I read up on the case and the reasoning behind dismissing it. The judge cited Greenlaw and Cimenelli as precedent. His argument was that "deceit" is not enough to convict for fraud; you need to deprive people of money or property. Since the followers did not give money directly to the influencers, it's not a crime. So fraud is a-ok as long as you launder the money. You can thank the Supreme Court and the Fifth Circuit for that one. Happy pump-and-dumping!

I can see this Texas court deciding the following: "K wasn't responsible for V's death, because K only fired the gun. The bullet had to travel the distance from the barrel of the gun to V, which is determined by physics. Then the bullet had to penetrate V's skin. There seems a fundamental flaw in the US fraud offences. From what I understand of the UK offence of fraud, all that is required is that the defendant gains from their misrepresentation, and their is no need to identify a victim or causation of the victim's loss.

I suspect that it's based on the asymmetry of financial education. I have seen multiple different scams that ultimately work only once: like the tourist scams, used car sales scams, real estate sales scams (poor quality hidden), crypto scams. Once the victims have had a lesson they would usually not fall for it twice, but unless they get a "vaccine" through education, they are likely going to make a lot of money for the fraudsters.

@@planescaped I'm a cop and I learned over the years to be careful with how I write as even a small grammatical error can lead to a charge getting thrown out. While I'm careful with my writing I had my share of nights where I was woken up at home in the middle of the night and told to rewrite a charge to add needed verbiage. Mind you this would be county judges in state criminal courts not the feds, but ironically I'm in Houston where the federal court is located. However, in fairness to the prosecution here the judge based his decision on the Supreme Court's Ciminelli decision which came a year after the indictment. The Supreme Court decision was unanimous by the way. If I got the legal logic right SCOTUS did not deem information as property, so depriving person of information can't be treated like depriving someone of their cash. Problem is pump & dumps work by depriving people of info and manipulation them with that lack of info.

It is very sad. When I just started discovering stock investing and trading, I fell a victim of pump and dump scheme. I knew absolutely nothing about it. I didn’t know much about price actions and how short selling worked, etc.. So, six months later, after I lost huge money (for me) on that scheme, interactive brokers restricts me from trading some stocks. As a result, I started trading some options and lost money. So, I totally moved to another platform. Screw IBKR. I called them. They told me probably it was because of my “involvement” in that scheme where I was a victim. I didn’t have my phone then so couldn’t confirm my identity for the moment, so I didn’t continue with details. So, pump and dump will continue to be legal unless these thousands of scammers scamming people of billions of dollars get punishment that they deserve, and not a tap on their hands. The judge should be imprisoned. The judge definitely was bribed.

I read the judge's document and it was dimissed without prejudice so the case can be retrialed. Hopefully prosecutors are able to do so and get charges to stick

I feel it is important to point out that a trial court does not set precedent in the US. Just because one judge throws out a case does not mean the next judge won't throw the book at a pump and dump scheme. I bet the prosecutor will appeal the dismissal and refile the case. This really isn't too different from the postal worker who won a dismissal for charges of carrying a firearm in the post office. The trail court ruled that was constitutionally protected but that ruling doesn't apply to anyone else. EDIT: Typo, since y'all care so much.

That's true only the federal circuit like the 9th and the 3rd Courts who over see multiple states and of course the supreme court can set precedent But since the US supreme Court sees less than 3% of all cases presented to it most of the things that are seen by court and become precedent and become laws usually done by the federal circuit courts

I find the comment on how the stock market better helps allocate capital to companies that need it. It's like if Person A buys stock from Person B it doesn't have any direct impact on the company's funds. The only time stock price effects the company is if the company is directly buying or selling it's own stock, or using stock price as collateral to get a loan. The stock market is mostly a gambling/speculation house for financiers who make money with buy low and sell high rather than the actually financial well being of a company as we've seen plenty of stories where companies CEO do things to make the company look good so they can sell their own shares while the company value is high. Yet not considered pump and dump or insider trading because their policies were public knowledge and they "thought" it would improve the company cause after all incompetence is not illegal, but is a great legal defense.

Lots of illegal stuff that is accepted or tolerated by the establishment...especially if big money is involved. Monopolies, functional rackets like HMOs, bundled cable, trust funds which are fake companies, automatic/forced software updates and alterations to stuff you bought after the fact, surveillance, pump n dump, stock buybacks are all illegal by our laws already on the books. There is also such a thing as spirit of the laws and justice as well. Even private law firms are questionable legal as they create an obscenely unequal representation under the law. If we had lawyers worth their salt and a legal system uncorrupted, these would all be successfully challenged. Acceptance does not mean legal.
