مسلۂ پاکستان ایک انتہائی سنجیدہ اور اہم مسلہ ہے. ویسے تو ہم کہتے ہیں پاکستان کا مطلب کیا لا الہ الا اللہ محمد رسول اللہ . لیکن پاکستان کے دستور آئین میں اس کلمہ کو اسلام اور مسلم کی تعریف نہیں بناتے. بلکہ اس میں ایک اضافہ کرکے اس کو لازمی جزو بنا دیتے ہیں. اب ہم ذرا خود ہی غور کر لیں کہ ہمارا کون سا قول صحیح ہے. پاکستان کا مطلب کیا والا نعرہ یا دستور کی پیش کردہ تعریف. اسلام ازلی و ابدی دین ہے قران اللہ کا ازلی و ابدی کلام ہے. اللہ کے کلمات تبدیل نہیں ہوتے. اسلام کی ازلی و ابدی تعریف کلمہ طیبہ میں کردی گئی ہے. اس تعریف سے ہٹ کر کوئی (اور) تعریف قابل قبول نہیں ہے. The standard definition of Islam is well addressed and well contained in Kalimah Tayyibah. Any other definition deviant from it is of little use. The definition adopted by our constitution is itself problematic. It does not adopt a universal and ageless definition. Rather it makes the definition relative. Means relative to a particular time-bound situation. That's how and why it loses and deviates from the universal meaning of Islam and Muslim یہ ریاست اسلام کے نام پر بنی. ریاست کا قانون اس کے باشندوں کو شہریت اور شہری حقوق دیتا ہے. کیا آپ نے کبھی غور کیا ہے کہ اس ملک کا آئین قانون دستور ایک مسلم کی کیا تعریف کرتا ہے؟ پاکستان کی ریاست حکومت اور قانون نے مجھے ایک مخمصے میں ڈال دیا. اللہ ہی سے فریاد ہے کہ مجھے اس مسلے سے نجات دلائے آجکل مجھے مسلۂ پاکستان نے پریشان کر رکھا ہے ہماری آئینی و قانونی تاریخ میں مسلم کی تعریف پر بہت لے دے ہو چکی ہے The Constitution of Pakistan defined a Muslim as a person who believes in the unity and oneness of Allah, in the absolute and unqualified finality of the Prophethood of the Islamic prophet, Muhammad, and does not believe in, or recognize as a prophet or religious reformer, any person who claimed or claims to be a prophet, in any sense of the word or of any description whatsoever, after Muhammad. یہ ابھی صرف تمہید ہے اور میں لوگوں کا رد عمل دیکھ رہا ہوں کتنے لوگ اس کو سمجھنے کیلیے تیار ہیں. مسلہ واقعی بہت بڑا ہے جس کیلیے ہمت حوصلہ اور تحمل کی ضرورت ہے. جس قدر میں سمجھا ہوں میں یقین رکھتا ہوں کہ ہمارے دین اسلام کا اولین تقاضا اور بنیاد (fundamental) کلمہ لا الہ الا اللہ محمد رسول اللہ کی شہادت ادا کرنے پر مکمل ہو جاتی ہے( اور اس سے زائد کی ضرورت نہیں ) اصل مسلہ ہماری دستوری اور آئینی تعریف میں یہ ہے کہ وہ اس کو کسی خاص صورت حال سے متعلق کر دیتی ہے. وہ کلمہ طیبہ کی شہادت پر ختم نہیں ہوتی بلکہ اس سے آگے بڑھ جاتی ہے. وہ کہتی ہے کہ اب صرف کلمہ کی شہادت ہی کافی نہیں ہے بلکہ اب کچھ انکار بھی ضروری ہیں جن کے بغیر مسلم کی تعریف مکمل نہیں ہوتی. اصل مسلہ ہماری آئینی تعریف کے بعض مقامات پر اطلاق سے پیدا ہوتا ہے. قانون جسے ہم قانون کہتے ہیں یہ کوئی مذاق تو نہیں ہوتا جب دنیا اور انسانوں کا بنایا ہوا (غلط) قانون اللہ کے دین اور کلام سے ٹکرانے لگ جائے تو زمین میں فساد تو رونما ہو گا اس ریاست نے ہمیں شہری حقوق دیے ہیں. ہم اس کے قانون کو (شرائط وضوابط کے ساتھ) مانتے ہیں. کیا ہم اس طرح کسی غلط قانون کو بھی ماننا شروع کر دیں پاکستان شائد وہ واحد ملک ہے جس نے اسلام اور مسلم کی معیاری اور عالمگیر تعریف میں (غیر مطلوبہ) اضافے کر دیے ہیں . اس کا مطلب ہے کہ ریاست اپنے شہریوں کے مذہب میں دخل دیتی ہے اور ریاستی قانون کے جبر سے اپنی پالیسی مذہبی معاملات میں بھی dictate کرتی ہے. حالانکہ ریاست کو مذہب کے معاملے میں معتدل اور غیر جانبدار ہونا چاہیے علماء اور فقہاء اسلام اور مسلم کی ایک مخصوص تعریف پیش کرتے رہے ہیں. انھوں نے ایک اصطلاح ضروریات دین متعارف کروائی اور اسے تعریف کا لازمی حصہ بنا دیا. حالانکہ یہ اصطلاح اسلام کے ماخذوں میں کوئی وجود نہیں رکھتی اس کا کہیں سراغ اور اشارہ نہیں ملتا لہذا یہ اصطلاح غیر مطلوب اور غیر ضروری ہے پاکستان کی ریاست اس مقام سے بھی آگے بڑھ گئی جس سے تجاوز کرنے کی دین میں اجازت ہی نہیں ہے کیا پاکستان کی ریاست دین اسلام کے اوپر کوئی سند یافتہ ہے. یہ اللہ کے کلام کا حسن اور اعجاز ہے کہ وہ کوئی ضروری چیز چھوڑتا نہیں ہے پاکستان کی ریاست علماء اور عوام کو چاہیے کہ وہ اسلام کی ازلی وابدی تعریف پر راضی اور مطمئن رہیں اور اس سے آگے نہ بڑہیں. اگر وہ اس سے آگے بڑھتے ہیں تو عملا وہ یہ کہتے ہیں کہ وہ اللہ کی بتائی ہوئی ازلی و ابدی تعریف پر تو مطمئن نہیں ہیں . بلکہ اپنی طرف سے ایک نئی تعریف پیش کرکے مطمئن ہونا چاہتے ہیں. کیا پاکستان اور یہاں کے علماء کا علم خدانخواستہ اللہ سے بھی بڑھ گیا ہے. اس سارے مقدمے کی بنیاد اس مفروضے پر قائم ہے کہ فلاں لوگ یقینا غلط ہی ہیں یا فلاں لوگ یقینا غلط ہی ہونگے ذرا دل تھام کر یہ تو بتائیں کہ کیا اسلام میں ایسے مفروضوں کی بنیاد پر مقدمہ قائم کرنے کی اجازت ہے
