Two significant verdicts came out this week - In Kolkata, Sanjoy Roy who sexually assaulted and murdered a doctor in RG Kar Medical College Hospital, was given life imprisonment. Meanwhile, in Kerala, Greeshma who murdered her romantic partner Sharon, was sentenced to death. While both the courts relied on the same Supreme Court guidelines on awarding punishment, the judgements differ. This raises a bunch of questions; how are punishments decided? What are the criteria to award a death penalty? What is a ‘rarest of rare’ case?
This week’s Let Me Explain is hosted by Editor-in-Chief Dhanya Rajendran, and she reads both the judgments closely and explains the nuances.

If lust is not a motive for murder..Then why was the doctor killed so brutally and inhumanly? We should blame the crime on lust and alcohol, and leave it at that? What kind of a message does it send to the society?

Totally agree. There is a thin line between revernge and justice. Revenge is biased and based on personal emotions but justice should be unbiased and impartial.

Both are different cases, in Doctor rape case Sonjay Roy might be a scapegoat, there is a high chance of involvement of other persons in rape as Sonjay was repeatedly saying. But in Soran case where girl poisoned her boyfriend is rarest of the rare case and the girl should be sentenced to death is legitimate to set an example in society otherwise there are number of cases where women commits crime and play victim card. There are already many laws exists to protect women. We don't need new laws but we need reforms in existing laws so that equality can be maintain in the society. Our Judiciary and Government both are corrupt and incapable to handle such cases.

I respect this decision but there has been another case in kerala, the same state where a boyfriend k!lled his ex girlfriend , he did not recieve the same treatment. Does de@th penalty only apply when a woman does it?

What will the judge say if the criminal in the Kolkata case comes out and repeats the same crime? It is not right to release the criminal like that

Greeshma was a very beautiful woman and a university rank holder, known to amaze even her teachers with her brilliance. However, to everyone's shock, she was later accused of being a perpetrator of a heinous crime. She lured Sharon, whom she was in a relationship with, into engaging in sexual intercourse and then gave him pesticide mixed with kashayam (an Ayurvedic medicine). Initially, he refused to drink it, but eventually, he complied because she persuaded him. Sharon suffered greatly after consuming the drink. For 10 agonizing days in the hospital, he couldn’t even drink a drop of water due to the excruciating pain. His brother, who was a doctor, questioned Greeshma about the drink she had given Sharon. She claimed it was something commonly used in their household. Sadly, Sharon passed away, as all his internal organs were severely damaged, including his kidneys, which became dysfunctional. Even his throat had sustained significant damage. While sentencing Greeshma, the judge remarked, "She did not just kill Sharon; she killed love." During the trial, Greeshma remained unscrupulous and appeared indifferent to the judgment. Later, she requested the court's permission to continue her studies and submitted her academic records, but the court refused her request. Sharon, a soft-hearted and loving person, loved Greeshma deeply, even in his final moments. Even in his final moments, he never suspected her. But last chat, retrieved by the police, was heartbreaking: "I love you, Vaave..."😢😢

The basic difference in the two cases is this. Greeshma is a selfish, cunning woman, but not politically powerful, or involved in corruption facilitated by state government. Since she is not supported by corrupt political powers, it is easier to collect evidence against her and give justice to Sharon, which Kerala Police had no major challenge in doing. It is a bunch of mature minds vs one young common woman's criminal mind. she is bound to lose. And she should, for what she did. In R.G.Kar case, the killers are fellow medical interns involved in state government-facilitated medical corruption, which the doctor girl came to know about, and became a threat to those interns and the powers behind them. Here the State government and the police themselves are on the sides of the culprits. I think, later the centre-backed CBI also couldn't do much because of lack of evidence which were efficiently erased by corrupt Kolkata police officials, right after the incident. Thus, if Sanjay Roy (the scapegoat) is put to death, the last hope of truth getting out will also be lost, and the powers behind this crime will feel relief.

The death of the lady doctor in R G Kar Medical College Kolkata is not the handiwork of Sanjoy Roy, who has been convicted now by the judiciary. The doctors and the police which worked overtime to remove all evidence from the scene of crime are the real criminals who are walking free, whereas this Sanjoy is an escape goat of a crime very well planned and executed. This murder speaks of the rotten system of governance in general in West Bengal and the rotten system of governance of the medical administration in West Bengal starting from the CM Mamata Banerjee to the IAS and the office bearers of the Medical Council of West Bengal all are involved in the crime of extortion of money in the name of giving marks in exams, in the giving of certificates, and the allotment of medical equipment in hospitals in west bengal, be it even addmission in the hospital itself, in all these situations mentioned, their is a big racket. Even selling of dead unclaimed bodies, selling organs from unclaimed dead bodies. All these things have been extensively reported in the media, when the reporters were exposing the incident of the mysterious death of the lady doctor of R G Kar Medical College Kolkata.

Everything depends on the way police collect the evidence. Kerala police did that, while in the West Bengal case or in the Arushi's case they didn't. RG kar's judgement was the headline while the Sharon Raj's was in the last page with lesser focus of two small stanzas.

Nirbhaya was also brutal, but still they had to fight for so many years to get death sentence. Same with Kolkata rape case no death sentence and many more examples as shown in the video. Women always have second class citizen treatment in our country. Thats the sad truth..

If the sentencing outcome was reverse, with the man getting a death sentence & the woman a life sentence, would this news channel have the courage to ask a similar question? Shameless journalism 😅

Kolkata rape accused is not convicted to capital punishment could be for another reason. It has political involvement and looks more like an aggravated crime and sanjay Roy clearly is being framed or made a scapegoat. He is only one among the culprits and in order to protect the others, system compensated by giving him a life term than the capital punishment. Nobody wishes to die, no matter what! System is rigged especially that of Mamta's.

Maybe but even with Nirbahaya's case they didn't get capital punishment immediately. In fact a lot of people bktamed the girl . The court was partial to the criminals. The girl's mother and lawyer had to fighr for many years to finally get justice. And what about all the other examples at the end of the video? Women's lives are not taken as seriously men lives in our twisted society .
