I misspoke in the video. I said probable cause when I meant to say Reasonable Articulable Suspicion. Now the officer might have smelled jazz cabbage before saying so, but he definitely initiated detention before saying so. I stand by our analysis and should have been more careful in my words there.

John, I really enjoy your analysis for most videos, but sometimes you do tend to have a little bit of "diarrhea of the mouth". Don't get me wrong, everybody repeat themselves, but I've heard you use the wrong word on more than one occasion. There's nothing wrong with being imperfect, it's what being a human being is all about, I just wonder if you would consider writing a script prior to the video because I feel like a lot of the stuff you do is on the fly. Which is good, it's not like it's improper to do, but maybe sometimes for more controversial videos, perhaps a pre-written script. There's a couple of your other videos where I noticed you kind of say things that don't really seem to make sense, or repeat yourself ad nauseam. I do sincerely enjoy your content/wealth of knowledge and experiences hope it's OK that I make an observation it's not like I think your content isn't of high-quality. I certainly have learned a lot watching. You have helped my comprehension of human body language, grow even further, because for the most part, I only looked up, the body language of the opposite sax (yes, that's intentional) to decipher if they were coming onto me or not. And even though I have some comprehension of understanding when someone is violent. The fact that you pointed out specific cues that people do, especially furtive gestures, when analyzing if they are a threat or not.

A lot of people think it's a bs reason since it's impossible to contest on the street and impossible to prove in court (regardless if actual marijuana is found). There's nothing you can do if that's a one-off behavior but cops do hang themselves by repeating stuff like that. If a cop ends up with twenty complaints about claiming to smell drugs or alcohol and there ends up not being any after they violated their rights without justification that's going to catch up to them eventually often with the help of local news. And not all cops do that so it's good you know how to make it clear whether the cop is detaining you or not and if they fabricate a reason to detain you you just gotta play the long game.

If you change it , criminals only raise suspicion to the cops, not all civilians who are bothered by the search. Every policeman should be able to ID randomly.(takes 2min and reduces illegal imigration) And searches take(10-20minutes) it sometimes happens twice or three time in a same day so its annoying , but thats rare.

I’m a huge supporter of LEO, but this seems a very questionable stop. This guy wasn’t a threat to the public. If the police smelled weed, so what. Weed is everywhere so pick your real battle with real bad actors. On the other side, don’t resist, go through their process and take it to court instead of taking a bullet… and never pull a gun on trained people.

Several states have made it unlawful to stop or detain someone because an officers "smells Marijuana." Especially with Marijuana being legal for medical purposes, this is no longer enough evidence to stop and search someone. This goes for the home as well, just because officer "smell Marijuana" coming from your house. They can not enter and search using that excuse for a warrantless search. Once the suspect fired a shot, though, that completely changed the rules. He would have had better odds fighting it in court and winning than fighting in the street and ultimately losing it all.

I got a call for two suspicious males walking one night and it was the same scenario. They were walking home from a local gas station(had a bag with food from there). I asked dispatch what they were doing and dispatch stated “walking”. Moral of the story the resident called when they saw them walking because they supposedly have broken into a house/houses in the past. But weren’t doing anything. I didn’t even feel comfortable asking for ID. They were cool with me told me what they were doing which they didn’t have to do. It was a casual/good encounter and we all went on our way. They were extremely cool with me told me to be safe and I had no PC to really even do anything. Also got one for a guy shopping once lol.

Probable cause is being in a known drug area late at night and not stopping to talk to an officer when he asked you a simple question. Good friend is a sheriff in Washington County here in Oregon and he just said if you want to detain somebody to ask them what they're doing in a known problem area, you have every right to as an officer on patrol. He said that's why they Patrol. When that person fails to comply with a basic identification request by being in a high crime area or known drug activity area you have every right as an officer on patrol in that area to stop said person based on the suspicion of drug activity. If that person identifies themselves and is shown to not be partaking in the problematic illegal activity especially late at night during peak times, then they are free to go. But the moment they pull away from an officer or start running and acting suspicious all it does is escalate the situation and then turn into a mess like this. This was all on the perp and the reason was cuz he had a friggin gun tucked in his waistband that I highly doubt was legal. So is my friend incorrect?

@@MR_KILL777 there is caselaw regarding that, but it’s kind of one of those things where you really gotta make sure…. Well let me ask you this. How do you know it’s a high drug crime area? And what classifies as a high drug crime area? Is there one drug dealer that lives nearby or is there 10 and how far do those drug dealers live? How spaced out apart are the drug dealers or are they all living within a quarter mile radius? There’s no clear-cut answer…. I would never fuck with somebody specifically just for that. Also, did you witness the person just leave a drug house and their pockets are bulging, or are they simply just walking down the street. It really depends on all the little facts and circumstances. One of the reasons is because I didn’t wanna end up like this Officer and if I ever had to shoot somebody, I really wanted to make sure I can justify it. These are all also questions you’re going to get asked in court probably.

@@Jdog587 High drug area means they actually have drug task force in that area and are told to be on the lookout for people that match the criteria, nice cars that don't belong in that area, people walking late at night with hoodies on when its 100 degrees out, you know stuff like that if youre a officer. Come on. They don't just randomly assign a drug task force to an area without statistical information. Give me a break. That's how they know it because most of their drug busts go down in that area, or they trace the dealers back to that as their Source area and where they see most of the movement of Narcotics spreading outward. That's just one of many examples of high-crime areas or prostitution riddled areas where they set up stings on Johns. This is kind of Common Sense amongst from law enforcement I've gleaned off of my friends over the years...MP's included. Secondly, if you don't have anything to hide you're not going to continue to walk away from an officer when they're asking you questions and start escalating the situation by acting sketchy and suspicious. Again I think that's common sense from any sort of outside Observer to law enforcement or ex-military like myself that is in line with nothing to hide.

Most of ours were from getting pc on cars leaving drug houses and establishing enough PC for a warrant linked to those traffic stops and those houses. If somebody’s not doing anything and they’re in a high crime area. They still have the freedom to travel. And it’s not illegal to run or be scared of the police…if I end up having to shoot somebody due to a foot pursuit…all I’m saying is I’d rather have established a decent amount of PC/reasonable suspicion so when I’m on the hot seat I can say I without a doubt I had the right to attempt to detain them instead of a simple…we’ll he ran …if it’s at night in a high crime area he may have thought I was an op or potentially a drive by shooting was about to happen if all he saw was my slow moving head lights approaching him…see how many what ifs can come up in the defense of the “suspect” Like I said I personally want a little more. Plus it makes a stronger case the more you have. It can be risky just going based on that.

Whatever happened AFTER the stop doesn't have any bearing on that because the police do not have the ability to see into the future. A crime that hasn't been committed yet is not a crime. He was stopped for nothing. "His record-" The cop hadn't even identified him yet. He knew nothing about his record. From the officer's perspective, this is some random guy walking down the street with a grocery bag. That's all the information he had when he initiated the contact. Being outside, even in a "high narcotics area" or whatever the fuck, is not legal justification to shake somebody down. "The guy was a piece of shit" isn't either, considering that information was not available to the officer until after the fact. John & Mike, I am a supporter of the women and men in blue. Anyone who dons the shield on a daily basis to put their life on the line for others is worthy of my respect. Cop was definitely in the wrong to stop him, but I can’t think for a second how running away and shooting a cop is going to make anything better. If he killed the cop, he’d spend the rest of his life in jail, or he’d end up getting shot and killed like what we saw in the video. Both of those options are a lose lose. If he chose to just talk with the officer he would still be alive today.

@D B I'm not even gonna pay attention to the verbal warning part, but you must've missed the part where he pulled that gun on the officer and a round went in the officers leg, questionable officer for escalating, but doesn't remove the fact that the kid was not in danger to the extent of death, but yet he chose to use fatal force against an officer, but soon realized then unrealized, he was lacking of both luck and skill. Easily preventable in every aspect on both parts.

5:46 A detention requires reasonable suspicion that a crime is occurring, has occurred, or is about to occur. Probable cause is required for an arrest. It's debatable whether the officer established reasonable suspicion to make a detention ("This is a high narcotics area") but I don't think so.

If legitimate justice can be obtained then that disproves your point. And you may well have the right to a jury. I think the point is, unless the cop is straight up literally trying to murder you and you're defending yourself, it's a bad idea to resist arrest because it can end up going very poorly for you physically and legally. But you can win in court. And if you were provably compliant at the side of the road or what not, you're going to look far better to anyone weighing evidence. You can also possibly draw media attention to gain compliance to your side (I'm thinking of a certain civil asset forfeiture case for that sort of context).

Good analysis, though imho, this was a 💯% illegal detention and resulted in the murder of this kid by another psychopath with a badge and a fragile ego. This kids’ attempt to defend himself from an aggressive attacker who forced the encounter on him with a gun was foolhardy but didn’t merit the death penalty. I hope the family sue the pants off this cop, the department, and the city. Reckless cops like this have no place in a profession where they are entrusted to protect people’s lives not snuff them out when their egos are hurt when a citizen rebuffs their illegal demands.

Yeah, unfortunately cops can do whatever they want during the moment. You can't argue your case to stop an arrest, you'll only be physically assaulted or killed. All you can do is get badge numbers, file complaints, and sue later on. If the cop goes beyond what they can legally do then whatever they charge you with will be drop (more or less).

I'm a police officer and I say legalize all marijuana. It's too petty of a crime to be getting yourself into dangerous incidents over. I used to work for an agency that would not allow us to pursue unless there was already a felony in progress. Having been in many pursuits, I agree with that. Been doing the job since the early 2000s and it has changed a lot. Criminals get away with more nowadays because of the laxed court system and it's just not worth putting everybody in danger for someone to spend 6 nonths in prison and be released back into the public.

(Controversial opinion) - sarcasm I am not 100% sure this cop did anything illegal. The kid in the video probably didn't know any different, and the cop probably thought he was enforcing the law. You yourself don't know either. You are saying something that if people try and follow in their own lives, will get them killed, put in prison, or have their lives destroyed if they manage to stay out of prison. Logic tells me that if the detention was illegal, the initial shooting would have been self defense. If an armed civilian chased and tackled you, you'd legally shoot him. Cops might have more leeway but they need to follow strict rules.

You cannot legally defend against physical force with deadly force. If someone tackles a private citizen you can't legally pull a gun and shoot them. You have to be at a risk of death or great bodily harm, which this individual was not.

You could argue that the initial shot by the deceased was in self defense if the detention by the police officer was unjustified. If it were considered unjustified, at that point the officer chased a retreating citizen and tackled them to ground while armed, putting the deceased in reasonable fear of their life. If he weren't a cop, he would likely be guilty of at least manslaughter.

Preciisely! I grew up in Boca Raton FL in the late 60's and was once walking home from my girlfriends house at which I had been in her dark bedroom for a while. I'm walking, minding my business, cop pulls up to me, says my pupils were dilated, grills me, says he suspects drugs. COuld not have been more wrong as at that stage, about 17 years old, I had never even seen any drugs and had no desire whatsoever. I have always carried myself older than my age and finally reasoned with him the he was WRONG! He eventually gave in, and I continued to walk home. Now, this has stuck with me all my life and my next birthday will be my 70th. Do I hate cops? No, I hate douchebags that carry a heavy badge! But had he attempted to detain me, would I have resisted, DUH... no!

Citizens are innocent until proven guilty, we should live in a world where an unlawful detainment such as this is met with self defense. Yet we live in a world where cops like this can act as the judge jurry and executioner, and the citizen is assed to be guilty. If its even possible that he could've had a medicinal card, then to ask would've been a HIPPA violation, plus no way to prove it wasn't coming from one of the houses nearby.

I'm a police officer and I have never used marijuana smell as a reason to take action against someone, since it can't be scientifically proven. I can't go on a witness stand and testify with 100% certainty that whatever I was smelling is marijuana, even if I am 99.9% sure it is. Especially in case like this where some guy is just walking around, I wouldn't even consider stopping him.

That was an unlawful detainment and that cop had no right to put hands on that kid

It doesnt matter. You are required by law to stop when a cop is detaining you. You cannot defend youself. If you dont like the law, then move to another Country that lets you run away from a cop.

If they didn’t find marijuana on the guys body, they’re 100% going to get paid in the civil suit. Unlawful detention all day. You can ask to speak to someone, but they’re free to tell you to get fucked unless you have probable cause. Walking while black is not probable cause.

Probable cause is for a arrest he wasn't being arrested he just needed reasonable suspicion to detain him.

@@papimaximus95 The first lawful command and when the detention began was a 1:20, after he approached. Cops are allowed to walk towards you in public. The stop was not initiated until then.
