Don't know how it works in other countries, but in the UK, if the person we contacted is clearly the wrong person, we automatically remove the number. If its the customer and they don't want us to contact them, we remove the number but we advise we will still send out letters. As for how debt collection companies get these numbers, it is from credit file referencing agencies and through dedicated tracing team. But companies getting wrong numbers happens a lot. It happens, part of the parcel with tracing.

While many of the protections afforded to customers in the collections process only apply to 3rd party collections, 1st party collections should always strive to follow the more stringent guidelines as several of them do still apply, including that if a Lawyer calls and says they are representing the customer you MUST cease all further contact with the customer and only speak with the attorney. Mind blowing.

Yeah, debt collections after deaths are pretty evil. I kinda understand some companies desperate for money owed, but if no survivors are legally liable it's kinda cruel to threaten and scare grieving people into paying. My father died intestate (no will) and I can't remember what it's called, but he basically didn't leave an estate, only debts. Sadly some of them were joint with my mom, but one of his credit cards was only in his name. And they wanted my mom to pay, but yeah, no, sorry. I think she had to send them a letter once, twice max, saying he died without assets and they stopped. So pretty lucky it didn't become Reddit drama worthy. And further lucky, he did a sort of death benefit thing when he worked for the government and it paid out enough money to cover his funeral expenses.

The mortgage company story sounds like the same company my wife and I dealt with after our mortgage was sold for the third time. Had NO issues with the original or first two companies that bought out our mortgage, but as soon as CENLAR bought us out we had nothing but problems with them, mainly due to the whole "Partial Payment" excuse except we had one payment that was literally $100 short one month and as a result they did not apply (but held onto our money) the next full year of mortgage payments, which is when they started sending us foreclosure threats and started sending employees to peek in our window to try and determine if anyone was home in an attempt to change our locks on us before they had even filed for foreclosure. Finally had to hire a real estate lawyer and sell the house because CENLAR would not work with us at all on getting the mortgage back on track (the only thing they would agree to was a deal that had us paying the interest each month but nothing was being applied to paying off the loan itself) and on the day of the closing we get informed we were being hit with $75,000 in fines and fees we were never informed of prior. We almost had to PAY to sell out house! AVOID CENLAR LIKE THE PLAGUE!!!

The last story reminded me of something that happened in 2003. A friend and I built a very beautiful patio on a custom home spent two weekends building this thing only to get stiffed on our payment. Well we find out he's throwing a giant party the weekend after we finished so we waited called him all week still nothing. So the day of his party we parked around the corner warmed up a couple of chainsaws pulled up in front of his house kick the gate in found him before we brought the chainsaws in by the way demanded our payment he still refused. He was surrounded by a lot of very wealthy friends they are all looking like what the hell's going on. I told this guy you pay us or we're taking the patio down. He didn't believe me till my friend walked in with a chainsaw fired it up and started walking at the center post. You know it didn't take him long to show up and hand me $8,500 cash in front of all of his friends who just realized what kind of a deadbeat this guy really is.

The lawyer REALLY, shouldn't have settled. After all, the lady said she would see him in court.

As someone who works in debt dispute, the first story made my skin crawl. One of my duties is deleting accounts if we accidentally reached out after a cease and desist. We have automated systems to try and stop this because "holy lawsuits Batman"

I really hope that lawyer friend got the company to actually pay something. Words are useless to a company, it only EVER bothers them if you hit them in the moneybags.

Holy freaking wack! The same exact thing happened with my old mortgage company. Only I had no way to prove anything and after they foreclosed without notice and sold my property while I was still living there to a shell holding Corp owned by themselves, they evicted us, tried to steal our other properties and force us off our other home property... They took our money, home, ruined our credit, and blamed us. All I can think with the rude agents and everything being the same, Must be VANDERBILT mortgage company.

I have a similar story with the bank that had my car loan with. When I purchased it, I opted to buy the accidental disability insurance. Well, three years later, I was involved in an accident in a company vehicle that left me 100 % disabled. So the insurance contacted the bank, informed them they would be assuming the rest of the loan until paid off. All I had to do was to send a monthly copy from my doctors to the bank so they’d get the insurance payment. Well, on 3 different occasions, some flunky at the bank misfiled/lost the note. However, instead of contacting me, they repossessed my car. The last time they damaged it, so I sued! The bank gave the excuse that it’s my problem for their incompetence, and since they own the loan, I can’t sue them unless the loan is paid in full! They lost, they had to repair my car, then had to refund me every payment they received from the insurance company, over half the value of my $30,000 car. I drove that car until 2021 when the motor and transmission died. I miss that car, not the bank though. That’s why I pay cash when I get a new car.

As a young Architect I strongly agree with the OP in the last story.

8:18 ASAP is a known abbreviation for Alcohol Safety Action Program. Any criminal lawyer will corroborate that fact. Putting that abbreviation in a medical record when the patient is not an unrepentant alcoholic is a bad idea, but still....

Gotta say: that is the first time I've EVER heard that abbreviation instead of "as soon as possible"

@@aonrarsdani1436 Your background differs from mine. Years of doing disability exams and working in a prison and later going to jail myself as an inmate have given me an unusual perspective.

That story about the mortgage company triggered flashbacks from when I had similar problems with our doctor's clinic. We love our doctor, but the billing dept is a nightmare. They'd list the same appts on multiple bills because they weren't applying payments to those appts. Instead, they'd just randomly assign the funds to any appts in the system, regardless of whether or not they'd officially billed us for those appts yet. It left our records an absolute mess because (due to differing costs of certain appts) some would get paid in full while others only got partially paid. We tried writing appt dates on the checks, but they'd ignore them. My husband finally resorted to writing individual checks for each and every appt on the bill. They tried to tell him that wouldn't be necessary, but after countless phone calls and two in-person mtgs that I only got because I "stormed the castle", he wasn't budging. We haven't had any issues since, but I'd like to think that the woman who processes those checks (whom I've had the dubious pleasure of meeting) thinks of us every time she has to process each individual check.

Whenever I read/listen to these stories I think of the alien spaceship from Flight of the Navigator being a smartass and telling the main character "Compliance"
