Why is it that women can't be sued for fraud involving child support? The law forces the man to pay for a child that is not his,he should be able to turn around and sue her for damages. Damages including anything that was incurred before the divorce. Everything that you paid for for that child should be reimbursed. The courts can figure out how much to charge when the man doesn't have a job, they can figure out some random amount of damages too. Minimum 100k for emotional abuse. Make her pay for therapy too.

Fraud is a criminal offence. Get your lawyer to make a complaint to police. You need evidence of the false statement that there is no other potential father. I'm sure there will usually be a text, comment in medical records etc. Criminal fraud is a false statement main for personal gains. The problem will be statute of limitations and police unwillingness to investigate or charge. That's why you need a lawyer to present it in a format that they can't decline.

In California a man also only has 30 days to contest a "finding of paternity" on a birth certificate or in a court document. The women can give an old address (purposely) and it is more or less a certainty that by the time the man is actually apprised of the fact that he has been named as a father the 30 days has elapsed.

The problem is the system does not prioritise equality or fairness over 'in status quo' The starting point should be 50/50 custody. That is in the best interest of the child. Anyone arguing against it should be challenged and realise their professional licence is vulnerable to a complaint if they can't justify their opinion. It then follows that both patents can provide care, maintain a house and work. The current position needs challenging at multiple points. The policies are fundamentally wrong.

Family courts in the Midwest have earned the reputation of favoring the female perspective. She can get the kids, the house, the better vehicle plus monthly money.
