Scott Leaver was charged with Common Assault and Public Order offences and was sentenced to a Community Order, three months curfew at his home from 8am - 8pm, and ordered to pay £85 court fines.
Incident near East Putney tube station. The driver performed a dangerous pass as I was about to overtake the parked bus (32 seconds), forcing me to veer left behind the bus. When I caught up with him I looked in the vehicle but did not say or gesture anything. He started the conversation with "what's the matter?" (transcript below)
He does not appear to be aware of the Primary Position. The guidance on Primary Positioning from the Department of Transport is available here: professionals....
Also interesting that towards the end of the video, a man across the road appears to be offering him support - "tell it like it is...arseholes, every single one of them".

Driver: What’s the matter?
Me: That wasn’t good driving mate.
Driver: Hang on, you pulled in front of me, bang in the middle of the road, not pulling to one side, you’re the one in the wrong.
Me: When? At the lights?
Driver: At the lights yeah.
Me: I’m entitled to be there, it’s safer……
Driver: Straight in the middle of the road.
Me: You know you’re on camera mate?
Driver: Do I give a fuck? Pull over.
Driver: Do you think I give a fuck? About your camera?
Me: I’m allowed……
Driver: You, I tell you what you done right, you pulled, you was in front of me at the lights right, and when you went behind the bus, bang in the middle instead of pulling over to the side to let cars past, you decided to stay bang in the fucking middle.
Me: Yeah, that’s the safest……
Driver: No, no, it’s not, you’re in the fucking way of me, so see your camera?
Driver: See that thing there, I’ll stick that right up your fucking arse. Right? Now fucking mess about with me right cunt, you was in my fucking way, right?
Me: I’m entitled to……
Driver: You can put that wherever you fucking want.

First he overtake a cyclist in the same lane right in front of a bus (which easily could have ended up with a collision resulting in the death of the cyclist) and then he goes on about the cyclist being in the middle of the road and not to the side and that the cyclist was in his way and claims the cyclist pulled in front of him, even though the cyclist was in front of him and was in the same lane as him. I don't know where to begin really, but basically everything he did and said is wrong. If he was king and made the rules, I am sure he would be right, but luckily he is not king and do not make any laws or rules on who people should be driving or cycling. Instead, lets look at some actual legal references about this: *Cyclists have a right to claim the lane* It may come as a surprise to most drivers but cyclists have as much right as drivers to take up the entire lane. You will often see cyclists riding side-by-side, and you, as a driver, may think they’re being selfish by doing so. But the fact is the cyclist is actually reducing the risk of having an accident; it’s the safest way for them to cycle, particularly if there’s a blind bend, a narrowing of the road, a high risk junction, pinch point or traffic lights ahead. Cyclists should never cycle in the gutter as it gives no room for avoiding obstacles and leaves no room to fall if an accident occurs, increasing the risk of falling into the road and potentially under the wheels of a vehicle. *Allow plenty of space* When overtaking a cyclist a driver is required to give them as much room as you would a car, where possible. Cyclists may need to swerve to avoid hazards. Drivers should always anticipate that there may be a pothole, oily, wet or icy patch or some other obstruction. Don’t drive too close behind a cyclist as you may not be able to stop in time if they come off their bike or pull up abruptly. Unless you have an entire clear, empty lane in which to pass, slow down and wait until there is room to pass, and do so slowly. *It’s your responsibility as a driver to avoid hitting the cyclist, not the responsibility of the cyclist to avoid getting hit by you.* www.derbyshire.police.uk/Safety-advice/Road-Safety-Vehicle-Security/Cyclists.aspx *When to take the lane* If you can keep up with the traffic, such as around town, it's safest to take the lane. It's also the position to adopt when you want to dissuade drivers from doing something stupid, like cutting you up. K-R J Right but sooo wrong at the same time. Cyclist should not ride side-by-side on busy roads, narrow roads or whilst taking bends. Also, goes without saying that they should consider the road condition before riding side-by-side or single file. *Highway code rule 66*

Space Ghost: So you think the police is wrong do you? Let's look at a reference about Rule 66: *Cyclists are allowed to cycle two abreast!* Rule 66 states you should never cycle more than two abreast, and ride in single file on narrow or busy roads. This means cycles are perfectly legal to cycle side by side on most roads in the UK. Obviously some common sense needs to be used to work out if and when cyclists need to single out to let cars overtake but on the majority of UK roads cycling 2 abreast is allowed. Usually a group of cyclists will shout forward that a car is waiting ("Car Up") and if the road is too narrow for the car to pass the group safely while they are two abreast they will single out. However, if there is enough room but there are oncoming cars preventing the overtake the group will probably not single out. *Why do motorists get annoyed by cyclists two abreast?* There are many reasons why motorists tend to get annoyed so here are a few that I know of: • They think it's harder to overtake • They think it's illegal • They think it's dangerous in general •They think it means cyclists are not paying attention to the road So why do cyclists cycle two abreast? There are many reasons why cyclists choose to cycle two abreast so I'll give you the reasons that I know of. *It's Safer!* Simply put, it's safer for cyclists to ride two abreast, it means that motorists usually have to overtake in a proper manner rather than overtaking in the same lane as the cyclists. If a group of cyclists are in single file, motorists will often assume they can overtake in places which are not safe and will not leave the cyclist enough room. Motorists should give cyclists the same amount of room they would give another car when overaking (please see the Overtaking Cyclists page for more details) which means they should be on the other side of the road and would have to wait until there are no oncoming cars. Being in two files usually forces this scenario but riding in single file can lead the motorist to think they can overtake on the same side of the road if there are oncoming cars thus not giving the cyclist the correct amount of space. It allows motorists to overtake quicker!?! Riding two abreast also allows the motorist to overtake the group of cyclists quicker as there is less distance between the front and rear of the group (about half!!). This means that the motorist is past the group in less time, spending less time on the other side of the road and along side the group of cyclists and therefore safer all round. *It's sociable!* Cyclists out for a long ride will have a much more enjoyable ride if they have someone to talk to, and enjoying the ride is the main point of the ride for most. Most cyclists prefer to have someone to chat with but this does not mean that they are not riding safely, most car drivers will talk to their passengers and this is not regarded as unsafe driving! ukcyclelaws.blogspot.no/p/the-laws-according-to-highway-code.html

K-R J you are so bitter about not having a driving licence it is so obvious. People get annoyed with cyclists because they pay no attention to the rules of the road, they undertake cars run red lights and jump between road and pavements when it suits. You have no insurance so when you squeeze past it traffic and scratch cars worth thousands of pounds you think a sorry is ok, it's not! Then you have the attitude of a wet tired cyclists trying to tell motorists rules of the road when they have had no training of it past no test practical or theory! You don't have any sense of what's around you, you pay no road tax, and most of you not all are cunts

I saw this happen in Cologne, Germany. However, the guy on the bike was punched, but the driver didn't know he was a cop and in seconds the cop pulled his gun, got the driver on the ground, cuffed him, and called back up. It was in the local paper: The driver was given 2 months jail, had the vehicle impounded, banned from driving after release from jail for 6 months, and had to pay €4850 costs. Now, this is instant Karma.

@@Landie_Man I don't drive or cycle. I have cycled in the past though and found myself annoyed with cars but also other cyclists. I definitely think it's 6 of one half a dozen of the other but I think the real problem isn't cyclists or cars but bikes being on the roads. If we're trying to get the country fitter and greener etc build more cycle lanes. I see some areas with little paths or lanes for bikes only but they're few and far between. Bikes off the road win win for everyone.

I recognise the car driver,he’s the fitnesses trainer at my local gym. We both graduated from Oxford, he studied English language and diets. I believe he went on to become the bishop of Cambridge. He’s a very nice man and very articulate, I’ll introduced him to you all delightful chap. Attention to detail always immaculately dressed.

I followed a group of middle aged cyclist on a country road for 3 miles. They could easily gone to single file and let me pass (I was on way to an appointment) but two of them insisted on riding two abreast which put them in the middle of the road. They pulled over to single file for oncoming cars. I'm a chilled guy but after 2 miles at 13 mph I was ready to either take a risk and overtake them on a bend or stop and batter fat guy at front who was the worst offender. Use some commen sense and everyone will be careful and happy

Two things. I agree they should have pulled over and let you pass. However, the Highway Code does say that Cyclists can ride two abreast. That isn’t done to piss you off but is done to protect their safety. I’m sure you would regret it if you knocked one of them off and killed them and then had to avoid dropping the soap in jail.

@@justincooper6340 it's not protecting their safety if it's aggravating a long line of drivers behind them that now need to overtake in an awkward manner. Rule book slinging seldom helps anything. If they had pulled over single file just for a couple of miles then back to two abreast then everything would be fine. It's the same situation with caravans and motorhomes on country roads. They pull over every so often into layby's to ease the traffic behind. Imagine if they said it's safer for me to just continue on because otherwise I have to pull out into moving traffic again.... Use a bit of common courtesy and we'll all be better for it. Sadly the only way anyone is going to do the right thing, is if it's written into that bloomin rulebook.

I agree it would have been courteous to pull in and let you pass. However, given that legally you should give a cyclist 1.5m space when overtaking which, on most roads, means driving on the opposite side of the road, cyclists two abreast are actually easier to overtake as they take up less space along the road. When groups ride together on a long line it’s much harder to find the space and time to overtake.

I appreciate the law but like all laws can be abused. I myself ride a bike everyday and I pull well over when safe to do so. As a motorist I've nearly has a couple of head on crashes when cars coming towards me who have rashly pulled out to overtake cyclists . Think the answer is better roads but no chance of that

Doesn't apply to this video though. Overtaking a bus is completely fine. The only thing I see as weird is how the cyclist overtook on the right at the beginning of the video. I've seen so many videos of this in London so it feels weird for someone living in Australia, to overtake the opp. side of the road in such an urban place.

Why cycle after someone who drives like that? You're not going to convince him with reason and logic. If he was reasonable he wouldn't drive like that in the first place. Obviously motor supremacists don't like being confronted and exposed but, as this video and others like it show, the confrontation worked in favour of the victim because motor supremacists often incriminate themselves. The confrontation is a warning to them and a public safety announcement.

Those roads are normal in town….you have to get used to the danger…and cycle on the pavement if you can or select a longer safer route…but sometimes its unavoidable..bite the bullet and peruse the disability buggys on the net often…

I commute with a bicycle in London, day by day. And I can safely say that the ratio of idiots among cyclists is about the same as among drivers. In this incident, nothing's really wrong, the guy have passed you, maybe a little risky, but not overly dangerous. From the view of the camera, it is obvious that you checked over your shoulder when the bus stopped and saw him overtaking and waited. So what is the fuss about? Just let it go. You ride behind him, catch him, seeking the confrontation and the 4th sentence you say is "you are on the camera!". WTF is this? What good does this do other than provoking him? You are doing nothing good to the cyclists in this city, quite contrary, you are staining the image of cyclists. Do you think he will now become a better, more careful driver or will he have a bigger problem with cyclists, raising the risks for all of us on London's roads. Grow up, get a life!

Agreed. Removing emotion from the discourse: it’s not logical to address any issue on the roadside. You won’t change the person’s manner of driving/riding. It's the first comment I have found that uses full intelligence, what ever has happened you do not confront somebody who is clearly not going to take being told off lightly, he was out of his depth,when you tell someone it's all on camera is a red rag to a bull,use your brain,and pass on the vid if you want to the relevant authorities, they'll decide what to do,not you. Whilst I don't condone what happened, it was instigated by himself...he wasn't hurt, and should be wiser when approaching people who may not take his lesson on the highway code lying down.

Good point Kult38. Poor drivers are often angry people as well. Pursuing them might make for a mildly interesting KZbin clip but really? What does it achieve? I'm a cyclist that uses the canals rather than the roads... The roads are far too dangerous.... Also , if you look at other European countries, they have lots of cycle lanes.. I'm afraid Britain is 30 year behind...

I'm usually on the side of the driver, but the cyclist is in the right here. For one thing, the driver was not wearing a seat belt. Cyclists do not have to move over at that speed as they are not causing an obstruction. The driver would clearly be able to see that the bus was about to stop, but veered past like an idiot (he also crossed into the opposite lane). After all that, the cyclist simply took the index of the vehicle. The driver assaulted the cyclist and threatened to kill him. Driver should be in custody

So many appalling drivers have no idea there is no such thing now as road tax it’s Vehicle Excise Duty, also cyclists are permitted to be in the primary position which is in the middle of the lane if they wish too. The DVLA should make it compulsory for all drivers to complete an online course detailing cyclists rights in the road. Given that the government want to encourage and make it safer for people use bikes, to reduce carbon emissions, then given the amount of ignorant idiots like Mr T in his gold chains, much more needs to be done to train control this road rage against cyclists that’s going on. Everyone is entitled to use public roads full stop, no special rights for motor vehicles over cycles.

Well you can say that. But...I doubt you would have done any better. It's ok bitching about someone.. What they drive and how they look. This lad would probably just punch you a few times even in his flip flops. If you are going to confront people be sure you can fight. I know its against most cyclists demeanour in they tend to be middle class and physical violence is way down on the list of things they would want to be proficient at... But I think it's something that should be mandatory...a push bike road licence and 100hrs of boxing or Thai boxing training prior to being allowed on the road. Mincing about banging on about the nuances of law... Why...just have a fight and be done with it. Motorists are always the capable ones in these videos. Pretty sure you need to hand signal if your going to change lanes because a bus stopped in front of you. Glancing over your shoulder is not indicating that you are about to change lanes. Cars use indicators cyclists use hand signals. The boiled egg was right even if he was a little aggressive

Haha why is there always some dumb argument of you have to be pro car or pro cyclist? By law cyclists have right of way (they are classed as a vehicle), if a bus pulls over then the cyclist is to move out to overtake just as a car would. Why should a cyclist have to stop any more than a driver should? I'm not even a cyclist lol, it's just right or wrong innit and by the letter of the law and highway code, the cyclist had right of way. Couldn't disagree more. The driver was aware the cyclist had a camera, was wrong and wanted to intimidate the cyclist into doing what you suggested of 'nothing'. You're saying the cyclist triggered the car driver into assaulting him and so it's his fault. That's ridiculous and by that logic all rapists are innocent of their crimes by attractive people walking around in public. The facts are: the cyclist remained calm, didn't react to the car driver's threats and intimidation, took him to court and won. That's how it's supposed to work and in this case did. So the car driver will think twice next time he's in a rush instead of continuing to think he's the centre of the universe and should risk other's lives by driving dangerously. FYI I used to be a cyclist in London, am now a biker and car driver.

The moment the cyclist said you’re being recorded on camera, even I would have gone crackers! It was a smarmy move on the cyclist’s part considering the situation. Recording the motorist is what incensed him to kick off

I've driven in London for 25 years, and I try so hard every day not too knock a cyclists off (Un intentionally) it's hard enough with bikes both sides as it is without people riding like this (by the way I ride a motorcycle aswell) however not like London riders (taught not to undertake!!!!) Yeah RIGHT !

Granted there are some good and bad cyclists out there, same as any other road users. But the cyclist does not have to yield and as a motorcyclist and car driver, you should know this. Maybe you learned differently and if you've been driving for 25 years, the Highway has been updated quite a bit since then. Surely your motorbike instructor mentioned being in the priority position? And mentioned why this is important? The cyclist was wrong for going for confrontation, not for failing to yield.

I know the driver, he's a decent guy we were at Dulwich college together. Hes an actor,the accent is put on.He lunches at" Le Gavroche "in Mayfair. Always gets a decent table. Their dress code is not as strict these days.Or maybe it was Fat boys cafe in Thornton heath.

That area is pretty much wall to wall cyclists, especially on the weekend. Can't say I ever had any issues when I worked in the area. Al Mos thing is everyone owns the road. Which was exactly the cyclists point. He has every right to be in the middle of it. Especially when he was behind a bus and preparing to overtake it. What the driver did was dangerous but not uncommon in London. As a cyclist myself in London I would have cycled in a similar manner but I wouldn't have bothered calling the driver out on it because he passed without any problem in the end.

Speaking as a cyclist and car driver, it was the cyclist in this video that was at fault. Never in any physical danger from the car he seemed to be deliberately courting confrontation with another other road user.

I too am a driver and cyclist but it looks like the cyclist had to swerve out of the way of the Shogun driver’s dangerous overtaking maneuver (0:35). The driver himself said that he believed the cyclist had no right to overtake the bus before him.

Cyclists run red lights every single day where I live. At every junction you can guarantee that when there’s a red light there will be a cyclist flying across like they own the road. It’s such a danger to pedestrians.
