Here's the segment where ADA Krause feebly attempts to explain the improper disclosure of the drone footage in the Kyle Rittenhouse case. Watch a state prosecutor lie directly to the court about what happened as he tries, desperately, to account for improper disclose of the KEY EVIDENCE in their unjust prosecution.

The one downside to Kyle's acquittal is there won't be as much pressure to investigate the prosecutor's office to figure out if they're corrupt, incompetent, or both.

@T G I hope you're correct. Unfortunetly I'm sadly cynical when it comes to things with this type of poltical nature. Who knows, while I personally not a huge fan of repubs I think the Virginia election shows some positive changes against a lot of radicalism happening. Would like to see a justice system work towards better integrity.

We definitely know they're incompetent. Corrupt is suspected, but not quite proven yet. Edit: okay there's proof of that too, basically these guys need to be taken under oath and asked a bunch of questions

These Political persecutions will never end without changing the laws for prosecutorial immunity. We have a prosecutor problem in the cities. Too many of which are supported by and elected, thanks to Soros political donations. There is no justice for Kyle, nor anyone else in the future, until Kyle's prosecutor is punished in some manner for withholding Brady evidence and other prosecutorial misconduct. It was obvious from the beginning that the prosecutor was politically persecuting Kyle. He was trying for a conviction by any means necessary, as left likes to say. The only downside for the prosecutor's violation of Brady rights and other prosecutorial misconduct was a mistrial. Which is a loss for Kyle. Because, there would be another trial for Kyle. Prosecutors understand, the legal process is the punishment. Prosecutors must be held to a high standard, as a defendant's life is held in the balance. There is no skin in the game for prosecutors. Prosecutors must be accountable for violations of basic rights, having serious sanctions, if there is to be the rule of law. There should be no immunity for any prosecutor violating basic civil rights.

@@tmcche7881 a mistrial with prejudice means their is not anymore trials. They weren't asking for a mistrial, they were asking for a mistrial with prejudice which means Kyle could not be tried again. The judge said he would decide after the verdict.

Any SANE prosecutor wouldn't have taken this case. There was no case! I'm guessing the ONLY way binger and his fat (facepalm) colleague took the case was either $$$$, promotion or political power of some sort. The fact that this even went to trial is obviously political..... and it backfired 😜😜🤠🤠💪 But yes, I'm looking into the legalities of a possible suit against the state for even bringing this to trial. The web of corruption is great.

Through this I've learned that they're not held to any standards. It makes me believe that there really are a lot of people in prison who don't belong there due to lies made up by a lawyer that just wants to win. I always thought they had to use truth they see through evidence.

@@SirPunch2Face I agree that there were some actions that were objectively unethical, such as asking why Kyle didn’t give his story before he took the witness stand. That’s an obvious 5th amendment violation. But I wanted to include some of the other issues, such as claiming not to know the identity of so-called Jump Kick Man. I think there should be an investigation into that as well. I should have been more specific.

No people shouldn't be thrown in jail on your say so you are just a bad as the prosecution. People deserve including this prosecution a fair hearing of the facts and punishment or acquittal based on all facts not just the ones you have heard. If you can't see why everyone deserves fair treatment under the law then how are you any better? Tribalism is wrong no matter what side it is.

This happens a lot. Government agencies frequently are operating on IT policies written 25 years ago. The official email system may have low attachment size limits. They may also have ineffective firewalls that filter out legitimate emails and allow spam.

Agreed. I'm with RL on having cameras in All courtrooms Except where they should not be as in underage cases. All others should be televised on PBS....

I hear you, but with them tampering with evidence to me I wouldn't want them.. they were caught this time. And I truly believe the judge had the mistrial decision ready to fling at them.. but for the jury coming to the right conclusion he did not have to rule mistrial. But how many other people have they twisted evidence to convict. I don't believe this is the first time.

Honestly, the best way to punish them for this would be to turn the next Kenosha DA election into a referendum on the issue. I wouldn't expect the Bar Association to do much of anything (they _might_ but I wouldn't count on it), but the DA may very well toss them to the wolves if they becomes an electoral liability.

We don't want or need that. We don't need or want courts making decisions based on public opinions. Bc Kyle was found innocent this won't go anywhere. It'll back fire on binger in future cases tho.

I'm not a lawyer, but I'm going into the cybersecurity field, so I have background knowledge on it. In cybercrime, all evidence on storage devices have a chain of custody log and hashes (mathematical proofs) that ensure the original and copy are 1:1. As we live in a digital world with every other trial containing digital evidence, we need to have greater technological backing in court.

@@SeaJay_Oceans For one thing, if a lawyer uses Gmail for priviliged communications, that privilege tends to disappear since the people at Google theoretically have access to read them.

@@SeaJay_Oceans I am not a lawyer, but I do work with sensitive information. We use proper email encryption with signature. No-one can read our stuff in transit and we can verify the information has not been altered when it is forwarded on.

That day of reckoning would have been a conversation about what to have for lunch, some judge who retired 20 years ago, and the ceiling of the courtroom. This judge was hoping so hard for the jury to bail him out of ever having to do anything to protect the defendant's right to a fair trial, and his prayers were answered by the jury.

If the drone footage was edited 21 minutes and 19 seconds after it was received, that means they talked about editing it before it was sent. Just as soon as the prosecution received the drone footage they started editing it. It took them 21 minutes to do so. With the 2 editing programs on the prosecutors computer. The prosecution's words in court. Guilty asf! But we all know not a got dam thing is going to be done. Kraus "I asked our investigator to go speak to this guy. I suspected it was the drone video" Why did he think it was the drone video? And, did you notice the prosecution NEVER used the clear drone footage? Until they were caught off guard and accidentally mentioned having "the better video". Why didn't the prosecution ever wonder why the defense's copy was a lower quality? Why did the prosecution only show the better video at the end of the trial, on the most important piece of evidence in the case?

@@wesleytrout4931 It would have actually have been pretty useful to the defense. The prosecution's withholding of it is a huge problem though. Their intentionally misleading screenshot taken from it is another problem.

Without becoming too conspiratorial, I think what happened in this case is that the detective tried to email the video to Krause, but hit the limit of the maximum size that Gmail will receive attachments at. So either his email program compressed it, or he compressed it himself to get it to Krause, while he also uploaded it to Dropbox afterwards. Unfortunately, they email the compressed attachment to the defense, instead of just emailing them the Dropbox link.

Why did the prosecution blame the mix up on "TV is acting weird". How did the prosecution not notice that their copy was more clear than theirs? The defense stated the video file was edited 21 minutes after Kraus received it. This with Kraus having 2 editing programs on his laptop is suspicious asf. There may be a logical explanation, but an investigation is warranted. You agree?

The obvious question is, if the file was provided to the DA's office and then sent directly to the lab, why in the world didn't the lab provide it to the defense via Dropbox as it had other evidence? Why was normal procedure dropped? Why did the file size, resolution, aspect ratio, etc. change between versions? Those changes aren't just a "technical glitch". The alteration decisions came from somebody and there's a limited number of suspects to interview under oath.

He can get the rifle back, because Dominick Black already verbally admitted that he was holding it for Kyle until he became of age. Therefore, under oath, the verbal contract is validated. Dominick couldn't get the gun back even if he wanted, because it's legally affirmed that Kyle is the owner of the gun.

When the prosecution team testifies to the judge that they supposedly don't know how to re-compress video files, but we've already seen that the prosecutor himself has Handbrake on the computer he's using for storing the case evidence, is when I knew the state prosecution team was lying without a doubt. And it is an amazing coincidence that of all the thousands of man hours spent gathering evidence, perusing tons of video and photos, and interviewing witnesses, there is only this one video that the prosecution hung their whole case on…and it happened to be the one piece of evidence that had multiple technical “issues” throughout the case.

Exactly, if you know how to use Handbrake, you know how to compress files, because that's what Handbrake does. And it is easily the most accessible software program to compress video files.

You have remedy for citizen oversight, it is called elections for district attorney's office. If citizen's actually care enough to vote in their local elections and keep up on issues then a DA will know that letting this behaviour slide will result in being voted out of office. We need something, for sure. Because, these Political persecutions will never end without changing the laws for prosecutorial immunity. We have a prosecutor problem in the cities. Too many of which are supported by and elected, thanks to Soros political donations. There is no justice for Kyle, nor anyone else in the future, until Kyle's prosecutor is punished in some manner for withholding Brady evidence and other prosecutorial misconduct. It was obvious from the beginning that the prosecutor was politically persecuting Kyle. He was trying for a conviction by any means necessary, as left likes to say. The only downside for the prosecutor's violation of Brady rights and other prosecutorial misconduct was a mistrial. Which is a loss for Kyle. Because, there would be another trial for Kyle. Prosecutors understand, the legal process is the punishment. Prosecutors must be held to a high standard, as a defendant's life is held in the balance. There is no skin in the game for prosecutors. Prosecutors must be accountable for violations of basic rights, having serious sanctions, if there is to be the rule of law. There should be no immunity for any prosecutor violating basic civil rights.

They won't since there won't be an appeal. Since Kyle was found innocent bingers lies don't matter now. That's just how it works. It's more of a future kinda thing. This will haunt him in later cases. The system has its way of sorting out lawyers that go to far.

This was the best outcome, I think, for Kyle, himself - but as others have noted, it provides far less impetus to investigate and (where necessary) provide penalties for rights violations and what seems to me to have been suborning perjury in a few places.

Trying to piece together Krauss’ story: Howard airdropped him a copy of the high res file; Krauss put that on a thumbdrive and gave it to the state lab. Later "he" (presumably K means H) emailed a copy of the file to defense. We know defense only had a low res version of the file. Setting aside K’s ignorant claims of email reducing a video’s resolution, and giving K the benefit of the doubt, one might conclude at this point the simple explanation is H emailed the wrong file to the defense. The simple solution is to check H’s email outbox to see what file is attached. My guess is they’re going to find H sent a low res copy. Of course all of this doesn’t explain HandBrake on K’s laptop.

We need to demand a forensic investigation of the prosecution's laptop. This would reveal any versions of the file made on the drive, as well as any logs from Handbreak or Format Factory.

@@user-lt2rw5nr9s I’d love to see the metadata in both the defense’ and prosecution’s files. ffmpeg’s ffprobe command alone is going to give us a _shit_ ton of information - rendering software (e.g., HandBrake), input and output file names, creation time and date, frame rates, bit rates, resolution and aspect ratios, codecs, audio formats, and much more - that can definitively tie the low res version back to the high res, and even to the computer it was rendered on.

There’s a difference between playing fast and loose and outright failing as a lawyer. This may not be a disbarable offense, assuming they’re not lying, but it definitely called for impeachment or worse. But chances are, they’re lying. No ADA would politicize a case to this extent, and no good lawyer would make this many mistakes. For both of those to happen at the same time, to suggest there isn’t some correlation is absurdly unlikely.

We absolutely need a forensic investigation on the prosecution's laptop. This will reveal if Format Factory and Handbreak were used in the tampering of the evidence. This would show if the high quality evidence was used with Handbreak to modify the evidence, as well as any other versions of the file made during the process.

Because even though he lost, the Left still sees him as a hero who fought the good fight, and now his name is out there. This was a great career move for him either way, no downside. Look up what happened to the careers of the Zimmerman prosecutors after he was acquitted. Every single one launched a lucrative political or media career. That was Binger’s goal from day 1. It didn’t backfire at all. He may be a bit salty, and he would have liked winning better, but he’s still going to go out and sell himself as the brave ADA who tried to prosecute the Kenosha Kid, but he just couldn’t get the conviction because America is racist. And the ppl who already buy his narrative will eat it up.

I want the incompetent-and/or-corrupt prosecutor(s) to get their Day of Reckoning (the sooner, the better), but getting Kyle out of there with the "NOT GUILTY" verdicts comes first. Kyle's trauma included both the jail time and the uncertain time in the courtroom, so minimizing the amount of time Kyle has to personally be in the courtroom is the first step to helping him heal from the trauma.

His life is still in jeopardy he is being guarded by law enforcement. He should quickly file lawsuit before against the media before his security detail leaves. For the rest of his life he will need a detail. He won't be going out to public much, needs a change of address ect. He is free but also in his own prison, only to see things in moments of time. I know this because of my deployments and seeing my kids in moments of time.

The identity of Jump-Kick-Man has been known to Binger the whole time - only after the defense rested their case the prosecutor told the court and the defense about the identity of him - there are now articles about him - he is/was a criminal and wanted a bargain for other charges for testifying in kyle's trial

That's not how it works. People don't get a choice about testifying but binger didn't have to call him either. That's optional. If he's not being called to the stand then binger doesn't have to give his info to the defenses. Either way, I've seen no proof of any of it. Only internet rumors.

The time to take action is the election. People aren't educating themselves or voting but can't figure out why these DAs get elected.
