relating to the Texas Roadhouse sign, in Alaska payment in game meat is really common. My parents lived up there when I was really little (I don't remember it much because I was a toddler at the time but they tell me about it all the time), and a lot of people and business will accept caribou meat, salmon, and other kinds of game meat as payment the same as they would cash.

I think the real question about the Texas Roadhouse sign is: if I show up and see that sign and tell them that I would like to pay with cattle (and I happen to have a cow with me for some reason) are they legally required to accommodate that?
@therrydicule2 жыл бұрын
In practice, I think the answer is no; but if they refuse your payment of a cow, they need to change the sign fast (because that would become false advertising) and give you acceptable accomodations for payments in returns. In reality: well, who is going to try that?

For judges the main problem is that if they weren't immune from suit for their decisions you'd have every criminal in the country trying to sue the judge that presided over their case. Even without immunity there's no cause of action for a judge making a ruling that gets overturned, even if it was clear error. And if you can sue them even for rulings that aren't appealed or are upheld every ruling would invite a suit. Sovereign Immunity is unnecessary though.

Regarding that carnival ride, anything that carries people has a much higher requirement of safety and redundancy. They also need to fail safe, meaning in the (totally foreseeable) event of power loss, it needs breaks or arrestors of some kind to prevent it from just plowing into the ground. And likely double redundant breaks, as well. If it didn't have something like that, its a defective product, if it did, they were not adequately maintained.
@KantiDono2 жыл бұрын
I can almost guarantee you that's exactly what happened: The power failed, the emergency brakes engaged to bring the ride to safe stop, and the sudden deceleration ripped the phone from the hand of the person filming, causing it (the phone) to plow into the ground. Not the ride or the people. That's why the video looks so bad, it's just a phone tumbling through the air.

On the app the food costs twice as much and then I pay a 10% extra service charge and ~10% more again for delivery, who wants to tip when a £20 food order is already costing £45-50? Then of course the delivery drivers don't get that £5 you paid for delivery so they're dependent on a tip which is just ridiculous when you're already overpaying by so much(and the restaurant winds up getting paid less so really everyone loses so UberEats can make another million). I keep thinking every new competitor will encourage lower prices but they all do the same stuff because it let's them claim their fees are low.

I think you missed the issue with the question about accepting horses, camels, timber, etc. The issue is not whether they are allowed to do it. The issue is whether them putting up a sign claiming they WILL is legally binding. If I take a horse to them and they say "we will not accept that as payment", could they be sued? Which is a legitimate question. Most legal questions have obvious, simple answers usually I think (not a lawyer but I pay attention to the law and what is or is not illegal is usually a fairly simple matter)... but whether they can legally be sued for not being willing to negotiate based on the value of a horse, timer, or camel is a legitimate legal question I think. They can definitely accept it, but are they prevented from refusing and saying the sign is just a joke? And if they have to accept payment in those forms, who then determines what is a fair trade? If they say "we accept cattle as payment" and you show up with a cow and they're only willing to give you $5 worth of product or service, is that acceptable? Especially if you incur a reasonable level of expenses to acquire such a thing, and then they are only willing to value it very poorly, can they be liable for your damages and if so how would the amount be determined?

I think that the restaurant can’t be sued because I’m pretty they can just argue that the sign is a joke that any reasonable person will understand and can argue how clear that it is that they can’t accept something like cattle based on how they don’t have facilities to take care of it or a way to sell it which most people will easily be able to notice. Like this is a case that will probably be easily thrown out of court in my opinion. The thing that I find more interesting is if the trades are accepted how exactly would it work from a tax perspective. Like how would the government tax a restaurant or store that does not use money but instead barters maybe through assets or something, but I don’t know enough about how taxes work to know for sure.

It's funny that you would advocate against carnival rides as if full time theme park rides aren't just as dangerous. Theme parks get their rides inspected maybe once a year, with a "test ride" being the only verification each day to say everything is good. At least temporary rides get inspected every time they are moved and reset up, just so they can get permits for the new spot. Only issue is that constant movement of rides means that there are more moving parts and jostling around of the structure to cause serious maintenance issues to pop up more frequently. Plus it isn't like cheap carnivals are going to have a team of engineers on staff to look at things either....
