Hello Ratan Ma'am, According to Model Byelaws no. 169(a) for cooperative housing society..... There are penalties for encroachment of common spaces. Any member found violating this byelaw shall have to pay a penalty. But here it seems that your society MC themselves aren't cooperating. You need to approach the Deputy Registrar or Cooperative court and file a complaint against the neighbour as well as the all the members of MC, along with a police complaint. Take pics of the area and attach the copies of coloured pics along with your complaint letter.

Dear Ratan …. Empathise with you . Get a copy of the Society bye- laws. Any kind of encroachment of the common area is not allowed. Complain to the Registrar of societies. Management committee has to take strict action or resign . Understand that bullies are generally cowards.

Common area should be entirely clutter free because (God forbid) in case of a fire or any kind of emergency, residents should be able to vacate unobstructively...that is the rule according to the laws formulated for all apartment buildings. You can contact the BMC and find out the rules as well as apprise them about the problem that you are facing...and don't get upset or scared...because that is the intention of those neighbors...fight it out!

Can truly relate to what you said...gone through it personally..the irony is actually no one among the society comes forward to sort issues but one day when you confront these deliberate instigators and get into heated argument, all society members come to see the whole tamasha. I feel those whose lives are personally disturbed by these issues only react and have tendency to support or sort otherwise people very casually say "yaar leave it, humara lafda thodi na hai""...And also Ratan, you would neer be able to make them understand as for them they actually don't see feel any wrong in their doings. Very true! Societies are like mini countries. No one likes to speak for the other more so in matters like these. I have my parents living alone bravely at 80+ years of age with me and my siblings placed globally . We make it a point to be with them in turns so that they have someone with them in rotation. But the society they live in has no regards for the elderly very pious and cooperative members. It's sad.

Hi Ratan. I can relate very well to your situation. I live with my sister and an aging mother in a posh locality in Delhi but I'm constantly being harassed by my neighbors. They keep trying to suggest unreasonable things and have threatened us in the past. We keep getting into unnecessary fights that impacts our peace of mind and is very stressful for my mother. Nevertheless, I feel so inspired seeing you Shoulder it all alone and not back down. It's very important to have a strong stand and not cave in to someone's unreasonable demands. Yes same to me my neighbours are harassing on daily basis, of they see any of us coming outside they start to spit, scold us indirectly by scolding dogs, they keep on rumouring about us, like we are doing black magic, we even asked them why are you doing this to us and it led to a big fight and the unknown people started giving us advice about brotherhood humanity and they told we have ego so we decided to the sell house, did the people become worst or is it me seeing it now I don't and I had so much depression that I even cut my hair

At first, try to go through legal way, if it doesn't work than take steps strictly against your evil neighbour. Sometimes we have to come down to the dirty level to teach some people their level. Todays date the problem is people take one’s kindness for their weakness but I am sure that’s not the case with you. You are a very strong women with even stronger thoughts n determination. If your society fails to take any step against your neighbor then you can always complain against your society to the deputy registrar. N if you have any threat to your life from your neighbor n you feel insecure please complain to the police. Keeping quiet is never a solution cos some people can understand only in one language and that language is of law.

File the report Immd. Tomorrow anything happens they should be held responsible since you are alone and they are taking advantage and do g moral policing to you for being alone. Yes I agree, Ratan in our country this neighborhoods is called "BULLY" Get CCTV camera outside, note each and every thing, keep a video, audio diary. And get a legal action. And, sue your neighbour for mental Harrasment, get FIR registered it is verbal treat to you, so when you take legal action you will be covered. And, do not remove your Wheelchair, it is not illegal. And if your society committee not taking appropriate action then you can use them and take them to court , trust me you will win the case get good lawyer.

Ratan, I am writing to you from California. I am in a very similar position as you. I was shocked to hear how you are feeling as I am feeling the same way with my HOA (this is what we call them here). These most uncomfortable feelings have taken over the peace of my home, but unfortunately the housing market here is highly unaffordable so moving is out of question. I am wondering whether you can look at the various documents you received during purchase. Look at the Bylaws and Rules and Regulations? It should say there clearly what the boundaries are and what the rules are. Write an official letter to the Society and the parties concerned quoting those paragraphs out of the bylaws and threaten them legally if they don't follow them. See if it makes a difference. I also am fighting but it is very very difficult. A home should be a place of rest not of mental torture.

You should consult a good lawyer who will guide you appropriately. I am also a lawyer in Mumbai, but I don't do property matters. A lawyer dealing with property laws can guide you well. It is obviously illegal encroachment.

Been through this situation and had health issues because of the stress. so my husband decided to sell the house.After we sold the house it's been resold three more times in last seven years. The stress takes a toll on health so it's totally useless to reason with such people as we have live there and have to face the situation day in and day out. Ramram Ratanji🙏❤️💐how frustrating and exhausting to live next door to negative energy neighbors. Totally understandable. It’s just wrong especially if you share the same entrance area. Usually with neighbors either they accept you or due to various reasons (eg background) they are simply stubborn and ignorant. I don’t think it’s about the stuff in the common area - it’s about who they are. Miserable people make others miserable. Even If you get 3rd party involved and resolve the issues, the energy exchange will still be heavy and toxic. These people are bringing the worst out of you. Some people are capable of anything. I am worried about your safety peace and mental health. You are very independent, progressive and hardworking young woman with amazing experiences with different types of people and places. Don’t rely on others to fix your problem. I am wondering about an option to voice your issues (do everything you can) put them in their place so they don’t torture others. Correct their behaviors accordingly. Hopefully it Educates them in the process. Then look into moving to another floor or find something affordable and suitable in another building. This place is getting bit of “thick black cloud” I feel. Since your dad passing, your eye health, hinderance in new projects, A/C air quality. Heat intolerance, Nikki’s departure and now your horrible neighbors negative behavior and stupid allegations may all be signs from above to make some bigger changes in life. You are not being a coward or running away. You not giving them power either. It’s not about winning, teaching lessons and ego driven results but a wise thing to do for yourself. For your own peace of mind, body and soul. Sometimes we are stuck in stagnant places. Kub tuk ghar se idhur udhar jati rahogi. You are young right now so you can travel etc but we all are aging at the sometime and need stability both financially, spirituality and also for a convenient and comfort lifestyle. Mom will go back soon. Home should be a retreat, a place to rest and relax. Your neighbors are sending you bad vibrations. Don’t know if they are the type to make peace and get along types. Yes you love this place and have memories (understandable) but look what it has become. Perhaps it’s time to upgrade and adjust to todays situation. A change in environment sometimes brings tremendous positive life in general. You deserve happiness. You earned it. You are amazing. I see so much of myself in your lifestyle. Life is a journey (like a river flowing) never look back. Treasure the old, embrace the new. If ever I hit a jackpot lottery, I will buy you a penthouse, whole floor to yourself. Keep inspiring and think about finding a new home that reflects who you are. Not just your space but the surroundings as well. I have such neighbor. Daily she keeps her dustbin in front of my door. When I come back from my job, garbage is scattered by cats right infront of my door. Everywhere in the world management of the community solve this problem. In apartment living common areas are supposed to be clutter free so that during emergency it is easy to get out of the building. Fire exit must be clear. Wheelchair should be next to your door so that in emergency differently baked person can get out quickly. Neighbors shouldn’t have any problem.

I have also been facing the same problem. I am from Chandigarh. My immediate neighbors have also encroached upon the landing area.They have even put a door also n have kept their personal belongings in that area. It gives a very shabby look to the entire area. I also approached my society executive members, even they have not been able to do anything about it.
