I think it needs to be more than that. Cops usually aren't filthy rich, so the problem with removing QI is getting the money from them. They will just declare bankruptcy, and I think they get to keep 1 car and their house.

@@Damitsall What they can keep depends on the state. An order for damages from a court lasts until the judgement is satisfied. It does not have to be all cash. It can be proceeds from seized property like cars, boats, and jewelry. All future income, including a pension, can be seized up to the limit set by state law. Until the judgement is satisfied a portion of any and all paychecks will taken from the cop before he even sees it. In my state the maximum is 25% of the gross paycheck amount.

That really needs to be some sort of system of strikes for officers. Just like they do in prison you get a strike for lying under oath in court. A second one for excessive force complaints. The third one for being completely wrong, you accuse a person of doing something you cuff them and lock them up you find them give them tickets of any kind' when they are proven wrong that's a strike against the officer. In a strike for dismissing people who have called them to do their job! Something that is hard to catch on camera but happens every day officers are called to a house or business, just don't want to arrest anybody don't want to do any paperwork. And because they don't do their job bullets fly later and people die. Two strikes for that. If a car was dispatched to a neighborhood or a house or business, days or weeks before

A judge can throw your entire case out if you turn down an appropriate settlement profer. It sucks but it can happen, especially when there's no physical evidence that the victim should receive a better offer. Perhaps if he'd sustained a broken arm or something, that would make this about tangible damages. Other than nerve damage which will generally repair itself after a suitable convalescence time. It sucks to say this but, that was probably the best thing the victim in this case could do.

Interrupting again after that, at any time, could be considered contempt. This is because you're interrupting an agent of the court and ignoring the judge's caution... which is disrespectful.

All these recordings listed above are pre-trial depositions, which are taken under oath which legal council present and court recorders, but not in a court and without a judge present (so no contempt possible. There are only "Rules of Conduct" for deposition hearings). The city of Romulus (or their insurers) settled before going to trial on both occasions. Giving wilfully untrue or misleading information is perjury.

@@SenorNavel You have to get the officer to knowingly "admit" that the arrest or detention is not a legal one. Usually this is done when you ask the officer for their RAS. Ex, if they say you are under arrest for "suspicious activty"... this which is NOT a Crime nor a Felony. In the video the lawyer asked the officer if the "Sole reason" for the arrest was because of the video recording, in this case the officer would have Admitted to Knowingly violate his first amendment rights which would have caused the officer to Lose his qualified immunity... he almost hung himself then redacted making any comment.

In my country, there is a law called ”police misconduct”. Fines of 1-6 months of salary or jail up to 2 years in severe cases. Last case was a cop not following procedures regarding evidence (drug spiked beer bottles left in police reception in restricted area and not locked away properly at once). The beer bottles were thrown in the trash by the receptionist and ended up at a party through a rediculous chain of event. A woman died from an overdose. Think he was fined 3 months of salary or something like that for not handling the evidence correctly and the receptionist was found not guilty since she didn’t know what the bottles contained or that they were evidence. He couldn’t be found guilty of any other crime regarding this incident. It is not perfect, but it is something that can hold police officers accountable for their actions, even when they don’t committ other crimes.

Actually by not asking that and other detailed specific questions leaves the Attorney the option during examination or cross examination to catch the LEO'S in a lie which would constitute a perjury allegation to the court. Which in turn calls that officers credibility truthfulness and integrity into question and when taken IN CONTEXT with the sworn depositions statements and testimony of the other LEO's leaves the jury zero wiggle room to Aquit or find in their favor during both a criminal or civil proceedings. While accountability is needed it's needs to go much further than simply looking at law enforcement, by and large the politicians have been given a pass on this for decades. They have fostered and by their influence and actions indemnified law enforcement to continue to violate the constitutional and civil rights of the public and should likewise be held firmly accountable.

@@johng.1703 Wasn't the RAS and or PC already in jeopardy by admitting under oath during a sworn deposition that he issued the citation upon the order of his superior and not by his own insistence or validating the citation by at least confirming use or ownership of the vehicle. Interestingly enough there are several retaliatory accusations made by the LEO's on scene prior to the vehicle inclusion that discredited any RAS/PC that shows they had none other than the subjects unwillingness to identify. Which was covered by both the state and federal legislation and understanding of said same as covered in the video. Most people don't understand that by not verbally invoking their fifth amendment right the are in essence giving law enforcement RAS/PC that can be used against them and the court will disregard any notion of them not having prior RAS/PC as they will view the precursor conversations as a willful interaction. Though this does in most cases mean you could be detained or even arrested for any number of reasons that have been given by the subject via willful verbal interaction that substantiated their RAS/PC after the fact. It appears this subject didn't do that nor does it appear that the LEO's were operating under TCOL at any point nor did they have RAS/PC ergo the escalation in criminal accusations culminating in the vehicle citation and finally with the actual citation issued.

"You can be the rap but you can;t beat the ride"? police officers can arrest you for offences that don't exist in law, and can get away with it without impact on them if they thought that they were enfocing a valid law, and and from that any escalation they do is also inline with enforcing an actual criminal law.if a police officer thinks that smiling is a criminal offense he can leagally treat it as a criminal offense, arrest you, beat you up, etc etc etc.

My favorite part of the full deposition is when he ask a cop what caused the defended to be placed into handcuff s and the cop replies resisting arrest. He is saying the reason was made after the fact. When the lawyer tries to show his the error in time the cop just goes ignorant. After hearing that I would question the cop of how he uses timing in reports because clearly he has a hard time understanding linear timelines
