@Manchester United Because they are doing it behind their spouse's back at the same time that spouse is not even aware of it, there is a breach of trust loyalty and mental trauma not to mention there is whole family involved what about kids. Why the adulterous keeps them as option why don't they divorce them instead. If marriage is bad they should get out by divorce but why cheat and keep them as backup plan for money. Also criminalising at least make them fear the law so they do the right thing that is to divorce first and start relationship with someone later.

EARLIER LAW - 1) If a man has an affair outside of marriage with a non married woman, the his wife could not file a criminal against him. 2) If a woman has affair outside marriage, then if her husband complains, then the guy with whom she slept with can face criminal charges. This law treated women like cattle or property. Now, criminal charges are removed, making adultery non criminal, and only canbe used as ground for adultery, giving women and men equal right. So if any of their cheated they can file for divorce.

Thanks NDTV for this discussion which brings real understanding about this Adultery law. Yet most of the people have the habit ( no matter they have higher degree or job) without knowing what is the real matter they blab a lot because they do not have to pay for this. Would like to make this compartmentalize like following and based on this NDTV can educate more people. 1. ADULTERY WAS NOT THE REAL LAW TO RESPECT THE INSTITUTION OF MARRIAGE. BECAUSE IF THERE WERE ANY RELATION OUTSIDE MARRIAGE , IT WAS SUPPOSED TO PUNISH THE OUTSIDER MAN BUT NOT IN ANY CASE THE WOMAN SO, (A) IT PROVED THE WOMAN AS PERSONAL PROPERTY OF HER HUSBAND WHICH IS ALSO COMES UNDER HUMAN SLAVERY (B) IT IS NOT JUSTICE FOR THE MAN IF THE WOMAN WAS WILLINGLY PART OF THE RELATIONSHIP OUTSIDE MARRIAGE. SO, THIS SECTION SHOULD HAVE BEEN ABOLISHED LONG BEFORE. 2. SINCE THERE WAS NO PARTICULAR LAW AGAINST "EXTRA-MARITAL AFFAIRS" ADULTERY WAS USED FOR THIS WITH ITS DOWNSIDES WHICH WAS GOING UNNOTICED. 3. THEREFORE, PEOPLE ARE WORKING ON THAT TO BRING ANOTHER LAW WHICH WILL BE SPECIFICALLY FOR RESPECTING MARITAL ACCOUNTABILITY. LET'S HOPE APPROPRIATE LAW SHOULD COME , PASSED AND BE EFFECTIVE SOON.

Marriage in India has much deeper meaning, also it joins two families together. This law is totally against the marriage institution, a person has some responsibility in marriage.

बहोत ही सही फैसला दिया कोर्ट ने । कोर्ट का फैसला स्वागत योग्य हैं । पहले के कानून के हिसाब से उसी व्यक्ति को 5साल की सजा मिलती थी जिसने किसी महिला से संबंध बनाए थे । नए कानून के हिसाब से सिर्फ इतना हुआ हैं कि अब उस तीसरे व्यक्ति को सजा नहीं मिलेगी । . जो लोग यहाँ कोर्ट का अपमान कर रहे हैं उन्हें में ये सलाह देता हूँ कि इसकी जगह ये मांग करते कि पति और पत्नी दोनों को एक जैसा अधिकार दिलाने की सिफारिश करते क्योकि पहले के कानून में सिर्फ मर्द को ये अधिकार था और हाँ सबसे जरूरी बात शारीरिक संबंध दो लोगों के बीच में बनते हैं तो सिर्फ तीसरे व्यक्ति को 5 साल की सजा क्यों मिले । इसलिए मेरा कहना हैं कोर्ट का फैसला बहोत ही अच्छा हैं। और कोर्ट ने कुछ बाते उस कानून की नही बदली है जैसे अगर कोई महिला या पुरुष बाहर सम्बन्ध बनाता है तो उसे तो इस आधार पर वो तलाक ले सकते हैं । दोनों में से कोई बाहरी संबंध से तंग होकर आत्महतया करता है तो उसके खिलाफ केस चलेगा ।
