@Silent Rider I agree, and am surprised that with all of his experience in the music business (running a studio, not sure if he owns it), working with musicians and their management over the years he claims he doesn't know what to do. In a video he even said he didn't know how to contact KZbin! I Googled it and one minute later had the phone number and address for KZbin. One day he is blaming the artist, the next he blames the music label, and the next time he blames the publishing company.

I had a copyright claim on one of my videos, when it was my original song. It was a basic 1-4-5 blues progression, and the song it was supposedly copying was also, but that was where the similarities ended. After doing some digging, I learned the real story. This particular distributor was buying rights to obscure songs that they could get cheaply, then filing as many copyright claims as thy could fabricate. It's a highly predatory practice, and I'm sure they are making plenty of money from it since most people do not want to dispute it for fear of it becoming a strike on their channel. I disputed it, and the other party simply let time expire without responding, effectively releasing the video, and rendering the claim void. They knew they didn't have legitimate grounds, so they don't bother with people who actually dispute it. Shady AF! And no, I'm not naming them for obvious reasons. I don't want to havee to hire Ms. Kryslte because of my comment on her video.

I got strikes yet they never showed the exact written material or who filed the claim, supposedly going against community guide lines, possibly hurting someone's feelings telling the truth

I fully agree with Rick and his rock solid stance on how he conducts his channel. I mean, these artists that block some of Rick's videos, should be grateful, for the free PR and exposure they recieve, as a result of Rick's masterful presentations of a given song, or band or artist. I guess what trips me out, is these geriatric rockers prefer sitting in the park on a bench, feeding pigeons, instead of enjoying continued popularity and recognition for their life's work, to a younger potential fan base. To me its totally counter productive to why they pursued their careers in music to begin with. Maybe it's ego? Greed? Selfishness? .....whatever

I know it doesn't work this way, but if if a copyright owner (or proxy, it's most often a proxy) has a problem with a post, it would be nice if they first messaged you asking you to take down the offending post. Nice and diplomatic. I mean, give the person a chance to say 'okay'. If not then take it to the next step. 🙂

In summary, use researched information as a weapon of choice to counter these claims and come up with an agreement. Some music publishers just do it to take away the revenue your video makes per view and goes straight to them. While some music publishers are kind enough to grant your permission to use the content for various purposes and share the revenue with you from the views. Why are there publishers allowing others to use their content? Because: 1.) The publisher has a system or a guideline that explains thoroughly in black and white about using their content for your videos for various purposes as long as you ask permission first and have an agreement to share the revenue together. 2.) This is also a good exposure for both the artist and the publisher to have their presence known. Why are there publishers not allowing others to use their content? Because: 1.) They don't have a system of their own and that's it.

If you're interested in getting into Entertainment Law, definitely start consuming Entertainment News related to legal. Doing work with/for an Entertainment Attorney can also give you a good idea of whether you will like the work or not.

I love his channel, especially the what makes this sing great series. It's good info for writing and recording, and even mixing. Most of us don't do our own mixing, and for good reason, but we need to understand what makes a good mix.

Note Rick has even stated he doesn't think all those songs are great. They are big hits and great at gaining subscribers. Like doing endless top 20 and top 10 lists. Believe it or not, there are many suffering artists now, who likely have better, more musically interesting songs. You won't see any reviews of those.

None of it is as easy as all that. He granstands a lot by playing the downplay guy and then says oh yeah I got of these friends in the "industry" and the most important thing of all an army of followers. Suppose you don't have the mob justice advantage? It is the equivalent of crossing the street because you are a pedestrian and have the right of way with a Mack truck steamrolling through the red light. You can't win, you don't have the money to fight it. They do. Copyright is not suppose to be a punitive measure, one of the main purposes is to prevent monetizations. My channel is going bye bye soon. UMG physically filed a notice, according to Don Henley they have 60 oxy 10 geeks in a room trolling KZbin and filing notices. Here is my dispute, KZbin literally says every time their content ID recognizes a song , "It's okay, the right's holder ALLOWS the material to be used on KZbin. If KZbin is only a venue, you know like a bar, THEY should be paying the license fee for all so we all can cover songs, artists get paid but to be fair we should get paid too. What's the problem though? PUBLISHERS. They see a music video and want that money. The license for music videos is wayyyyy more than a simple mechanical license. That's the problem. The law needs to be changed. We are not living in 1965, I do not shoot my videos with a Super8. What can be used as leverage? Payola used to be illegal. The guy who coined the phrase "Rockn'roll"(or atleast was the 1st white guy to say it on the radio)Alan Freed, had his career came to an end because of the scandal. Put the music indu$try on trial for payola or force them to change and share. It's not like musicians have any place to play anymore. Sports bars killed bands and musicians in many ways. And sports are all fake, at least most musicians play live.

Protecting your copyright is like protecting your car. Letting strangers use your car might not necessarily result in extreme harm, but you are nonetheless suffering damages, and the "wearing out" of the car (in copyright's case, it will be the dilution of your original creation). Not all copyright infringement results in a copyright claim, however. Such as with cover songs, record labels like people doing cover songs, generally speaking, because it gives exposure for their artists. But it may still technically be copyright infringement. KZbin has their own rules independently of the law. So, though it's not legally a violation of copyright law, it is a violation of KZbin's rules. However, if someone else is profiting from his work, he should have a case.

Rick uses famous songs not because there aren't other ways to teach, but so he can gain subscribers to buy his book, join his Beato club, buy mugs etc. He won't use songs that aren't famous, and maybe just as good or better, because they won't get hits and subscribers and in fact would hurt his youtube algorhythms. We might ask where all this fair use might lead for non famous artists in a capitalist society. Doesn't seem very positive.

@@TopMusicAttorney ive heard Beato talk about certain videos negatively effecting his algorhtythm. I even heard Rick say he might have to stop doing certain videos that don't get traffic. Its an obvious point to anyone who understands how youtube works, that click bait titles, with famed content, lead to subscribers.

He should be fighting the demonitozation if he qualifies for fair use. He has been letting the demonitizations go all along because he is essentially accepting that he did something wrong when he didn’t.

The big problem with hiring an attorney is cost. Easily a thousand bucks out the gate to defend a video for which he gets no revenue? That’s what most attorneys I see say “hire an attorney” miss.

Attorneys can certainly get expensive, but there are plenty like me who will do simple flat fees (up to a few hundred dollars) to assist. Always be sure you discuss billing, so you feel comfortable with your attorney. More than anything, I've found that whatever you pay up front ends up being a very small % of what you will pay if you don't get the help, and find yourself in a legal battle down the road. Definitely blown over proportion lol. He literally showed that he could dispute it through KZbin and didn’t do it. Also it expired after 90 days. You’d have to get 2 more strikes within that period to get in trouble

The dispute system through KZbin is broken as all hell. It basically goes back to the same person who blocked it in the first place. It basically does nothing most of the time. This has been confirmed recently when Rick used the actual form to dispute a block. It was immediately rejected. He had a lot more luck with just openly calling out record companies etc online. The argument that people made that “not everyone has the reach to call out those people“ is wrong imo. You dont have to personally know the big guys to be able to cause a little bit of damage to the reputation of the labels which they will want to repair...by unblocking the video :)

You forget that Ricks videos are adverts for his books, courses & other products he sells. The 'all time greats' are what draw me to watch the video, but courses and books are how Rick makes money online, and he markets them by telling us about music & demonstrating the skills he can teach you. His videos are essentially very long adverts. Very entertaining and informative, but adverts. I'm a pianist, guitarist & bassist, If he used my music to sell his ear training, I would want royalties.
