In simple terms the portuguese law says the assets belongs to the couple in equal parts. If one of the spouses dies, Half of the assets belongs automatically to your spouse. The other half is divided in equal parts between spouse and sons.

Thank you so much for this!!! Very helpful. It's only my husband and I (no children) and we've put off retiring to Portugal due to being a full time caregiver to my aging parents. We don't want to put it off much longer since we are not getting any younger (approaching 60) and seriously considering the move with my elderly parents in tow. Are there any duplex type properties or properties with mother-in-law (guest) quarters on Madeira island or Portugal in general?

Fantastic!!! We know folks that have come with parents a d we of course came with our youngest child. Yes, the Portuguese traditionally lived in multi generational families. So a quinta will be what you are looking for. They are wonderful different than a duplex. Send Claudia a email set up a zoom meeting with her.
