Of course Morrissey lied on the stand about why Erlinda quit and blamed it in the judge televising it. Morrissey is a liar through and through. I'm glad Erlinda had the ethics to walk away.

Chris, people keep missing the reason this is so important. This actually provides an answer of how the killing occurred in the first place.The key is regarding the silver vs brass primers. Remember, Seth-Kenny provided the training, guns AND ammo to Hanna. Seth-Kenny outsourced the ammo reloads (if you are not a gun guy, or country girl, you will think the only way you get a bullet is to buy one off the shelf, in a prepackaged box), this is not so. People who shoot a lot make their own bullets which are called reloads. RELOADS significantly reduce ammo costs as you reuse the most expensive part of the bullet..aka jacket. You then add either dummy content or LIVE content, place a primer around it and you get a new bullet. The bullets on the Rust set were reloads, facts already established. The reloads were outsourced from Joe (there is his name in evidence). Joe was known to use both BRASS OR SILVER primers and was not consistent in which he used for dummy and which he used for LIVE rounds.IF Hanna was taught that all silver primers were dummies, she would only be half right, half of the time. Remember this new evidence is key because it was said to be from the same BATCH of reloads sent to the Rust site. DOES NOT MATTER IF IT EVER ENTERED THE RUST SITE. This would prove the inconsistency in primer usage and perhaps point to the true failure in the safety process. Hanna could never have been able to tell simply by looking at the bullet to determine if it was a dummy or not since no consistency in the primers existed. She would have to pick it up and shake it. IF Hanna was taught that silver primers, for example, were always dummy rounds but that she should shake them as an “extra” assurance (whatever that means), then you can see that the safety failure on the Rust Site occurred way before filming and way up in the supply sourcing chain. It at least explains how someone died.

"Horse play" is a matter of opinion. People who know how things are actually done would say that Baldwin was practicing for a scene to make it more realistic. The attorney is just trying to cover her butt. Shameful

It is her indication that it was horseplay, that is just opinion. Other actors might say he was rehearsing a scene, trying to make it look realistic. She was trying to justify her involvement in the case. She has probably never been on a western movie set to know the protocols they use. Guns are pointed at people; no actors should not be "checking their weapons." Armorers are the final word on whether a gun is safe for the actor to wave it around or point at people for every specific scene. Industry protocols have worked for decades. It is only when the protocols aren't followed that things can go wrong. The armorer failed to follow protocols.

Chris, your guest is wrong about SAG/AFTRA. The actors are not in charge of the weapons. The Armorer is. Baldwin should have had the Armorer there to help him get used to the weapon & choreograph the scene. The unions know that actors can not focus on their job & try to be Armorers, Stunt Actors, Electrician or run the Craft Food Service.

@@tammylynnarts23 She was at the scene when the shooting happened. Part of her defense (excuse) was that she had too much to do. A professional armorer should say no to additional responsibilities if safety might be compromised. Their very existence on the set is for firearm safety and helping the actors with the weapons. She said the weapon was cold, actors aren't supposed to check weapons.

What does the ammunition on the set have to do with the charge against Alec Baldwin? He wasn’t charged with an ammunition charge. The prosecution really went down the ammo rabbit hole.

Agree but there's a story out there that the ammo supplier wanted to sabotage the armorer and he got live ammo on the set...it's outlandish but the defense could have claimed that if they knew about it. And if true the armorer could use it for a dismissal if her case. He got off on a technicality and it's not just in my opinion but that's life. Prosecutor blew it.

A Brady violation is still sanctionable…evidence not turned over in this case, relevant or not, is the ONLY thing that was going to save Baldwin. And his attorneys KNEW THAT. This was a gift from Morrissey. On a platter. Baldwin fired that weapon and shot that woman and he’s still a horrible person.

I'm not a lawyer, but I believe it has to do with the legal doctrine of superseding cause. Basically, if Person #1 is more to blame and acted first then they mitigate Person #2's culpability, even if Person #2 was negligent.

They should never have brought charges in the first place. The guilty party responsible is in prison I* am an actor / stunt performer, former military for over 20 years I have worked with weapons on movie sets. I am a small weapons expert, even with all my experience I have never been allowed to check, load or unload a weapon on a a set, ONLY the armorer can do that. The only time I load or unload a weapon is when it is called for the character to do it on camera. Then I will examine and shake to verify they are dummy rounds. I have worked on sets with Alec, he is a first class ahole. If I thought he was guilty I would be leading the charge to convict. I had an long argument with that more@@@ John Schneider when he went on camera with a brand new single action saying how it can never fire without pulling the trigger. They can, will, and have. Ruger was sued over the Blackhawk singel action for that very thing, people loaded them, jolted and tehy fired without the trigger being pulled.. In the day there was a thing called the cowboy load, they left the hammer on an empty cylinder "so I won't shoot my knee off". I also compete cowboy fast draw, with singel action the trigger and the hammer meet and lock, with high use the metal wears down, and they SLIP off without the trigger being pulled. I carry spare hammers, triggers, and springs because in high use competition they fail all the time. Schneider is full of it. Alec is innocent .......... of this crime at least

It's interesting she failed to note what the judge did - that the ammo that was concealed was relevant and material to the defense and may have proved how the live rounds got onto the set.

I truly believe that the Defense knew about the rounds and they also knew about and had seen the Lapel Cam Videos of Troy dropping off the rounds at the Sheriff’s Department because they knew way too much and, Troy was good friends with Hannah’s Father. Also Troy specifically said that he wanted the rounds to go to the Defense so you’re telling me the Defense didn’t know anything about this? That they didn’t contact Troy and didn’t know who he was? I think there was something Fishy about that whole situation and they wanted to create a Smoke Screen and to do a little misdirection in front of the Jury and focused on the whole where did the live rounds come from, even though it was completely irrelevant in the Baldwin case.

​​@@nickv7793When Troy said he wanted to give it to the "defense" he was referring to the defense in the Hannah Gutierrez Reed trial. This defense team probably found out about it the day or two before they exposed it. They have a team to look into things. Even if they found out about it a few days BEFORE this trial started they would have to investigate to see if it was legit before they presented it to the court and the prosecution STILL committed a Brady violation. Accusing them of being underhanded or doing something unethical is horrible.

The bodycam video belonged to the sheriff's office, no way the defense could have got to it first. The whole point of this is that Baldwin defense did not know about this, Hannah and Baldwin have different lawyers.

It’s the actors job to act. It’s the armorers job to organize the guns and ammunition and to maintain all gun safety on set. Why were they using real guns? Why were real rounds on set? Even if Alec pulled the trigger, why were there even rounds in the gun during rehearsal? Lax set safety that let several employees to walk off set.

Was there negligence on the set? Yes. Was Hannah Gutierrez competent to be in charge? No. Is Alec Baldwin at fault? Not criminally. He thought the gun had been cleared. Any actor handed a gun on a set makes the presumption that the prop and the armorer have cleared it as safe.

What still is being ignored when prosecutors say Baldwin pointed the gun at a person is that the process at the moment it discharged is called "blocking". Baldwin was under the direction of others practicing his moves that would later be on film. The blocking process establishes camera angles and lighting for future use. He didn't deliberately target anyone. He was told to angle his body a certain way, hold his head in a certain position and point the gun in a specific direction. That's how movie making works. He was just the actor holding the gun.

When an actor gets in a car to drive it in a movie, do they have to check the engine and the wheels and the oil for safety reasons too? Oh, and I assume they have to make sure their passengers are seat belted because again, it's the actor's duty to make sure their actions are totally safe.

The "cardinal" safety rules aren't and can't be followed on a movie set. For a 100 years real guns have been pointed at people on movie sets. What she deemed as "horseplay" others would say he was rehearsing a scene to make it look realistic. She probably has never been on the set of a western in her life. Turn on your TV and you will see people pointing real guns at people. The protocol is that actors don't check their guns when it is handed to them by the armorer. It is much safer that way. Can you imagine actors in Saving Private Ryan having to know how to "check" 10 different American and German guns including machine guns to determine a blank from a dummy or a live round, that would be chaos and would cause more injuries and more fatalities. Look up Garand Thumb. The judge made the right call. The DA should never have filed charges. The armorer was responsible and sentenced to prison. Often in police trainings real guns are pointed at people after confirmation that they are not loaded. Movie sets aren't the only place that happens.

The New Mexico District Attorney who was just up for political RE-ELECTION in June, is the one who decided to press charges against Baldwin. Her challenger was critical of her ability to handle high profile cases like this one during their campaign. Then somehow the FBI got involved in firearm testing of this gun, even though it's a local case involving an accidental shooting. Why were the Feds involved? Why do all these people have their pitchforks out for Alec Baldwin? Bcause he made fun of Donald Trump on SNL. Politics .

This never should have been charged as a IM (involuntary manslaughter) case, for the same reason Dick Cheney didn't do time when he shot the fellow bird hunting. The state of New Mexico owes Baldwin and his family an apology.

When I took gun safety classes the FIRST thing we learned were the four rules of gun safety...you never EVER have your finger on the trigger unless you're prepared to shoot, possibly kill, and know what your target is and even what's behind it. Baldwin is a careless, remorseless, dangerous,, arrogant show-off and I'm sorry to see him get off scott free.

Stating that horseplay with blanks is against SAG guidelines, shouldn’t equal culpability for manslaughter when the Alec was told the gun wasn’t loaded, by the armorer who’s job it was to keep live rounds off set.

Police officers who have been dishonest are sometimes referred to as "Brady cops". Because of the Brady ruling, prosecutors are required to notify defendants and their attorneys whenever a law enforcement official involved in their case has a confirmed record of knowingly lying in an official capacity.

They didn’t compare how the Rust movie was filmed compared to other films being filmed. So we don’t have any clue what is typical on a movie set and if what Baldwin did on Rust was different than other sets. That was never presented at the first trial and would have probably been at this trial.

How many times did Arnold Swartzengger point a gun at another human and pull the trigger in the Terminator franchise? How many people has Arnold killed on set? The answer to the last question is none, not because he didn't point the gun or pull the trigger, but because the Armourer did their job properly. Again, if the Armourer supplied weapons to play with on set, then they weren't doing their job then either. Baldwin didn't bring the gun to work with him, someone handed it to him.

The sad part about this is justice was not served for the victim. That started with the destructive testing of the firearm. That individual knew better. Then again it was in an FBI lab. Surprise Surprise. Hanna’s family was never going to see the shooter actually face justice. If the case was dismissed over non reported found ammo what do you think would have happened when the defense could not have the weapon tested themselves. This stinks to high heaven.

I'm tired of hearing people say that movie sets are an exception to the rule, that actors are exempt from handling firearms safely. I'm sorry, but no. There are no exceptions. No one is exempt. These are not toys. They are deadly weapons regardless of being on a movie set, regardless of a seasoned expert assuring you it's okay. The majority of experts will tell you it's never okay to point a real-life deadly weapon at someone (outside of self-defense). It's especially not okay to then pull the trigger. The fundamental rule of firearm safety ("Treat every firearm as if it were loaded") applies everywhere, to everyone, and at all times. No exceptions. If you need to point a gun at someone for training, demonstration, or entertainment purposes, use a dummy or prop gun. By that, I mean a clearly marked replica or "deactivated" firearm incapable of firing a deadly projectile. These are safe to point at each other, and they are not that difficult to obtain. Any real gun can be rendered into a prop. They can be altered to only be capable of firing blanks. Easier and safer than that, they can be rendered incapable of firing anything at all but still retain mechanical operation. Even easier and safer than that, they can be welded shut. It may be cheaper to have an armorer create these props for you than to have them on set every day micromanaging everything. There is no need to point a real-life, functioning deadly weapon at someone (outside of self-defense), especially with a Hollywood budget. Alternatively, you can use camera tricks or rewrite the script to fit your capabilities. Be creative. Safety comes first. No exceptions.

Reckless and Careless on Baldwins movie set. To many live ammo and a few fake. His gun was real with real live bullets. He was taking shot after shot till his finger pulled the trigger. The Canon shot went off and tore through that woman body and out enough to hit another person behind her. Sad circumstances for all involved. There was no sense of safety on that set. If the family still decides to pursue, best bet to file civil case against Baldwin productions on set of this movie. Disregard for safety on this set. Carelessness and reckless handling of real guns with live ammo.

He pointed the gun, pulled back the hammer, and pulled the trigger. That is a no-no everytime. Should his trial have been dismissed with prejudice due to the Brady violations? Absolutely. Too bad Baldwin isn't going to prison. But, the law is the law.

I completely agree. He was unquestionably negligent with handling the firearm and lied about pulling the trigger. But our legal system is based on rights and the cops & prosecution blew it. We wouldn't want that (and don't) for those that are innocent. Disappointing result but the correct one.

This woman on the video hasn't a clue. In the military, we loaded blanks into our real M16s and fired then at each other in training. I've fire as many blanks at other soldiers as I've fire live round at targets, and I've fired many, many thousands of rounds at targets. Baldwin would not be conducting horseplay if asking another person to run back and forth as he fired blanks at him. At distance, the blanks are not dangerous whatsoever. They are a problem up close only. He would have done this so later, during his scene, it would be easier to visualize where the people he is supposed to be shooting at would be. It's a technique like any other actor's technique. Nothing they did on Rust was inappropriate or unprofessional. They were following the rules. The problem people have, like the obtuse woman in the video, lies in a two-word phrase - real firearm. Without bullets, a real firearm is no more dangerous than a plastic toy pistol as long as the set has been sanitized of real bullets. The rules on set are not the same as the rules at a rifle range. The rules are different. When I heard about the distribution of the real bullets, especially how they discovered one in Baldwin's gun belt, I realized the notion someone planted the live rounds on set was not so far-fetched. In the end, the armorer may have been innocent after all. I'm willing to bet her conviction is overturned, and she gets a new trial; or they simply overturn the convection and let her go. I'd put money on it.

Indeed he got lucky! This is probably the only case in US history where the cops are on the stand admitting to hiding evidence, the prosecutor got on the stand in her own trial and admitted to hiding evidence and then tried to blame it all on the cops. The co-prosecutor resigns in the middle of interrogating witnesses. Just closes her computer and walks out of the courtroom. This will be a class in every law school for years to come. Alec is lucky he had money for good attorneys and investigators. The average broke Joe cannot go toe to toe with the corrupt judicial govt. All they had to do to nail him was to play fair but they couldn’t. They never do.

Anyone with half a brain knows that you don't point a gun at anyone, and you check every gun to make sure it's not loaded. What's next if you hit someone over the head with a hammer are you going to claim the prop guy said it wasn't heavy enough to kill someone? It's absurd how this guy can blame someone else for his own incompetence, or was it? For all we know he could have planned to kill her and make it look like an accident. After all he is an actor!

First off he had 2 people that were hired to make sure that something like this couldn’t happen. The safety manger and the armorer. They both cleared the gun. They are the experts and are the ones checking it. Alec Baldwin is an actor not a gun expert. Him checking the gun would d absolutely nothing when the other two have cleared it. All it would have done is make the other two reclear the gun because is the actor tampers with it it is no longer clear. Alec is expected and is told to respect the experts when it comes to the gun. It’s like a cna being told to administer a certain medicine and when they do they are culpable instead of the doctor that ordered it. That’s absurd and disgusting reasoning. If the doctor has the correct training and experience to make that call not the cna. The safety manger and armorer have the training and experience to call cold weapon not Alec. Once cold weapon is called it is a movie prop and nothing else and he is free to practice his scene.

They are playing a role when the cámaras are rolling, they are still subjected to law and safety. They are not in a literal fight with guns, they have a choreography and between the takes the have time to check the damn guns. It is just as simple: you use a deadly weapon to play, at least check it beforehand.
