EDIT: following publishing Ryder reached out and informed me that he had in fact presented his findings to Yuga before going public. He is also adamant that he is not low-level trolling nor that he wrote the post on 4chan although someone was indeed sponsored to create it. Leaving many unanswered questions. We will attempt to do a follow up as the film is obviously missing his voice. Which it needs.

Yuga have been exceedingly generous with rights to holders so it's a moot point. Ripps picked BAYC for this because he is an irrationally obsessed bunny boiler. Aronow dubbing him 'a demented troll' is accurate. If he wanted to make a point on IP activism he could have attacked DMCA-happy Tyler Hobbs' Fidenza. But he didn't. Anything to get rich and famous, even if it means destroying the value of actual digital Art considered an important part of the NFT not throwaway. Who is he to fuckin' decide the image is not an important part. Tunnel visioned and arrogant. But there you have it, Ripps will destroy the entire space for Artists if he has to cos he doesn't GAF about anyone else except his OWN success. Case closed.

I think a lot of what the lawyer you had on falls moot and is actually a weak argument for yuga labs because parody/recontextualization of art is protected under the 1st amendment and is considered a form of protected free speech! The intro was funny though!

@@FukU2222 Lol yeah but Ryder didn't really mechanically "copy" any visual content, the token just has the same link to the IPFS in the smart contract. Blockchain tokens are different from youtube video uploads. Yuga is not pursuing any copyright charge in the lawsuit. Also, trademark infringement usually deals with confusion with origin or source of goods. Ryder had a disclaimer with the purchases of these tokens that they were not affiliated with yuga whatsoever and that they were along the lines of parody/protest/criticism/satire.

Isn't what is sold just links and text on the blockchain that happen to link to images? It would be the fault of the marketplace that uses those links to bring the image forward for tricking any customer by not properly labelling the collection as something other than the legit BAYC project. It's very easy to know if you are buying an NFT from the real BAYC contract or another if you are simply exchanging NFT's directly on the blockchain. Not sure Yuga actually can win this case. And their greatest fear here is not only the 4chan meme art being talked about, it's that RR is trying to make a 0% fee marketplace for Yuga's NFT's which will cut them off from royalties. Their investors must be pretty angry about the prospect.

I don't think they should settle with RR, I think they should crush him and make an example out of him. Taking advantage of people's ignorance to confirmation bias, social proofs, and the like to smear someone else and profiteer is unacceptable in my opinion and nobody who behaves this way should see the light of day (that includes much of the sensationalist media as far as I'm concerned). Really hoping to see justice prevail here. The spirit of Web3 is not to let those who have committed criminal acts evade prosecution, it's to hold the courts accountable when they themselves fail to behave justly.

They wont lose. They will win solely on federal copyright and infringement laws. The trademark office has a specific code to trademark nfts now. Any art created under that trademark is protected under federal laws. I just helped a friend file for a trademark for their digital collection.
