I always tell my military peeps to BE CAREFUL, many filipinas are out here to get what you have and will get you for all you have if you are not careful. A lot of filipinas know how to play the "long" game; meaning they will get married, wait ten years to divorce a man and be eligible to take half of his retirement and all benefits. In hindsight, marrying a filipina can be very dangerous to one's life if they choose the wrong one. If you must marry a filipina, or ANY woman woman for that matter, try to marry in a state that is not geared towards rewarding divorce so heavily. This video is good advice explaining to men why NOT to get married to a filipina. Not all, but MANY filipinas are out here to get your pockets. Be careful brothas.

There is no divorce in Phillippines so your assumption is not valid...Anullments take many years and too expesnive for the Fillipina to undertake but by all means protect your assets in a family trust or keep your trap shut about what you own back home..be smart and see a lawyer before you shack up or get hitched and have a Pre Nup before you wed...Western women are all about getting their claws into you behind and the wallet you sit on..

@Gregory Jones They can’t own land, so technically you cannot “cohabitate”. Being in a hotel room for however long doesn’t count. So until you have a lease agreement / bought property and live with the female it’s called cohabitate. If you do not then you don’t have to worry about that law.

@Gregory Jones I think you're missing something and I don't know how well the Filipina Pea distinguished this, although I think she did a good job. The main point there is "husband and wife". From what she was saying, to me that sounds like cohabitation. The lawyer said there's no such thing as a pre-nup unless you are officially married, or that's what I got out of it, which is why FP went into the cohabitation part. So, the point is, best not to cohabit. She said that's frowned upon even though it's done. If you want to be there and start dating, the best solution to me is, don't let the woman move in with you. Her coming over to your place is not cohabitation. Her living with you is cohabitation. You can have sexual relations with a woman if that's what you want, and only that, but if you start to see her possessions in your place, best to tell her she doesn't live there. and her things gotta go. See her in the day time, not night. I could be wrong about what I was hearing, but I think that's what it comes down to. Don't be like "husband and wife". Unless, you're husband and wife. Also, it would be interesting to hear about traveling and how this affects a man taking a woman on a traveling adventure. On the surface it would seem like traveling together isn't the same as husband and wife because she hasn't moved in with you. Being in a hotel is not the same as being at your residence.

The Filipina Pea channel is a MUST-WATCH for any Expat!! i do not recall this info from any of the MANY Expat channels- i never realized that a Filipina could request a portion of the assets from her live-in partner when they break-- wow this info affects the majority of Expats that i know!! because most are live-ins not married!! and i would guess they are not aware of this!! as i listened to the entire video it sounds like the assets in question are ONLY those acquired during the cohabitation- but maybe i misunderstood??? I married my ex Pinay wife in Belgium, not in the Philippines, so that my marriage (and subsequently my divorce) would fall under Belgian legislation. I made her sign a prenup. I'm very glad I did that, because now she only got away with my house in the Philippines. If I hadn't done that, she would also have gotten away with half of my assets in my home country too.

That's why I always advise people to marry in their home country, even if they are planning to live in the Philippines. Our western laws offer much more protection.

It was never "your house in the Philippines". Even if you had a conjugal deed, you never actually owned it. You just owned a financial interest in it. If she had died while you were married to her, you would have had to sell the house and give her heirs 50 percent of the proceeds ASAP. Or, the heirs could have bought out your 50 percent financial interest ASAP and kept the house. You would have had to go rent a house or buy a condo, then. Foreigners cannot own real estate in the Philippines. They can own condos only and that started fairly recently. Hell, not even the Chinese have found a way to circumvent it yet, which is surprising.

From years ago I had a pre-nup. 30 page long pre-nup.Back in my wildman days when things started to get serious I would whip it out and the bimbo of the day would run for the hills.Used as a screening tool and it worked. When I was courting my wife from Cebu I explained it to her and she said she would gladly sign.I said never mind, shredded the pre-nup and have had no regrets or concerns.Our relationship isn't all unicorns and rainbows: every now and again we have a bad day but the foundation is strong so there are no worries about either of us walking away or stepping out. I'm faithful as an ol' hound dog and I trust her to give me the same respect. And she does.

Wow! Great info! I think that in the States, any property, including a pension, that a person has earned prior to a marriage are generally not divided up in a divorce. An ex has a right to a percentage of a their spouse's pension based on the time they were married WHILE the pension was being earned. The idea that a marriage entitles someone to their spouse's property or pension earned prior to marriage is really strange and basically unfair. Actually, I would like to ask this lawyer whether she did not mispeak when saying that marriage entitles a spouse to 50% of assets prior to marriage. If this law is passed, with great sadness I will scratch the Philippines off my list of places to retire.

Although cohabiting couples do not have similar rights and responsibilities as a lawful married couple, they are still protected by law. Once you enter a live-in relationship, it is legally recognized as a common law marriage in the Philippines.

Without her love and dedication I would of never had the motivation to make things happen. Granted I never see us splitting apart since she has already stayed strong by my side through the hard times. That is something western men in general don't understand. Women from this country when you find a good one....they are there for the long haul and will give you drive to do things you never thought possible. You're safe. Just don't invite a woman to stay with you. If they come over for a night, I don't think that qualifies as cohabitation. Don't let her start bringing stuff over to your place. Have witnesses. Don't be there on your own, so meet friends or go live where others you know are. If you want a woman to be something like a housekeeper, probably best they aren't having sex with you and you can probably talk to people about making a contract of service so the relationship is understood. I think the key takeaway is, living like husband and wife, meaning living in the same place together, in a relationship.

But there is also the case of the people just like bad salesmen that sale you a good story to get you to sign a contract thinking that once done, you are locked in. Its a common story that before a marriage one of both sides is basically acting and not being themselves to win what they think is a permanent deal, and then once the deal is signed, start the bad behavioral patterns, and physical and emotional torment. There is a reason all contacts have termination clauses, in business and marriage. Til death do us part sounds nice, but it only encourages people to find ways to kill their partner when they cant take it anymore, if they cant just leave :D

@@knivesandstuff You're right, I've seen people put on a "false face" to get into a marriage (or other relationships), then the "real" person comes out after they get what they wanted. I've seen it with both men and women as well. The bad part I see is the trend of the "no-fault" divorce, 17 US states and many western countries have this now. It means that the government doesn't care why you are getting a divorce. So, even if one or both are cheating, it doesn't matter to the courts. In my case, if I was married, my wife could cheat on me and still get half of everything I own. Even if she had nothing to do with my earning it. In addition, what used to be the "iron clad" Prenup is being overturned in the courts now.

The thing wrong with divorce, western or eastern, is the “divorce” part. The vast majority of people in the Philippines are Catholics or other Christian religions. What does your Bible say about divorce? There was the precept given in Levitical Law by Moses but later on Jesus himself said what? Read Matthew 12:1-12. Once “Divorce” is allowed, for any reason other than what Jesus said, you have started down the slippery slope from which there will be NO Return and many years of “well what about this situation” challenges to expand the law. All this said it will eventually End Up Like the western laws. Three pieces of advice, 1) No divorce 2) Reform annulment laws to cover the case Jesus spoke of and hard case provisions. 3) CONTINUE to raise and rear your children as you do now to RESPECT God, Family, and Marriage as Holy not to enter into the institution of marriage based on fickle feelings of infatuation, love (only) or even potential financial prosperity, security, or ulterior motives. If it isn’t broke it doesn’t need fixed. By the way, Jesus said that infidelity was the ONLY acceptable reason for divorce, but He did not say that if it occurred a divorce was required. Something else to think about, redemption.

Great video Miss Pea. Very informative. If people would only treat one another fairly at all times, there would be no need for new laws. In general, we can't so we are always putting our trust in someone we don't know. All prenups should be created by both parties to ensure a fair contract. Some will say that a pure love will not require a contract of a prenup and then insist on the contract of marriage. The best prenup is one that will evaporate over time as agreed upon by the couple. Keep up the good work.

It sounds like the cohabitation and divorce laws there are moving to similarity to the way they are in Canada. I believe in most provinces here the cohabitation time to entitlement is a year - after that, you’re effectively married. The grounds for divorce here sound like they will be similar. You can protect assets you had going into the relationship with a prenup, or at least with a pretty comprehensive statement of assets going into the relationship…but I’m going to have to go through this video again to be sure I got it. Strong agree, the purpose of the laws is to attempt to prevent exploitation on both sides but it’s tough to adjudicate every individual set of circumstances fairly. Often somebody feels like they hot taken advantage of.

Hi Pea, very useful information about cohabitation laws in the Philippines. Yes, get married under a prenup. Yes, worry if you cohabit with your partner if you buy property and consider your earning because both may be split if you decide to separate. All great information. And this law may affect many younger foreigners. I think the effect is very much lessoned when the foreigner who cohabits is a pensioner who gets paid pension in his native country. Also, a pensioner can decide not to have children by getting the snip. To protect themselves further, don't buy, rent. Right, household purchases you might need to be shared but is someone really going to be petty. If so, keep receipts. THERE, job done. FULLY PROTECTED.

Hello Miss Pea & Miss Gracie!!! So .. I listened very carefully about the topic called : CO - HABITAT agreement contract. Philippines version of this is equal to what is called : COMMON LAW marriage.. which i don't advise to any man to do. Here in Canada.. Our contract laws on this specific title is totally different & better .. There is much that i have to explain to you. I have a COHABITAT agreement contract written by my lawyer back in 2012. My girlfriend back then ( not in the picture anymore ) she moved in with me because i found an basement apartment. My contract protected all of my rights, all of my money, all of my pension money and etc. It was a clean break & no arguing. Our laws on this contract is far superior for protection of men's rights. I wonder how many of them are living in ignorance regarding the safety of their assets. The key point I think is don't let your girlfriend move in until you're sure she's the one and then either keep receipts for ever or get a prenup and marry her. And now I have two beautiful children with her. It is my responsibility to take care of my family no matter what happens. I am presently in the process of drawing my pension and I have learned that my wife even though she is not American citizen is entitled to a 50% survivorship automatically by American law. This cannot be changed except by her notary signature. Another tip I can pass on to my American co- ex-pat is that I have also learned that Social Security will pay extra payments for your minor children and your spouse that supports them once you retire and start drawing Social Security benefits. The family limit is around $5000. Remember a happy wife equals happy life.

I think that it would be very difficult for a local court to order that 50% of a pension be awarded to another party that originates in another country where they do not have jurisdiction. Apparently, the Filipina has to file the court’s decision in the local jurisdiction of the husband, where the finding may - or may not - be accepted. According to Gracey, it’s a roll of the dice (but it’s very rare that a Filipina goes to the trouble - or has the money to pursue it)

I was thinking the same thing. It’s hard to imagine a foreign company or government even acknowledging a court order from another country, let alone enforcing it if it’s contested. I'm not sure about other countries, but I can talk a little about the US. I had a friend that found out he was a father from a relationship he had in Ireland, but not until the son had turned 18. The mother lost government support at that time and wanted more money, so she went after my friend for it, and got it. The Irish court not only ruled he had to support the son for his years going forward in college, but also had to pay back child support. That ruling was forwarded to the US and enforced there. That is not alimony and it is Ireland not the The Philippines, but there precedence.

When I came here in 2012 I had put all my business interests and assets into an IBC (similar to an OIC) which acts as a Trust which I am the primary beneficiary. When I die the assets continue to be held by the OIC for the benefit of any heirs.. I bought a small house (2 bedroom) which I gave to a lady who had worked for me for many years overseas, but on the understanding that the farms I "bought" were mine. In order to protect myself further I had her sign a 25year lease with automatic renewal, AND a Sole Occupancy agreement. Now she still owns the property but as I hold all the papers it cant be mortgaged or sold without my knowledge. And when I am dead? Well, I dont really care then do I. She can have it all. If I do hook up with someone before then, I will have to review it, but for now it works for me.

(If she sleeps in the hotel room with you) 2) How difficult is it to get a divorce? (Referring to the court process. Like how many hearing do we have to go to? Does the guy have to show up to court or can the attorney do it for them?) 3) Are there lawyers that would take the divorce case without payments (until they win)? So flippinas don’t just randomly do divorce for 50% income. 4) If a foreign male makes a women pregnant does it count as cohabitation? There is one part of the subject that you didn't touch on in regards to a person that is already retired and receiving money from his pension along with payments from Social Security. Since that person is not in a working status and adding to their pension, Is the spouse or cohabitation partner entitled to half of that money?

Before the no-fault divorce crap in South Carolina, you only had 7 reasons that you could get a divorce. the ones I can remember are abuse by a spouse, infidelity, alcoholism, abandonment for over 5 years, mental abuse, and a couple of more reasons I can't remember. Interesting, Have pension deposited in to an American bank account, wire transfer to Philippines of needed amount, then deposit into local bank account ( no automatic reoccurring deposits ) pre nup/ pre cohabitation agreement. That's probably how I'd do it. I've worked hard for my pension and don't want to just give it away if the relationship turns toxic or dissolves.

Pea I read that law Gracie is referring to: Art. 147. When a man and a woman who are capacitated to marry each other, live exclusively with each other as husband and wife without the benefit of marriage or under a void marriage, their wages and salaries shall be owned by them in equal shares and the property acquired by both of them through their work or industry shall be governed by the rules on co-ownership. plz, note the word wages and salary. I may be wrong but I looked up those words under the RULES IMPLEMENTING REPUBLIC ACT NO. 6727 and this is what I found. Section 2. Definitions.(g) "Wage" paid to any employee shall mean the remuneration or earnings, however, designated, capable of being expressed in terms of money, whether fixed or ascertained on a time, task, piece, commission basis, or other methods of calculating the same, which is payable by an employer to an employee under a written or unwritten contract of employment for work done, etc::. basically, my pension or ss does not fall under that rule. so that's exempt. plz, ask Gracie about this. .

The cohabitation laws take effect as long as you are living ‘as a man and wife’, but the only assets affected are the ones purchased during cohabitation. So if you lived together for a month, the most she could possibly try to get would be half of the assets purchased during that month (which it wouldn’t even be worth attempting to do). As long as you keep receipts and a paper trail for any large purchases, you’ll be fine. It’s long term cohabitation that can cause trouble 👍

My takeaways: 1) Getting married? Pre-nup. Pre-nup! PRE-NUP! No pre-nup, no marriage! It may not be "romantic" to demand (not ask) for one, but it is practical. That said, don't be a schmuck and leave your spouse with nothing if you leave them. As part of the pre-nup set up an account with a decent amount of money in it that your spouse cannot access but is there for her if you pass away or if things go south in the marriage. 2) Dating and co-habituating? NOPE! Not even for one night. If you are serious enough to have them move in with you, you are serious enough to marry them. 3) Ask for a Proof of No Marriage document from your Filipina (and pay for it yourself). I wish Grace would have explained "during the cohabitation" more clearly. My understanding is that lets say your pension is 20,000 per year and you were together for 1 year. This means that the Filipino/Filipina is entitled to half of the pension for only the time they were together, so only 10,000. This is how I understand it to be.

So unmarried polygamy is the way to go. So long as the gals all know it and agree, then the assets are protected without a lawyer, a marriage or anything else.

@The Filipina Pea, Those rights are for the the wealthier upper class. I have not heard of even ONE legitimate example where a poor or lower middle, middle income Filipina has taken a foreign BF to court under these laws and WON a judgement for assets. If you and the girl are both wealthy upper class definitely protect yourself! The average Joe living on his SS check has little to be concerned about.

@@TheFilipinaPea Can you Imagine the colossal hassle from paying attorney fee's, long wait to win a judgement and then trying to collect the money. By that time the foreigner and his assets would be long gone.

In Canada and the US you need to be separated for one year before applying for divorce. I don't know anywhere it is 5 years. Also in Canada living together (common in law) it is the same as being married and I believe it is after 3 months. Some things don't seem right but that goes for a lot of places. This was very enlighting. Keep smiling and stay safe
