जब तक दाखिल खारिज ना हुआ हो, Sale deed को सब रजिस्ट्रार ऑफिस से कैंसिल किया जा सकता है । दाखिल खारिज होने के बाद सेल डीड को कैंसिल करने के लिए सिविल कोर्ट में एप्लीकेशन देनी होती है । इस पॉइंट को कृपया क्लियर कीजिए ।

सर नमस्कार कोई व्यक्ति नेरजिस्टर्ड सेल डीड की दूसरे व्यक्ति के नाम करने के दौरान वह ब्यौरा लिखवाता है मैंने यह प्लाट 1985 मैं खरीदा था जमीदार से मगर वह जमीदार की कोई डॉक्यूमेंट चैन नहीं देता तो क्या सेल डीड वैलिड माई जाएगी और जमीदार मर चुका है

A ka bhai B jisne sharab k nashe me C ko 2011 me POA krwa diya or sare rites de diye jo ki registered h POA. ab C ne apni patni D ko 2012 me registry kr di bina GDA ki permision k or jisme A ka bhai B gwah ban jata h jo ki power of attorney krte time bhi gwah tha.jiski rasi kisi A ko nhi di jati.sirf registry me likha h ki gwaho k samaksh Rashi de di gai h. Sale deed is done on June 1996, in the sale deed the godown area mentioned is 435 sq.ft but actually area is 598sq.ft so it is fraud by buyer Misrepresentation of area 598-435=163sft and 163sq.ft area is used by buyer since june 1996. Seller was uneducated and his son was minor in 1996 and now his son is adult and well educated Can seller's son cancel the sale deed? No payment given for the 163sft, No standuty paid for the 163sft pl.suggest your opinion

सर, मेरी case में buyer ने part. paid किया और बाकी amount के चेक दे दिये। जो बाद में dishonour हो गये, बाद में मैने उसें adv. के द्वारा legal notice भेजा । तो buyer ने मुझे नोटबंदी का कारण बताकर Case file ना करने की request की और कुछ महिनो में मेरा पुरा amount देने की बात की कही। जिससे वो3 महिने बाद में अपनी बातों से मुकर गया, मैने भी उसें legal possession नही दिया । पर सर मेरी जमीन का gut no. Change हो गया हे land consolidation ऍक्ट के बाद इसके बारे में मुझे भी पता नहीं था इस बात का पता उस वक्त मुझे चला जब मैने land record office मे fees भरके जमीन नापणे के लिये आवेदन दिया । अब मेरा possession एक जगह है और मेरा gut no. कूछ और है। क्या ऐसी situation में मेरी की गयी sale deed cancel हो सकती है?

Airji Mera bhi land ka deal hua tha. But buyer ne half 2 lakh payment diya unke baad diya nahin in between he done construction and run school. Now for remaing payment we did court case bust he not payed and court mentioned in doc that if in 6 months he not pay remaing the deal is forbid. And he not payed. Now we don't know what to do. He is still runing school since 14 years . He is payse wala party hai kya kare plz help

Sir,Good evening My father had done baynama of agricultural land. But they had not given my and brother part of land and we brothers are not agree of this sale. Purchaser had done some payment thru check. When we talked regarding the cancelation of agreement, he is demanding double amount and also warning that he will do the registry thru court directly. I request you kindly suggest me the easy to cancel the baynama and how we can avoid the double payment asked by purchaser. Can purchaser do the registry thru court directly or it is not possible. Respected sir, Instead of cancellation of sale deed under sec 31 of specific relief act, can I rescinding the sale deed under section 27 of specific relief act? What is difference between rescission and cancellation in practical layman language ( whether court treated both equitable remedies separately or what exactly) Sir, pls reply Regards.

Sir l am a 73 y 8th class educated lady my son and daughter in law fraudently made Sale deed in 2012 by me showing the consideration of Rs 15,40,000/- in adv that was not in my knowledge I was filled a civil case in 2015 for cancellation of sale deed still is pending and on the stage of evidence is it possible on the ground of fraud and non transection of payment pl make a right answer also in public interest

Yes It can declare void on ground of fraud U need to follow up court and convence court for early disposal of suit

If we mention in sale deed that if sale consideration cheque dishonoured then sale deed will be null and void. Then we can cancel sale deed or not..
