My situation was an outlier. I had my 50% rating for my feet over 5 years. They had me go to a RFE. The doctor never examined me and basically tried to accuse me of not having pain. I filed a complaint as soon as I left. In less than 2 weeks I received a proposal to reduce my 50% to 10%. Mind you, I was put on limited walking and standing. Given a cane for instability and had multiple falls that resulted in broken bones. No signs of improvement. I had to fight for 2 years. I had 3 C&P exams after that resulted in doctors saying I did not improve. I had 2 private exams with the same results and the VA still wanted to reduce me. Even after all that the rater still wanted another exam and wanted the doctors to keep answering additional questions. I had to eventually get my congressman involved. It like they were determined to reduce me with no evidence. Vets shouldn’t have to go through all that.

Good thing that you filed a complaint, most veterans don't. In the notification letter it states you are entitled to an RVSR hearing (I have a video on my channel about this topic). What I didn't hear you say that you looked at the diagnostic code criteria to see the requirement for the 50 percent and that you had your doctor to put that in a letter after you asked for a RVSR hearing and presented that information. The C&P examiners are hired guns for the VA. If they think any Vet is not 100% on target they write up a report that is damaging to the Vet. SO VA, if your JOB is to Take Care of Veterans, WHY in the HELL DO YOU DESTROY THEM using Faulty C&P's? Maybe a new rule, the Veteran can challenge ANY C&P and get it reversed!

I was in for 31 years (1989-2020), was rated at 90% overall 70% PTSD. I worked for a year got fired, I can not deal with civilians. I have not left my house in a year, however, i am to scared to try for TDIU due to the fact i could not survive at all without my retirement and VA money.

Here’s the problem I have with your video. I retired in 2014, and went to the Navy’s TAP Class and absolutely NONE of this was put out or covered during the class! The first question that you need to ask when you get to a C&P appointment is whether the doctor has veiwed your medical record. It was like a bad joke when I discovered that VA had sent me on four exams and not provided my record once. Each time, the doctor denied the existence of conditions that had decades worth of medical imaging confirming their existence. My claim was subsequently denied because the C&P examination held greater weight with the ratings specialists than years of medical imaging and testing did. After my lawyers caught wind of it, I received a P&T rating letter in the mail. Sometimes the vet is leaving out part of the story, and sometimes VA is corrupt.

The guy who replied understand who you are dealing with is absolutely right. The VA raters may not even have expertise in the body system youre being rated for to begin with. Smart money says take your own records into the C and P exam and make the doctor look at them. Take a recording device and let him know your using it. The "skip-over" of complicit fraud within the system in this video is glaring. That kick the can down the road explains the 'what" of the issue, not the "how'' behind the issue of fraud.

Yup, this happened to me. Doc didn't have my file and denied that I had broken my foot despite the medical report. VA denied my claim and its an uphill fight to rectify it.

You must not have a condition that implicates DIC. Otherwise, you would most certainly be filing another claim.

They screwed my disability and finally the doctor said it will not be considered. I told her that I will press for malpractice cause I never even got therapy, ortho, or an MRI. She refused to give me proper medical treatment cause my knee kept giving out and CP exam said I was faking the pain, and that it was all in my head, but my MRI reveals a severed ligament and said it was an improvement. I was about to sue and she said I can't sue the VA. Guess what? Get an SF95 form, see how fast they change their minds on it. I uncovered Malpractice, Extortion and withholding of medical treatment. They lost a LOT of my files to prevent me from proof. So I fixed their wagon, and showed the proof to a JUDGE. I just now got 70% and getting a form to fill out for unemployability.

Prior acknowledgement to recording the C and P examination wouldve steadied the wagon of corruption and probably saved you time. I'd rather get kicked out of a C and P exam for ostensible "uncooperativeness" than have to fight all the way up the ladder - I'm guessing it took you years to achieve your 70%.

Went for a increase for both uppers one got a increase the other a reduction was recommended then after i uploaded a affidavit they re-did the award with no mention of a reduction then i get a c&p i went i asked the examiner this must be a reduction exam the examiner said building 9500 asked for this exam - Examiner asked one question i answered it told me that was all i paused then i started telling him about my left arm pain for about ten minutes good thing i did he service connected my left ulner nerve with my finger at moderate level stating likely related to my SC radiculopathy building 9500 didn't reduce my rating plus they didn't even grant the claim as secondary to my radiculopathy so i filed the claim for the condition waiting on the answer now - I learned from your video never let the examiner control the examination good video as usual SIR !!!

Dewayne, you are a blessing! You provide so much valuable VA information to veterans and spouses. As you know, when I retired from the Air Force in 2001, social media for the VA did not exist, and retirees could not receive retired pay and VA Compensation until Jan 1, 2004. Thank God, I knew enough to get compensated starting in Feb 2007 due to an appeal that was granted Aug 2015. I tell people that my appeal was in a black hole at the BVA. I was only getting 40% prior to Feb 2007, but I received some VA benefits, hiring preference and dependents Compensation. Now, veterans and spouses can easily be educated and not frustrated by watching your videos. God is good! Nothing more disenfranchising than being at the VA benefits center and hearing from around the corner a benefits representative talking in kinship language to a member of the same service about how much he can get him in disability - and then having a different service rep tell you after 25 years out of the service that ur claims are maybe worth 20%, and how he had to wait 15 years to get to 100%. But waited 15 years while working up to a second GS retirement to go along with his 20 years military retirement. I call this nothing short of dereliction of duty and a breach of public service. Moreover, fraud. There was no deference given to me having provable service connected disabilities and the suffering I endure without the knowledge of even having service connected benefits (Cold War Era) since that info wasn't really shared to all veterans alike.

I have been at 80% for 7 years nd I waited until now to file new claims. I learned about the 5 year and 10 year rule and left well enough alone. When they say don't poke the bear, they mean it. Especially if you get 100%, don't file any new claims.

.......based on the current and ongoing Yale lawsuit for the admissions of racially biased handing out of VA disability awards for decades to a certain racial class of veterans, all based on the VAs own admission that culminated from a FOIA request, that had to go to federal court for the release of information - I think poking the bear is absolutely the correct measure to take.

DJ thanks for talking about this especially 4# I had been contacted about a contractor C&P appointment. I called to find out what it was for they told me it was for my knee. I called a few times over 3 days and was told it was for my knee. Well the doctors office I looked up on google said it was a back Dr. I called them back to verify and the lady apologized and said no sir it’s for your back. I was glad I caught this because I was doing research on my knee.

Your denial was based off of a numbers game. There is just so much to go around. Then factor in the fraud of some service members in trying to obtain a non-viable VA disability service connection, factored in with VA fraud as well, and that's what's going on. Just don't give up because no one in the VA would care a bit if you decide to. Contact your U.S. senator - we pay their check. They govern the Dept. Of Veteran Affairs.

Okay, "2" I was never reassessed for my PTSD, I applied for an increase 90 to 100, being 100 IU. I used my medical record to show a decline in my mental health. They reduced me to 80, stated I haven't complained lately so thats an improvement. The preparer said "that was a slap on the wrist" I was/am so confused. Palo Alto, Ca VA btw. Im currently fighting VOC rehab for education benefits. Im on my second appeal. Smh Thanks for all the transparency. I've loss a friend to suicide after he dealt with the VA. Did you show you met the 100 percent criteria from the VA's rating scheduler. Where did it state "you didn't complain enough", in the rating decision, C & P exam or was it noted on the rating code sheet in the special notation box. We as veterans have to ensure we are educated on what we did, and how the VA responded based on all the evidence. Thanks for the support to the channel. Don't give up the fight. The VA 'ASSumes' a Vets condition from 1 single C&P but never validates any of it with second opinions from DOCTORS that DO NOT work for the VA. The game is rigged, wake up VETS!

@@DewayneKimble "Note: The evaluation of headaches (claimed as migraines) with vertigo (claimed as vertigo secondary to migraines and/or tinnitus) currently evaluated 30 percent disabling, is decreased to 0 percent effective August 10, 2015. The date the VA examination showed your condition improved. Be advised we did not provided [sic] you with due process as per VA guidelines it is not a requirement because your benefit payment remains unchanged. Your overall or combined rating is 80% service connected..." This makes no sense to me. No evaluation was taken, and aint no way things improved because eight plus years later it has only got worse. Headaches and school bells come like clockwork. Any advise?

I am a retired military and corporate attorney. I am also a 100% P & T disabled veteran. Even with my vast legal and research experience, VA denied my claim, and eventually low-balled my claims. Obviously, the VA rater didn't see or ignored my military and civilian medical records that I submitted. The VA contracted doctor never read, or asked me any detailed medical questions during my C & P exam. In short, after years, I requested an appeal hearing at my local VA Regional Office. After 10 minutes of a recorded hearing at the VA Regional Office, my appeal hearing was completed by a Senior VA Rater. About 30 days later, I received the 8 1/2 by 11 yellow envelope from the VA Regional Office. I was granted 100% P & T and SMC! Quite frankly, I was shocked to later find out how many claims in one day a VA Rater had to complete to meet VA processing goals. And, the lack of knowledge and training of VA Raters!

Hmmmmph. You think maybe the VA might've looked at your overall financial need compared to other veterans who may be homeless or on the verge of homelessness as a factor? I'm not suggesting it makes a difference to your service to country or disabilities from the occurrence of service to country. There's only so much money to go around though, right? Also, you being a corporate attorney, and presumably well versed in regards to high-stakes gamesmanship in the business world, do you think that the recorded hearing may have had something to do with that 30 day favorable decision? Proof of evidence, say that may point to fraud in a tax-based, congressional codified, allocation system to those who serve their country?

Often times VA raters fail to apply the correct the 38 CFR for their claim. Also, many veterans fail to do their own due dilience with their claims folder and understand the process. Send in a your claim(s) in its entirety and not muddy the waters!! Great video brother!!! You are one of the few around that I truly have respect for.

better yet, veterans start forwarding mail to your U.S. senator - thats when the teeth in the bite occurs. Service to country is a politicians game anyway.; afterall, how many of us veterans actually declare an act of war or sign a treaty? It is ultimately incumbent upon our political leaders to ensure our rightful payment to service to country.

Question. What is the “rule” that is used as a deciding factors on a claim when the CFR for the condition has “or” between the criteria? Example… asthma for 100% rating requires a FEV-1 to be a certain percentage “or” a certain number of incapacitating episodes in a period of time “or” a prescribed high daily dose of corticosteroids. If you met just one of those criteria would that be used to award the 100 % rating or would they lessen your rating to the level that you meet all of the criteria? Thank you!

My question is does a "proposal to reduce" always happen? I filed for an increase for mental health for less than 5 years and received a proposal to reduce letter back in Dec 2022. As of today my rating is still the same and has not been reduced. But I do have a virtual hearing about the proposal next month to fight the proposal and increase.

A friend of mine was connected for back pain LBP. She went to a C&P exam for something unrelated & the examiner asked her how she was/if she was in pain. She responded “no”. The VA took away her rating for LBP & she had to start her journey to 100% all over again.

I just got 100% P&T a month ago for PTSD and I'm still unsure if I should be worried about them reducing it. The therapy, pills, and not having to worry about employment is helping a great deal, but I'm afraid if I tell my therapist this, they might reduce me, which would trigger all the anxiety again.

I used all the information to include VA regulation to help me service connect the veteran. Yes, if the vet had evidence from a private physician that was not on the C & P exam, I would input it to give the higher percentage. I had a knee issue on active duty where it would keep getting swollen and painful. 6 pages of in-service medical records on it. Never got diagnosed with the cause. 2 years after ets civilian dr found an inch-long tear in my meniscus. Had a mediastinoscope and I was good for a few years. In the national guard a couple years after surgery I had an annual check-up which did not indicate any knee pain. Now later in life, I have knee pain again. VA denied the claim using the National Guard exam as the reason it was not service-connected. The C&P dr did not believe I had the surgery since the small scars on my knew were not even visible after 20 years and he tried to say they did not do that type of surgery in the '90s. That dr had no idea what he was talking about. At the time I did not know I could do a higher-level review of my claim and bring these issues up so I am saying all this to bring home the idea that you really do have to educate yourself on how the system works. I am now 100% P&T for PTSD and never did get my knee service-connected however, I am not going to file any more claims as it makes no sense to at the rating I am at. I still get medical treatment for my knee at the VA and that is what counts. Good luck to all my fellow vets and don't give up.

My question is that P & T prevents you from working, periodically, if you wanted to - say for the Christmas holiday, is that right? Ok so that was the shut-up and just go away mechanism employed within the VA. How long did it take to get your rating? I am a firm believer that the system just cant afford to allocate monies to veterans in a unassuming fashion from day one, because admit it, like it or not, there are some in our constituency who do intend on frauding the government - and we all pay. With that beingo, due diligence is the one attribute that one has to maintain in seeking the justice of repayment to service to country.

Well done! Good Information. Dewayne, I received an increase for one of my ratings (COPD) two years ago. If my condition continues to deteriorate, are you recommending I wait until 5 years to request another increase (in order to minimize the risk of being reduced for some odd reason?

I currently have a higher level review in process since 2 May 23. I was rated at 30% Inhalation anti-inflammatory medication. I have a PT on record of 40% FEV-1 pred and currently take Xolair injection once a month for urticaria and asthma which is in my service records. These findings should take me to 60%. Am I missing something? I'm confused??

Kimble I have a question. When I first got SC at 70% to 90% they automatically put me on iU status. I never asked for it, they just deemed it with all my SC rating, so I was practically getting paid at 100% when I wasn’t. Once I got my 5 year re eval I went from 90-100% and it stated no future eval. How often would u PT someone but just looking through their med records ?

As a retired rater, I've never seen IU get granted automatically but inferred and then the veteran has to put in a claim for it. It's a combination of evidence when it comes to IU.

Wow! This is such a GREAT question! You didn't get evaluated, but got ur 100% TDIU and P/T. I have questions for you sir. How long did you wait, how long did you serve, what branch of the service did you serve? AND, do you have any VA service connected disabilities that could warrant a possibility of DIC? I equally find it amazing that a retired VA rater simply never heard of such a thing.

@@teaaet1 US Army from 05-09. Served 4.5 years all in a mechanized unit. Right after basic Was assigned to 4th infantry division out of Ft Hood and deployed straight to Iraq. Deployed a month after because my unit was already in country. 6 months into my deployment I was told I was going to be stop loss. Ended up extending for another year in a half. My unit ended up demobilizing to ft Carson when we got back to the states. If I wanted to stay with that same unit i was told I needed to reenlist another 3 years. I chose to go to another unit at hood and the catch was I would be deploying right back to Iraq the following year so I chose that route. So i deployed end of 05-06 then redeployed from 07- end of 08. Served 2.5 years as an E-5. During my ets transitional phase, I personally went to go get my med records and requested 2 physical hard copies. I also took the initiative to file for VA compensation 1-2 months prior getting out. When I got home, i got set up into the VA system and luckily I had a very very good case manager that took care of me. Long story short, had I not met with a VA case manager, I would have waited most likely 2 years. He made a call and it took about 2-3 months until I got my c&p exam. So total time from getting out and getting myself into the VA system about a year until I got SC. 70% IU the first time around. At the time I didn’t notice the IU status. Every VA appointment I went to during the first year I would carry my medical records with me everywhere. I would very fortunate one afternoon after my appointment when the VA was holding some type of job fair for vets with booths set up and what not. I was happy with my 70% up until a DAV rep stopped me as I was walking by and asked me if I was SC. We made small talk n once I told him i Carried around my military med records anytime I’m on a VA site, he asked me if he can take a quick glance at it. Once he quickly skimmed through it, he told me, “ dude, why did you not file for such and such. You need to file for this, this, and etc. Then told me I did not deserve to be at 70%. That I need to be or aiming at least 90% or more. He then asked me if he can help file on my behalf. I said ok and a year later i ended up at 90%. Few years after I landed a Va pathways internship n ended up working at VA long beach in Southern California. I don’t remember how it was brought up with a coworker but when I told him I was 90%, he wanted to see. Him being knowledgeable with VA math told me I need to shoot for 100%. By VA math he told me I was at 94%. I don’t know how he got that number but once I heard that, I tried to file myself and my status was “in progress” for about a year. I decided to reach out to a VSO rep to see why I was stuck on that status. VSO rep told me I filed it wrong but it will work on my favor because it can be fixed n end up getting back pay from the time it was filed. VSO rep fixed n filed for a secondary on my left knee and results came back within 3 weeks deeming my left knee should be primary not secondary. They discovered that I was seen numerous times during my time in service and also had MRIs on that knee. Got the 100% then when my 5 year re eval came, I was bumped to 100% P&T with no future evaluation. Moral of the story is when I was going to my VA appointments, I mostly cared about getting the right care I needed to get myself better, Mentally and physically. If you have all your documents in line, vso or dav reps love that. That’s more than half the battle won and they would love to help you out without hesitation. If you go to a rep without any documents, you are fighting an uphill battle. Sorry for the long comment. I know some of the stuff I said are irrelevant but Hopefully some of the things I said at least made some sense. I was a 19D cavalry scout. When I was first SC, I was 23-24 years old. I just turned 37 literally 5 days ago.

@@FMD023 Kudos to you for the due diligence and service to country. That's a phrase overstated, but truly meant veteran to veteran. Your story tells of diligence through the ups and downs of VA claims filing. Fortunately you were able to secure rightful VA benefits and employment as is meant to be for those injured in service to country. The compelling argument is that it's deserved amenities we all deserve - education, housing, healthcare and monies. Unfortunately, it doesn't always work out as such. The 90s and 2000s provided the Internet and a notification of VA entitlements to veterans more readily than those Cold War veterans who sustained injuries, most likely at a lower rate than those subsequent veterans. And unfortunately too, there's a willingness of some VA benefits officers and VSOs to not offer-up the rightful info in a "duty to assist" manner. We're ALL veterans and deserve are benefits if injured in duty to country. I won't spend time bashing any particular agencies, other than the VA for the ostensible rife biased outcomes to particular era of service veterans. I'll also make note of the apparent statistical data released by the VA via FOIA request/lawsuit, that suggest there also exist a "fixed deck" wherein regarding minority veterans and the allocation of our rightful benefits. This is a sham and a shameless tragedy to veterans who incurred life altering mental and physical issues. Again thank you for your service and the info given.

@DewayneKimble I have a question for you pertaining to a VA rating for well over 13 years. I had back surgery done in 2011 was rated at 40%. I filed for an increase in December 2022 or January 2023 due to more severe pain in the lower back. I went to one C&P exam in March 2023 was reduced to 20% now my overall is still 100% with unemployability and permanent in total. But I’m curious as to how could this brand new examiner, who only been doing it for 30 days recommend that my back gets reduced over possibly having a little bit of improvement on that day? How can this be plausible if I’m supposed to have two confirmed C&P‘s that show improvement? Do I have any recourse?

What does it mean when you file a claim but don't get a C&P exam? The VA originally done a back x-ray for back problems right after I got out of service. I later had a follow-up MRI by private doctor and the condition had gotten worse. There was no C& P exam scheduled for that claim but they did schedule exams for other claims. I'm assuming this was because even though the VA discovered my back problems, they never noted the condition on my problems list and I was never treated for this condition. Is this correct? The claim is still processing but I figured it would get denied since I'm not currently seeking treatment for it and never have.

Good evening. I am in need of guidance. When I was inducted into the US ARMY in 1979 the doctor noted on my entrance exam that I had bi-lateral flat feet. Knowing this, of course the US ARMY accepted me. In 2020 I filed a claim for bi-lateral flat feet, uploaded notes from podiatrist, xrays and letter describing the agony I experience daily. It was denied so I filed an appeal, which was also denied. Covid-19 comes in and doctor's visits are halted. I filed again in June 2023 with new evidence, more detail from new podiatrist and another personal letter. The podiatrist also included bilateral ankle problems. I received notice today that bilateral ankle was denied. I have not heard anything regarding the second filing of bilateral flat feet. What would you do?

It was so hard to get rated at all. The va wanted me to be labeled as adjustment disorder over and over again. Finally got 70% and a homeless vet but I couldn't get rated for things that I was being med boarded for bc they wanted me to magically travel from austin texas to temple texas. I have a ton more things going wrong and I know for a fact it is becuase of my other non certified disabilities and for my ptsd... ive always been afraid of trying to get to 100% bc i dont want to loose the 70% i depend on to not be homeless. Im absolutely unable to hold a job... is it worth the potential uphill battle? Or should i keep being thankful about the 70% amd suck it up?

@@DewayneKimble Well 70 for ptsd and I have been on a cane since 2011, plus ibs, gurd, back pain, migraines, and moderate to severe sleep apnea that was diagnosed while active... yea pretty sure I meet the criteria but I am totally afraid because any interaction with the va has been beyond subpar and I don't want to loose the 70%. I feel like a tdiu would open me up to more potential hijacking by va staff etc (I couldn't even get a reduced fare bus pass, and I use a cane)

If nothing else its called GULF WAR Or under some other act they have out for burn pits and such. Get that documented a LOT. I stay away from doctors too, caught mine with malpractice cause she tried having my service connection removed from consideration after making a LOT of noise about the pain. Oh, I taught them a lesson they won't soon forget! SF 95 if they put you on a removal consideration list.

Dewayne, CAN YOU PLEASE MAKE A VIDEO ABOUT THIS No one is talking about this, but it's so important: Filing a claim to change service-connected condition from non-static to STATIC (permanent)!!! Most of u are aware it's like filing a regular claim, but what helps raters? How do raters determine it should be static? Or even better: how can we educate ourselves, and fight back raters to adjust a rating to permanent! I'm surprised few people talk about this! Yet it's vital to protect our ratings!!! If your PTSD doctor says that you should have a higher rating than 80%. I would ask for an increase. Asking for an increase just for high blood pressure, I wouldn't risk it. Especially given a fact that you have IU given you 100%

There is NO 80% rating for PTSD. The two highest ratings for PTSD are 70%-100%

Hello Mr. Kimble, I recently had a scheduled C&P for Depression when I didn’t file for increase. I unknowingly went anyway. It was diagnosed at the same percentage (70%). What I didn’t realize is that it took on a new date. Is there anything I can do about that since I never filed for increase? Or leave it alone? Btw, I’m 100% TDIU no scheduled appts

It shouldn't be a problem appealing your effective date since the VA has to show proof that you requested an increase.

OHHHHHHHHH NOOOOOOOOOOOOOOOO, did you have an RFE. I've done videos on how to confirm what your showing up for before you go. I have a video on my channel about RFE's. I would have to see the rating code sheet to see how the rater inputted the information. The original effective shouldn't have change but some VA employees do make mistakes. Here is my situation: Rated 50% ptsd over 5yrs, put in increase request and got covid and missed C&P exam and was confirmed and continued at 50%, I informed the VBA of why I missed C&P and did a sup. Claim telling them I had covid and was good reason for missing exam- they scheduled me for exam and that examiner was horrible and said to reduce, can they reduce me off the one exam or do they need two, even though I missed the first one due to covid?

Why would you do a supplemental claim, that wouldn't fall under that. The examiner does not say to reduce, it depends on the boxes that where checked.

@@DewayneKimble ah, ok… I thought the examiner gave their opinion on top of checking boxes. I did talk all about my symptom’s and we covered the issues at hand for 70%…. So, I guess I need to do a FOI request. My biggest question is: does the fact that I got confirmed and continued count towards rating 1 and the negative C&P count as rating number 2 and they can drop me, or do they need 2 negative C&P exams? Or does a confirm and continued count as negative? Thanks for any follow up!!! I’m signed up for your Oct 21st class too

I submitted a claim for an increase under 5 years (before I found your channel). They did decrease my rating instead. I offered supplemental evidence and it was increased back to the original amount. What should I expect moving forward? Does the 5 year start at the most recent decision?

My big issue with this "raters" its that, how in the world they rate medical conditions when they're not licensed or medical inclined??? If they screw someone's claim they should be held accountable and sued as any other licensed rater that are required by law to be licensed, certified and constantly trained to avoid medical malpractice... They "legally" has gotten away with medical malpractice and miss handling medical claims for many years... I'm currently fighting all my primary disabilities due to bad/unsmart raters... They should've left Doctors/physicians handle these matters instead.

I’m 30% service connected. 30 for a shoulder injury and 0 for tinnitus. My shoulder has gotten worse and possibly may need surgery soon. Can I file for an increase in percentage or am I better off leaving it alone? I’ve been SC for close to 15yrs. Thank you for any advice you could provide.

What DK is saying is take a look at the 38 CFR Book C, Schedule For Rating Disabilities, then you can determine what the C&P rating will be basing his decision-making off of. That doesn't necessarily equate to an equitable and fair decision for you though - contact your U.S. senator, those purported to espouse the very tenets of freedom for those who have served their country. Make the contact via an evidenciary trail, not a phone call.

If you have 30% for unspecified depression disorder as a initial claim and then after finally seeing a doctor for it they diagnose it as PTSD, would you as the veteran file for a increase to get 70 or 100% for that or do they automatically change rating based on findings down the road?

SSG US Army, retired. I have a sleep apnea condition that was denied due too I wasn’t diagnosed with it while I was in the Army on active duty. However, I was awarded compensation for PTSD. Can I re file that sleep apnea claim as a secondary to PTSD. I’ve read many reports stating sleep apnea can be caused by PTSD?

Yes..I've tried five times to do the test and each time I wake up and freak out and rip all the stuff off..u have to sleep for eight hours,it's very difficult.Because when I sleep I have sleep apnea

Be sure to do the VA math before you fight for 100% those conditions may not be enough to get you to 100%. There is a chance they reduce you.

The key to 100% is getting any one condition (increased) to at least 70%. After that it’s a matter of other high value claims and claims secondary to conditions you’ve already won.

To @WadeFrick please go to social security. If your child was disabled before his 18th birthday then he is eligible for social security benefits. Please call your local social security office and also speak with a social worker who may help you fill out the papers. If you are an American 🇺🇸 veteran, there are social workers and other organizations that work with American veterans.

I’m 100% P&T with 70% PTSD. Since receiving my PTSD rating in 2021, it’s become a lot worse. Considering the examples you gave, is it wise to file for an increase in an attempt to go for SMC pay?

hi dewayne love your channel!! question... So I am finally 100p&t but will i have to keep getting check ups with my primary care provider in order to avoid a reduction? I ask because I keep hearing if you dont keep seeing your care provider then its grounds for them to reduce you due to the fact that its considered "improvement". I also after being 100P&T they still call you in for a C&P exam however, I have not actually met anyone thats happened to. Is this a myth?

I got re-evaluated for PTSD a month after I was rated on my initial claim was rated 50% PTSD. The claim was still open with several things deferred, a few declined and a few service connected. When the C&P was scheduled, I called the VA 800 number and was told it was for Weight Gain, which the rater added for the deferred Sleep Apnea condition. However, the C&P examiner doctor said he was evaluating me for PTSD as well because it was for an increase? WTF I never requested an increase and just got my rating. It was a horrible experience that I had to re-live. I am paranoid and worried I'll be reduced because I was unprepared and caught off guard. Also, he went on to tell me BEFORE we started that VA is trying to avoid connecting Sleep Apnea so don't count on it.

So I have a few questions ,I don't know if you will see this comment or you can answer them but one when I lived on the west coast I never received a letter from the VA yearly showing me what my disability rating was, all of a sudden when I moved to Michigan I get a letter from the VA out of Janesville Wisconsin showing me what my disability rating is, now they do show me 80 as unemployable however that's the incorrect rating although unemployable gives me 100% my actual rating is 90% unemployable and when you go to Washington DC's website for the VA it shows the correct rating so why does the VA out of Wisconsin show something different?, I was also told not to challenge the VA out of Wisconsin or they may open a new case
