As the search for the next chief justice is underway we look again at the interview of the outgoing Chief Justice Mogoeng Mogoeng in which his ethics also came under scrutiny. The road to the highest office in the judiciary was smooth for Chief Justice Mogoeng Mogoeng whose term of office comes to an end in just over a week. He had to fend off criticisms and mounting calls for him to withdraw his candidacy.

Judge Mogoeng is a spot on man. These debates in the clip shows a lot of gaps within the judiciary especially regarding ethics. As citizens we except high level of interpretation of ethics from judges, yet it looks like we are proven wrong all the time. An SOP regarding sitting in when your family is to appear should be drafted and erected.

I watched the proceedings live. Things were not this crystal clear then in the absence of hindsight. He came across as arrogant and intolerant of being questioned. He had to apologize for interjection. People were skeptical of him having "met" then president. His role as an erstwhile bantustan prosecutor came up, his response as an FDI very telling of the times. "Istraight lendaba" comments by then Justice minister and DCJs retort to them lent to the charged atmosphere. His staunch religious beliefs were also brought up. Watch the entire interview for balanced comment. Ten years later I still remember it well.

But I think the SABC failed in this reflective insert, they are painting a picture of a 1 dimensional individual. Balance or even contrast would have worked better here. That part of the interview suggests Mogoeng is not scrupulous, but his Judicial Leadership has very few dents to write home about. The Gwede Mantashe swore in hand shake makes him look like he was compromised as it ties in with the question about him. Given what the constitutional court became during his tenure, I would say he is by far the most non conformist judge we have ever had. Chaskalson, Langa, Ngcobo we very mute and aloof.

Throwing another titbit, the IFP rep said that in his 20-odd years of interviewing Mogoeng was the most arrogant and of course the CJ replied allegedly self-righteously. Can people stop quoting 'blood is thicker than water' incorrectly: The real meaning of the quote is exactly the opposite of what people are trying to prove. The full quote is "Blood of the covenant is thicker than the water of the womb" meaning: that you are born from the same womb/lineage means nothing compared to fighting battles with someone in the field. You will thus be closer to a stranger that you overcame struggle with vs merely siding with someone on the basis of lineage.
