I worked in the County Courts between 2001 and 2016, and I can confirm everything you have said is spot on. I would just add that at the time I left, the County Courts were authorised to accept receipt of claims where the Limitation Act would apply within 1 week. We would simply stamp it as received as per the practice direction you referred to, and forward it on to the Northampton County Court Bulk Centre to process.

Thank you fo that comment - its good to know what is helpful. Yes, I want to do more of client case studies and will be pushing that, as and when I can persuade clients to go on a podcast! But should have one or two coming up, one on Homes England and what appears to be a bit of a scandal, rising rent clauses in leases and people being unable to redeem their mortgages in shared ownership cases.

Thank you for your comment. I first started the channel during the PPI financial mis-selling scandal back in the day - and ended up on "Rip Off, Britain!" would you believe ;) I wanted to throw a light on this murky world and make it clear. Now things have come on and it is great to see so many comments and many clients coming almost exclusively via the channel. I have recently decided our marketing strategy for the mid-term is focusing on existing clients and active enquiries. 16 minutes in and I am finding gem after gem. I'm going to start legal proceedings by myself against a former legal aid representative that was not only negligent but sabotaged the case (which I can prove)..... and there are so many helpful tips of what to do and what to expect with a claim and court proceedings. Thank you

In my two short stints in Sheriff's court in Scotland 20 years ago.. I found it VERY interesting! I did a Summary Cause and a Small Claims and both times, the Sheriff chastised the solicitors brutally whereas he treated the party litigant as he should - sympathetic to them being largely ignorant of procedure. 😂 I couldn't believe how brutal they were to the solicitors especially the juniors.

Yes, a judge on a bad day can come as a real shock - to solicitors as well as LIPs! I am wondering whether to do a vlog on the mental preparation side for hearing ....

i am a LIP. Had a CMC hearing recently. Defendant's counsel made untrue statements to the Court. Appealed using N161, granted permission to appeal based on the proof i sent to the court in respect of said untrue statements. Have a hearing in Jan23. What comments to the Defendant's Counsel is the Circuit judge likely to make? Will the Defendant put forward a different barrister or am i likely to meet up with the same barrister, which is what i want?

How did it go ? I am in the same position with the addition of a solicitor using a false name for reserved legal activities. I already pointed out untrue statements in the hearing which was supported by a registrars order ( without merit ) but the Judge ignored it.

I have been denied a fair hearing and made to represent myself even though I was not well enough to do so and I feel the courts are corrupt

You've got this! We are often stronger than we think. :) And yes, one can only hope. Until a big change comes, we have to make do with what we've got.

Fee Remission: Technically, the fee is not "waived", if the Fee Remission is approved, the fee is paid by the Tax Payer. For this reason, Court Officer's must be very strict about the evidence that is supplied before authorising the Fee Remission. Litigants who falsely believe the fee is waived, sometimes expect a Court Officer to bend the rules for them.

What are the procedures of servicing of papers to a defendant

Just normal post is fine. When you issue the court will serve for you if you give them copies of your claim. Service by hand is only necessary in exceptional cases.

I have a non mel order representing myself & yet i still need contact the ex headache dispite not being able contact her . Unable prove anything she as claimed and still gets the order granted , not accepting the order and keeping my head up the lying ex can get done for lying in court & i hope she losses her career from it too
