Sir, at 23:02 you have explained that Home Buyers are required to be atleast 10% of the total or 100 which ever is less. Also it is explicitly mentioned in the notes that single home buyer cannot file an application for CIRP. My query is if there are total 10 Home Buyers and their total default has exceeded 1 crore then if we calculate 10% of 10 or 100 it comes to 1 home buyer. Now can that 1 home buyer can file application for CIRP. Sir I have also emailed my query to you.

Hey Real estate allotee are covered in definition of financial creditor & Financial creditor can file case if CD has default of 1cr Any FC application file kr skta h chahe 1cr ka default use na ho bs CD ka default 1 cr hona chahiye REMEMBER. FC can file case even operationl debt due is 1 Cr So 1 real estate allotee kr skta h qk cd ka default 1 cr h

@@priyanka08944 Please read the provisions of IBC again with regards to the financial creditors. As per the proviso to Section 7 (1) which includes homebuyers [clauses (a) and (b) of sub-section (6A) of section 21]. Law says "single homebuyer" even being a FC cannot file any application for initiating CIRP even if the default is 1 crore or above, it has to meet the requirements of law i.e. joint application shall be filed by (atleast 10% of the total or 100 which ever is less).

Sir, 48:05 Section 10A you explained ki Section 10A ki 2 crore happened during covid I cannot file CIRP during that suspension period - that is clear but you said that ki uske baad i.e after the suspension period I can claim and if not settled I can even file CIRP is it in line with Proviso to section 10A which states as follows "Provided that no application shall ever be filed for initiation of corporate insolvency resolution process of a corporate debtor for the said default occurring during the said period" - Anyone is free to answer please
