I was pulled over because I came out a liquor store on Sunday at 4:00pm. He followed me for three blocks. The reason? Because I just came out of a liquor store. No driving violations, just the liquor store. He said he knew I wasn’t impaired after talking to me, but still demanded me to blow. I blew 0.00. He and his supervisor told me they were mandated to make everyone whom they stopped to blow. ANY TRAFFIC STOP. Fascism in Canada is making a move.

I imagine this rule came into affect after a cop let a drunk driver through a checkpoint or after stopping a car/truck they let them go and then they were subsequently found to be intoxicated after a crash. That I could see would lead to dumb rules like this. Someone screwed up so badly that this happened. I have worked construction where ppl died and things like traffic control ended up with every single driver being read rules, regs, and vehicle tested before entering site. Some times 5 to 10 times a day for same truck. It got pretty tedious but was strickly enforced both by city and by companies involved. So yes ppl do have to mess up pretty badly for these sort of rules to exist.

Lawmakers probably thought that *talking* on a hands-free cell phone would be like talking to someone sitting in the car with you. I suppose that's valid. I had a conversation with a guy who was a friend of a cop who drove drunk all the time. He said his friend the cop would flash his headlights a certain way when approaching a police checkpoint and drunk and they'd just wave him through.

I was a designated driver at a RCMP ball and was waiting outside for 2 members to take them home. Cops outside told me to leave my car/keys and walk home in the middle of winter. Wouldn't even let me go in and tell the members I was being told to leave without them. No reason other than I was a civilian hanging around other cops.

I am counsel on a constitutional challenge to these laws which has been ongoing for 5 years. The most important element, which a judge has now ruled to be unconstitutional, is a provision where the police can take a breath sample more than 2 hours after driving and the law provides a mandatory calculation of that number into the time of offence. This provision applies whether they are 1 hour or 11 hours late in obtaining the breath test. You can be 2 hours home from driving after a minor driving incident, enjoy some wine with your meal, and police can knock on your door, demand the breath, and the law concludes this was your level of impairment when driving. AMA.

Man, so during covid I ran out of money and was ordered to stay home for a few weeks. I was at the point where I couldn't make mortgage, and wasn't allowed anywhere at work here due to snitches. So I took a job on a ranch in the middle of nowhere. It was bigger than I expected. My insurance on my truck/ trailer were nearly expired but I spent the money on gas and food to get to the job. Should've been able to finish it and come home in time, but it was larger than I was lead to expect. So, on my way home, I got pulled over because my insurance had expired a couple days prior. The red light cameras apparently run every license every time. Cop was dispatched to pull me over by his computer. That's a 10k fine in alberta, and a mandatory court appearance! FOR A FIRST OFFENSE!!!! the same fine in my home province? Like 400$.

There are plenty of drivers on the the road that should have their licenses revoked and they are stone sober. The problem with DUI laws is they set one bar for everyone. Blood alcohol content. Not everyone reacts the same way. If you want to make it fair they should be testing reaction time. There are so called impaired drivers out there with better reaction times than some who are sober. And there is such a thing as taking things too far which is the territory we are currently in. I think first time offenders should be subject to a fine. Habitual multi time offenders should do jail time. Also not all of the population lives in large urban centers with enty of other means of public transportation. This means when someone looses their license it could also mean losing their livelihood which is taking it too far. DUI is a situation where you can be arrested, convicted, financially penalized and thrown in jail to do time without actually having harmed a single soul. That seems a little unfair.

If you're home for 2 hours after driving, that gives a sober driver enough time to get drunk on a Friday night after driving, so how is that fair? That's just stupid. That's just a way for them to go around the burden of proof, a totally innocent person can now be charged with impaired driving.

Regarding THC in the blood, the metabolites stay in your system for a month and a half. Have they gotten with the times and started using a swab test? That shows use in the last 24 hours or so. That would be much more appropriate than considering someone impaired when they smoked a joint last month on vacation.

As well as the whole breath sample thing. If a person does attempt to provide a breath sample and they can't do it, they should be allowed to do a blood sample. No way my dad would be able to provide enough air for one.

In sask they just pull you over if they don’t like the way you look and make you swab and blow. I failed 12 hours after smoking. Didn’t commit a traffic offence.. clearly was sober. DUI on my record now. Feel violated

Saw a video where two Chinese were in a vehicle together in Washington, driver was drunk and crashed, killed the passenger, then fled back to China, and people were mad that the person “got away”. Quick story for you since you mentioned old ladies. Back in the 90's my elderly mother, a devote catholic, was driving 3 elderly nuns (wearing their habits of course) somewhere and came across a RIDE program. The officer looked in the window and said wit a big smile on his face 'Been drinking ladies? Okay, on your way' without even waiting for an answer. One of the nuns who I believe was 90 or very close to it said 'Wait! I want to try the breathalyzer thing!' He laughed but she insisted and he let her do it! She passed and they all had a good laugh and they went on there way. Probably couldn't happen now, there would be videos posted everywhere of it but my mom had great story about it! 😁 Thanks for doing these, very appreciated!

The easiest way to deal with impaired driving is to take an Uber. You won't have to know any of the drinking driving laws or have to spend thousands of dollars on a lawyer or lose your job.

The problem is that they can charge you with impaired driving, without you ever being in a vehicle, stopped or driving. Cue all the dirty cops that think this is a great idea. You used an uber or taxi, good for you, I applaud you. The cop says "I think he was driving." Now you have to go to court and prove that you weren't. Thats not innocent until proven guilty. Thats why these laws are so scary.

@zebatov Seriously, the only time the average working stiff deals with the police is when you are driving a vehicle. Driving home drunk is a crime. Taking an Uber home (regardless of cost) eliminates the stress of having to deal with the police or to even know all the legalities of drinking and driving. Peace of mind thing.

DUI is the low hanging fruit of the law enforcement world. Canadian police clearance rates on major crimes are in the toilet, and minor crime clearance rates are even WORSE (if they even actually get investigated), so they have to have SOMETHING they can get a bunch of convictions for in order to make themselves look effective enough at at least ONE thing that the taxpayers don't revolt and demand defunding them.

We never charged anyone that blew under .1 unless there an injury accident. The procedures in law heavily favored the accused/suspect, it made for lots of work for lawyers. Our neighbours to the south removed your ability to talk to a lawyer before you blow, the law says you have to provide a sample so lets go., some states replaced it under State law, others did not. In Alberta we no longer use Criminal impaired charges so there is a big change. We now use Provincial Law which has been streamlined to some extent.

My maternal grandfather was killed on his Harley Davidson on Vancouver island, on the stretch of road coming out of port Alberni, he was struck off the road on the side that had a sheer rock cliff. I never got to meet him so this would’ve been about 1998 or so, they never caught the guy but it was suspected to be a drunk driver. (They could see the fresh tire tracks)

Always good info. I have never had a breathalyzer, so i ask: is there a disposable mouthpiece used for each test? Is that mouthpiece in any way associated with the person who did the test? I ask because since anyone can be required to take such a test, it seems a great way to build a DNA database.

Saskatchewan has zero tolerance, any thc or alcohol is a life suspension from driving. Drinking or smoking a day after driving can also get a life ban, and they can come into your residence at any time to check.

Ive had 6 DUI and lost my license for 10 years on my last time and I haven't renewed because its expensive and I need to be probationary for 2 years. ALL my time served was total under 2 years and few fines really. All by the way were when I was under 35 yr old but I still drive today its been over 12 years but I don't drink anymore. Never had an accident or tickets for anything just spot checks after work as we always had a few beers when done work. I think the laws should be stricter and fines higher. I have to drive to live and support my wife who is ill if I get caught its a fine I asked a cop so hopefully that day wont come Im 66 now and am super careful thanks to GOD in my life.
