All prisoners are to be treated equally before the law, their previous status cannot determine how they should be treated. If the National Commissioner get himself involved in matters of the Head of Prison jurisdiction then he must do that to all the prisoners across the board.

Yes the personal medical practitioner diagnoses his patient but the medical board approves the medical condition of the prisoner. It does not mean zumas medical practitioner report simply must be accepted it does not work like that. In this case the medical parole board did not approve zumas medical report as they indicated it was not terminal and does not warrant medical parole.

Zumas doctors cannot recommend for medical parole, only the Correctional medical advisory board can recommend and the Correctional Officer can approve it. It will depend on the sentence of that particular prisoner. In this case zuma was sentenced only 15 months so he becomes the prisoner of that Head of Prison he/she can make that determination on the medical board recommendations. The National Commissioner had nothing to do with this prisoner as he was not falling under his jurisdiction.

The sentence length determines who makes the decision to grant parole. If an inmate is serving a sentence of two years or less then respobility lies on the head of the prison. Instead of being seen by parole board, they are seen by case management committee and the head of the prison makes the decision. In this case of Zuma only the head took the decision alone

For the first instance zuma was supposed to have been incarcerated in a diffirent prison but a decision was then taken to take him to this new facility that has the latest everything. Today the same Head of Prison says the opposite. At that press conference in front of the prison he and the Minister agreed on this. Today we are told that prison cannot accommodates zuma with his terminal illness but there are prisoners who are in the hospital section who are being catered to on their terminal illnesses. What is so special about zuma? Correctional Services must be fair enough and give all those prisoners who are terminally ill medical parole, all of them, not only zuma.

What does not make any sense to me is the following. Zuma legal court ruling was 15 months in jail. Fraser unlawfully decided Zuma can be released from jail before the jail term had been met. This being the circumstances Fraser messed up. So there no need for another court hearing, the original court ruling still stands, which was legally correct and needs to be implemented straight away. Stop wasting Tax Payer money, and do the right thing.

Adv Mphahlele fails to understand that this are review proceedings, the decision maker must not only disclose reports he considerd and jump to his conclusions. The court must be privy to evaluations of all reports presented before him, each or the reports cancelling the other, untill he arrives at a conclusion. That is how the Court will weigh up rationality of his decision.

Then why did the Act give Fraser the jurisdiction in the first place, to come to his own conclusion, if he was not a medical doctor? Im not going to watch further, as I can see from the ridiculous questioning by the Judges, is for one thing, and one purpose alone: Zuma must be back behind bars!

Zuma was sentenced 15 months, because of his 15 months sentence he automatically becomes a prisoner of the head of prison not of the Area Commisioner, provincial Commissioner nor National Commissioner. The parole board in the prison zuma was incarcerated must have dealt with it, not the national Commissioner. The national Commissioner only deals with prisoner's who have been sentenced 10 years and up. Life sentenced prisoners are referred as Presidents prisoners he had the legal right to decide on them with the minister. That Frazer guy was totally wrong to get involved at the level of a Head of prison. This is a layman's explanation.
