I work in auto insurance and have two avenues of thought on Chris’ story. One: The insurance company totaled his car in the second accident (also called a “loss” by insurance companies) and paid the car’s value because they (insurance company) might not have been able to determine what damage was fresh and what was prior damage from the fire. This is called overlapping damage. Two: The insurance company that totaled the car the second time did not do any checking and just paid the car’s value without checking to see if the car had already been deemed a total loss beforehand. Either way, do not try to commit insurance fraud. You can be deemed an uninsurable risk by insurance companies (plural) and end up playing a LOT more for your insurance for many years. In some states/countries, insurance fraud is a criminal offense and can result in charges filed against fraudsters.

out of curiosity (since im not a resident of the states) what if it was unintentional? i mean it IS Chris we're talking about here i highly doubt he planned that

In my mind, they probably should have updated his car's title to salvage after the first accident and re-assessed the value, and it seems like that wasn't done for some reason? In that case, then the other party should have consulted Chris's insurance company and realized they would only have needed to pay out the newly assessed value after it's salvage title. It is odd for an insurance company to not try to weasel into paying as little as possible, so it's probable that for some odd reason Chris's insurance company never updated his car's title after they paid out.

@@jacobkatz1423 No, but there is intent. The penal code of Texas (where Chris went to school) mentions intent in the statute regarding insurance fraud. He could rightfully assume they'd have the previous instance of being totaled on record and that any money he got from this accident was justly given to him, thereby granting him a lack of intent defense.

Only if he had an intent to defraud. If he just contacted his insurance company and said “hey, I got hit in an accident” and they just cut him a check, that’s their screw up.

You are allowed to drive totaled cars in the US? How can you still have insurance if the net worth is the scrap?

Typically a car that’s been deemed a total loss cannot get “first-party coverage” in the future, meaning a person cannot get comprehensive and collision on it.

@@SteveTAGamer Huh. Over here, technical total loss in uninsurable in general and driving outside of private property is forbidden. Economic total loss can still be insured under some circumstances(old timer insurance, special vehicle insurance) but they are either extremely expensive or subject to specifics(can't be used on weekdays 6-18h,...).
