The Economic Freedom Fighters (EFF) and the African Transformation Movement (ATM) are in the Constitutional Court today, challenging Parliament's decision not to proceed with an impeachment inquiry into President Cyril Ramaphosa over the Phala Phala farm scandal. The two parties are seeking to overturn a decision made in December 2022, where Parliament declined to adopt a Section 89 panel report that found prima facie evidence suggesting the president may have violated the law during the Phala Phala robbery incident.

If parliamentary majority decisions are acceptable or prevail ( as our constitution envisages/separation of power ) then it means executive will always get away with a lot of wrong doings instead of being held accountable. It means we can anticipate that, in the future every president or his/her cabinet members will do as they please knowing that there is majority rule that always protect them from accountability. Constitutional court should resolve this matter so that when executive acts outside of the law, parliamentary majority rule does not shield them from taking responsibilities for their actions.

INCORRECT... Rationality will always be the test. The judiciary cannot debate to parliament, but the decisions parliament reaches must pass the test of rationality. Thats the difference.

People are appearing in court for stealing the same money that was illegally in the country due to forex law ! So if a thief steal my illegal money which is a crime in the country, is it right??? It does not make sense !!!!

I just hope the court refers this back to parliament, and instructs for the corrective action to be applicable to all levels of government in so far as abuse of majority positions by parties (especially as it debilitates municipalities more than national parliament)
