She used to say to me money is the root of all evil. Our vulnerable elderly need more protection from Social Services & law enforcement.

My sister was POA of my dad and changed all monies my mother was to get if my dad passed. My mom predeceased my dad that's when she willed everything to herself . On my dad's death bed she tried to get an attorney to the hospital to disinherit me. Also I had $58k that was in my name that I didn't know about, she presents the CDs to me and cohersed me to sign them over to her in a guilting way saying dad wanted everyone to have a fourth. I signed them over in good faith, she redeposited into her bank next day and kept it. Yup. A sibling will use guilt deception or whatever necessary to steal your inheritance. She stole over $300k that I know of by changing beneficiaries to herself and cdeception. My advice, NEVER make the same person your POA and executor they will steal. This was in 2005 and it still haunts me, the abuse if trust.

What if you sue the trustee and they immediately do the following 1. Not reply, answer, respond to your summons ?..2. Does demurrer and motion to strike ? 3. Disqualifies the judge ? 4. Demands that you answer to their demurrer and m to s ? Immediately demands a jury trial within a year ? And other offensive motions, to cover their guilt.....

@@SineEyed Here’s the thing, law enforcement officials are not going to get involved in civil matters. It’s a waste of their time it doesn’t generate any revenue. Someone steals a candy bar from a store, the cops can’t get there fast enough to catch that thief. Why ? Not only job security but more importantly it generates revenue. The bottom line is that no matter how anyone looks at it Theft is a Crime there is no other way to describe it. I have had thousands of dollars worth of equipment and personal property stolen from me. I called law enforcement and they wouldn’t even make a report. I told them who has stolen my stuff and even gave them the address. Cop told me to take them to court, I told him that I’ll just go there and take my stuff back then. He said if I do that I will be arrested for theft. My temper was getting in the red by then. I said to him that if I go and take back my stolen property things that I bought and paid for you are going to arrest me ? Yes he says I said for what ? I will arrest you for theft. At this point I couldn’t be more pissed off I couldn’t even think I said what in the Fk do you think he did to me ? Go and arrest him for stealing from me ! I had to just stop arguing with this worthless POS before he arrested me for getting upset because he was protecting a thief.

im the stepchild who apparently wound up with the majority of the now stolen oil shares ...probate attorney refuses to help after a private meeting where > issues < were discussed without me present ...both judge and lawyer would rather sanction me 10 grand rather than call utah or even give me a affidavit of heirship to give the oil man...and why is a court employee living in the home i had to sell...isnt that a conflict as it stands i cant get rid of the attorney who is demanding 16 grand i filed all documents myself obtained my letters myself...and refuse to close...they are threatening arrest and sanction ...im in az estate is in riverside property is in utah ...its a huge mess...estate is clear just my inheritance share is missing and according to a step sibling i was left plenty...

What if your dad asked you to sign documents and when he asked you he was looking very "shifty".. and i say this because I've lived with him for years and never seen him so "shifty" apart from when he asked me this question. But I said no anyway. He left my room looking very shakey and very angry.. So through the week the dad says he will get someone to sign "on my behalf". Never explaining what they wanted me to sign. A week later the aunty comes over with a thick pile of documents very exited sits in the living room and asks me to sign the forms. I say no I thought my dad told you. She went absolutely crazy and ran into the dining room.. so I followed very confused and wanted to see the documents to see what they wanted me to sign... Meanwhile my dad's friend who my dad said would sign the documents on my behalf was outside waiting in a van when she arrived.. he only came in when we was in the dining room.. and my dad knew he had arrived when my aunt first sat in the livingroom... So ive followed into the dining room because I was shocked at how they reacted when I said no to signing. So after that I wanted to see what was on the documents, what they wanted me to sign.. So I got the documents off the table in the dining room and tried to read them and my dad got a knife from the kitchen and my aunty and my dad's friends surrounded me and snatched the documents out of my hand. "Why won't you let me read what you want me to sign".. The ten inch knife my dad came at me with lucky didn't hurt anyone as his own friend got in the way and stopped my dad attacking me. So after that they locked me outside and I ended up getting arrested for kicking off and causing damage. I've always asked for the documents and wanted to see what was on them but all I got from my aunt and dad was abuse and they purposely wind me up and ring the police and get me taken away. My dad has attacked me loads of times what has never been reported. Now my dad and my aunty have got money coming out of there ears buying new cars houses and I'm here broke and can barely eat and got into a lot of trouble even went jail because of these people. Everytime I bring up the subject my dad and aunty treat me as if im stupid or just mental and never give me no answers. I miss my grandparents man they was the only real family I had.. What happend that day I will never forget and I want to know what they wanted me to sign. Is that not a crime what they did.

So sorry to hear that. My wife’s sister used to scam her when they were younger and after the second or third time she never talked to her again, even when my wife was dying of cancer. After covid, My ability to focus is limited to an hour. So I forget everything. I have a good relationship with my sons and I shouldn’t take it for granted. Good luck with your son. Also to top it off he never paid the mortgage in 5 years twice he had to save it from getting repoed then he sold it and in the will it states that I get half of the profit well I got screwed out of pretty much all of it because he patted the books on a half-assed renovation and did not follow through with the will and only gave me $5,000 out of a $62,000 profit and really it should have been more of a profit if he would have been paying the mortgage for the 5 years I have been deathly afraid of my brother for years and not thinking he would go to this length thinking I would get something and he also wrote up a letter because I have sold a few things in the house and because I sold those few things he wanted to take my portion of the trust in this letter which is illegal because he did not distribute the will properly and he was going against what the will wanted and the will to top it off was made 5 days before my mother died he carried her in the lawyer's office and then the next day he threw her in hospice and she died 3 days later I need help any lawyers out there who can practice in South Dakota who can go after him civilly who can go after him with a trust litigation I need help please someone help
